About some questions of control of turnover of precious metals, gemstones and products from them at all stages of this turnover and introduction of amendments to some acts of the Government of the Russian Federation

1. Approve the enclosed Rules of functioning of the state integrated information system in the sphere of control of turnover of precious metals, gemstones and products from them at all stages of this turnover (further - Rules).

Rules are effective within 6 years from the date of entry into force of this resolution.

1(1). Commissioning of the state integrated information system in the sphere of control of turnover of precious metals, gemstones and products from them at all stages of this turnover (further - GIIS DMDK) is performed by the Ministry of Finance of the Russian Federation on subsystems (components, modules) of GIIS DMDK. The list of subsystems (components, modules) of GIIS DMDK and the requirement to them are determined in the technical documentation concerning development and functioning of GIIS DMDK.

1(2). For commissioning of GIIS DMDK (subsystems (components, modules) of GIIS DMDK) the Ministry of Finance of the Russian Federation creates the interdepartmental commission on acceptance of results of the performed works on creation and development of GIIS DMDK (further - the commission). The commission without fail joins representatives of Federal assay chamber, Federal Tax Service, federal state institution "Public Institution on Forming of the State Fund of Precious Metals and Gemstones of the Russian Federation, Storage, Leave and Use of Precious Metals and Gemstones (Gokhran of Russia) under the Ministry of Finance of the Russian Federation". The commission is headed by the chairman who is the Deputy Minister of Finance of the Russian Federation. The commissions as required can be involved the interested federal executive bodies, Goznak joint-stock company, and also the legal entities and individual entrepreneurs performing transactions with precious metals and gemstones (including subjects of production of precious metals and gemstones) and staying on the special registry.

2. Information in GIIS DMDK is provided by the following subjects:

a) federal executive bodies:

Ministry of Natural Resources and Environmental Protection of the Russian Federation;

Federal Agency on Mineral Resources;

Ministry of Industry and Trade of the Russian Federation;

Ministry of Internal Affairs of the Russian Federation;

Federal Service for Financial Monitoring;

Federal assay chamber;

Federal Tax Service;

Federal Customs Service;

b) federal state institution "Public Institution on Forming of the State Fund of Precious Metals and Gemstones of the Russian Federation, Storage, Leave and Use of Precious Metals and Gemstones (Gokhran of Russia) under the Ministry of Finance of the Russian Federation";

c) Goznak joint-stock company;

d) legal entities (in addition to this Item specified in the subitem "v"), the individual entrepreneurs and artists-jewelers performing transactions with precious metals and gemstones (including subjects of production of precious metals and gemstones) and staying on the special registry;

e) Central Bank of the Russian Federation;

e) credit institutions.

3. Information provided in GIIS DMDK by the subjects specified in subitems "an" and "b" of Item 2 of this resolution shall meet the following requirements:

relevance;

sufficiency;

reliability;

security;

timeliness.

4. The list of the data (information) represented to GIIS DMDK, the list of the data (information) received from GIIS DMDK (including data (information), access to which is limited in accordance with the legislation of the Russian Federation), and also the procedure and terms of connection to GIIS DMDK are drawn up by the agreement between the subject specified in subitems "an" and "b" of Item 2 of this resolution, the Ministry of Finance of the Russian Federation and the organization performing functions of the operator of GIIS DMDK.

5. Determine that since March 1, 2021 voluntary is in the territory of the Russian Federation performed:

registration in GIIS DMDK of the legal entities and individual entrepreneurs performing transactions with precious metals and gemstones, delivered on special accounting till April 12, 2020 in the state inspections of assay supervision of federal state institution "The Russian State Assay Chamber under the Ministry of Finance of the Russian Federation" who are subject to statement on special accounting;

re-registration in GIIS DMDK of the legal entities and individual entrepreneurs performing transactions with precious metals and gemstones, delivered on special accounting since April 13, 2020 in territorial authorities of Federal assay chamber who are subject to statement on special accounting;

registration of marks in GIIS DMDK, including the marks for 2021 registered in 2020 by the legal entities and individual entrepreneurs performing production and (or) repair of jewelry and other products from precious metals in territorial authorities of Federal assay chamber.

