About approval and enforcement of the Arbitral Procedure Code of Turkmenistan

Article 1. Approve the Arbitral Procedure Code of Turkmenistan in the new edition it (is applied).

Article 2. Enact the Arbitral Procedure Code of Turkmenistan in the new edition since October 1, 2021.

Article 3. Determine that from the date of enforcement of the Arbitral Procedure Code of Turkmenistan:

1) the cases which arrived and are not considered by Arbitration Courts of the first, cassation and supervising instances till October 1, 2021 are subject to consideration according to the Arbitral Procedure Code of Turkmenistan enacted by this Law;

2) the claims and representations which arrived in Arbitration Courts of the first instance after October 1, 2021 are subject to consideration according to the Arbitral Procedure Code of Turkmenistan enacted by this Law;

3) the writs of appeal and representations which arrived in the Arbitration Courts of cassation instance, and also the claim and representation which arrived according to the procedure of supervision after October 1, 2021 are subject to consideration according to the Arbitral Procedure Code of Turkmenistan enacted by this Law;

4) the decisions of Arbitration Court of the first instance passed till October 1, 2021, but not appealed which introduction term in legal force is necessary on (or after) on October 1, 2021, can be appealed or on them submissions to cassation instance in time, stipulated in Clause 162 Arbitral Procedure Codes of Turkmenistan enacted by this Law can be brought;

5) submission due dates of claims and representations according to the procedure of supervision are estimated according to Article 176 of the Arbitral Procedure Code of Turkmenistan from the moment of its introduction in action by this Law.
