According to the Federal Law of July 27, 2010 No. 210-FZ "About the organization of provision of the state and municipal services" (The Russian Federation Code, 2010, No. 31, Art. 4179; 2020, No. 31, the Art. 5027), Item 2 of Rules of development and approval of administrative regulations of provision of the state services approved by the order of the Government of the Russian Federation of May 16, 2011 No. 373 (The Russian Federation Code, 2011, No. 22, Art. 3169; 2018, No. 46, Art. 7050), and Items 5.2. 1, 5.11 Provisions on Federal Service for Supervision in Education and Science, No. 885 approved by the order of the Government of the Russian Federation of July 28, 2018 (The Russian Federation Code, 2018, to No. 32, of the Art. 5344), I order:

1. Approve the enclosed Administrative regulations of Federal Service for Supervision in Education and Science on provision of the state service in licensing of educational activities.

2. Recognize invalid:

the order of Federal Service for Supervision in Education and Science of July 29, 2019 No. 1109 "About approval of Administrative regulations of Federal Service for Supervision in Education and Science on provision of the state service in licensing of educational activities" (registration No. 56182) is registered by the Ministry of Justice of the Russian Federation on October 8, 2019;

the order of Federal Service for Supervision in Education and Science of May 20, 2020 No. 604 "About modification of the Administrative regulations of Federal Service for Supervision in Education and Science on provision of the state service in licensing of educational activities approved by the order of Federal Service for Supervision in Education and Science of July 29, 2019 No. 1109" (registration No. 58883) is registered by the Ministry of Justice of the Russian Federation on July 9, 2020.

Administrative regulations of Federal Service for Supervision in Education and Science on provision of the state service in licensing of educational activities

I. General provisions

Subject of regulation of Administrative regulations

1. The administrative regulations of Federal Service for Supervision in Education and Science on provision of the state service in licensing of educational activities (further respectively - Administrative regulations, the state service) establish terms and the sequence of ministerial procedures (actions) performed by Rosobrnadzor in the course of provision of the state service, establish order of interaction between structural divisions of Rosobrnadzor, his federal government civil servants (further - officials), and also interactions of Rosobrnadzor with applicants, other public authorities, the organizations in the course of provision of the state service.

2. Applicants by provision of the state service (further - applicants) are:

a) the organizations performing educational activities for educational programs of the higher education;

b) the federal state professional educational organizations realizing educational programs of secondary professional education in spheres of defense, production by the defensive order, internal affairs, activities of troops of national guard of the Russian Federation, safety, nuclear power engineering, transport and communication, the knowledge-intensive production for specialties which list is approved by the order of the Government of the Russian Federation of May 24, 2013 No. 437 <1>;

c) the Russian educational organizations located outside the territory of the Russian Federation, the educational organizations created according to international treaties of the Russian Federation;

d) the diplomatic representations and consular establishments of the Russian Federation, representation of the Russian Federation performing educational activities in case of international (interstate, intergovernmental) the organizations (further - foreign institutions);

e) the foreign educational organizations performing educational activities for the branch location in the territory of the Russian Federation (further together - license applicants, licensees);

e) the physical persons and legal entities which addressed for provision of data on the specific license for implementation of educational activities (further - the license).

3. Information on questions of provision of the state service can be obtained:

on the official site of Rosobrnadzor on the Internet (further respectively - the official site of Rosobrnadzor, Internet network);

on the official site in the federal state information system "Single Portal of the State and Municipal Services (Functions)" (further - the Single portal);

in the federal state information system "Federal Register of the State Services (Functions)" (further - the federal register);

at information stands in places of provision of the state service (further - information stands);

on phone numbers for reference.

4. Reference information concerning provision of the state service is placed:

on the official site of Rosobrnadzor;

on the Single portal;

in the federal register;

at information stands.

5. Reference information is provided by officials by phone, on personal acceptance of the applicant or in writing the mailing or the electronic message to the address specified by the applicant.

Reference information includes data on the location and the working schedule of Rosobrnadzor, its structural divisions providing the state service, the state and municipal authorities and the organizations, the address to which is necessary for receipt of the state service, telephone numbers for enquiries of structural divisions of Rosobrnadzor, the organizations participating in provision of the state service, including number of phone answerphone about the address of the official site of Rosobrnadzor, and also about e-mail addresses and (or) forms of feedback of Rosobrnadzor in Internet network.