6. Determine that since April 1, 2021 voluntary is in the territory of the Russian Federation performed:

entering into GIIS DMDK of data (information) on jewelry and other products from precious metals and (or) gemstones of national production, and also about jewelry and other products from the precious metals imported into the Russian Federation from the states which are not entering into the Eurasian Economic Union, and moved on the territory of the Russian Federation from the state members of the Eurasian Economic Union represented on approbation, the analysis and branding by the state assay brand;

entering into GIIS DMDK of data (information) on receipt of the branded jewelry and other products from precious metals and gemstones from Federal assay chamber;

drawing two-dimensional bar code is direct on jewelry and other products from precious metals and (or) gemstones with entering of information on them into GIIS DMDK;

entering into GIIS DMDK of data (information) on realization (shipment) of the affined precious metals in the form of standard and measuring ingots the organizations having the right to perform refining of precious metals;

drawing two-dimensional bar code and unique identification number by the organizations having the right to perform refining of precious metals, on the quality certificate (the passport, the certificate) accompanying the standard ingot, the certificate of the manufacturer accompanying measuring ingot of the affined precious metals which is drawn up in accordance with the legislation of the Russian Federation;

entering into GIIS DMDK of data (information) on the jewelry and other products which are in circulation from precious metals and (or) gemstones (except for jewelry and other products from the precious metals and (or) gemstones accepted on the commission from citizens (physical persons) realized by pawnshops of unclaimed jewelry and other products from precious metals and (or) gemstones on which collection, the precious metals and gemstones which are in the Central bank of the Russian Federation and credit institutions is turned).

7. Determine that since August 1, 2021 in the territory of the Russian Federation:

the organizations having the right to perform refining of precious metals enter voluntarily in GIIS DMDK data (information) on intake of the raw materials containing precious metals and also on shipment (realization) of the affined precious metals in all types, products made from the affined precious metals, waste and semi-products containing precious metals;

the legal entities and individual entrepreneurs performing production and (or) repair of jewelry from precious metals and gemstones voluntarily enter in GIIS DMDK data (information) on intake of the precious metals and gemstones used for their production and also on shipment (realization) of finished goods;

voluntary drawing two-dimensional bar code directly on the jewelry and other products from precious metals and (or) gemstones accepted on the commission from citizens (physical persons) who are not individual entrepreneurs, both unclaimed jewelry and other products from precious metals and (or) gemstones on which pawnshops turn collection, and also unique identification number on their labels with entering into GIIS DMDK of data on the specified products is entered.

8. Determine that since September 1, 2021 in the territory of the Russian Federation:

subjects of production of gemstones voluntarily enter in GIIS DMDK data (information) on results of sorting, primary classification and primary assessment of gemstones and on turnover of gemstones;

the federal state institution "Public Institution on Forming of the State Fund of Precious Metals and Gemstones of the Russian Federation, Storage, Leave and Use of Precious Metals and Gemstones (Gokhran of Russia) under the Ministry of Finance of the Russian Federation" and the state funds of precious metals and gemstones of subjects of the Russian Federation voluntarily enter in GIIS DMDK data (information) on leave of the precious metals realized in the domestic market, gemstones and products from them from the State fund of precious metals and gemstones of the Russian Federation and the state funds of precious metals and gemstones of subjects of the Russian Federation;

the legal entities and individual entrepreneurs performing buying up at physical persons of jewelry and other products from precious metals and (or) gemstones, scrap of such products procurement of scrap and waste of precious metals and products (products) containing precious metals voluntarily enter data (information) on receipt and realization of the specified values in GIIS DMDK;

the legal entities and individual entrepreneurs performing processing (conversion) of scrap and the waste containing precious metals voluntarily enter in GIIS DMDK data on intake of the raw materials containing precious metals and realization (shipment) of products of conversion;