6. On the official site of Rosobrnadzor, information stands, on the Single portal the following information is placed:

procedure for receipt of information by applicants concerning provision of the state service;

the list of the regulatory legal acts of the Russian Federation regulating provision of the state service;

text of Administrative regulations;

forms of statements (notifications, references) used by service provision.

On the official site of Rosobrnadzor, on the Single portal data on the course of provision of the state service are also placed.

7. Information on the Single portal, information stands and the official site of Rosobrnadzor on procedure and terms of provision of the state service based on the data containing in the federal register is provided to the applicant on a grant basis.

II. Standard of provision of the state service

9. The state service is provided by Rosobrnadzor.

10. By provision of the state service Rosobrnadzor has no right to demand from the applicant of implementation of actions the, including coordination necessary for receipt of the state service and connected with the appeal to other state bodies and the organizations, except for receipts of the services included in the list of services which are federal executive bodies, State Atomic Energy Corporation "Rosatom" of the state services, necessary and obligatory for provision, and are provided by the organizations participating in provision of the state services, No. 352 <2> approved by the order of the Government of the Russian Federation of May 6, 2011.

Description of result of provision of the state service

11. Results of provision of the state service are:

a) provision of the license;

b) provision of the temporary license;

c) renewal of the license;

d) cancellation of the license according to the statement of the licensee;

e) provision of data on the license.

The term of provision of the state service, including taking into account need of the appeal to the organizations participating in provision of the state service, the term of suspension of provision of the state service, term of issue (direction) of the documents which are result of provision of the state service

12. Terms of provision of the state service constitute:

a) provision of the license - no more than 45 working days from the date of acceptance by Rosobrnadzor of the statement for provision of the license and the documents attached to it;

b) provision of the temporary license - no more than 10 working days from the date of acceptance by Rosobrnadzor of the statement for provision of the temporary license and the documents attached to it;

c) renewal of the license in cases:

reorganization of the legal entity in the form of accession, transformations, merges, changes of its name, the location address, the termination of activities for one or several addresses, the terminations of rendering educational service in realization educational (educational) programs (programs), and also changes of names of the educational programs provided by the license for the purpose of their reduction in compliance with the lists of professions, specialties and the directions of preparation provided by part 8 of article 11 of the Federal Law of December 29, 2012 No. 273-FZ "About education in the Russian Federation"> (further - the Federal Law No. 273-FZ) - no more than 10 working days from the date of acceptance by Rosobrnadzor of the statement for renewal of the license and the documents attached to it;

intentions of the licensee to perform educational activities for the address of the place of its implementation or in branch, not provided by the license, or to render educational services in implementation of the new educational programs which are not provided by the license - no more than 30 working days from the date of acceptance by Rosobrnadzor of the statement for renewal of the license and the documents attached to it;

d) cancellation of the license according to the statement of the licensee - no more than 10 working days from the date of receipt by Rosobrnadzor of the statement for the termination of implementation of educational activities;

e) provision of data on the license - no more than 3 working days from the date of receipt by Rosobrnadzor of the statement for provision of such data;

e) the direction of the notification on provision (renewal) of the license - no more than 3 working days after day of entering of record about provision (renewal) of the license into the unified register of licenses which maintaining performs Rosobrnadzor (further - the unified register of licenses).

In cases, stipulated in Item 63 Administrative regulations, the terms of provision of the state service specified in subitems "an" - "in" this Item, are estimated from the date of receipt in Rosobrnadzor of properly issued application and in full the documents attached to it.

13. The term of suspension of provision of the state service is estimated from the date of delivery to the applicant of the notification on need of elimination in the 30-days time of the revealed violations and (or) submission of documents which are absent (further - the notification on elimination of violations), or the directions its mailing with the assurance of receipt, or in electronic form, signed by the strengthened qualified digital signature of Rosobrnadzor, and terminates from the date of receipt in Rosobrnadzor of the documents submitted based on the notification on elimination of violations within the term specified in it or after 30 calendar days from the date of receipt by the applicant of the notification on elimination of violations in case of non-presentation of such documents:

a) in case of filing of application about provision of the license, drawn up with violation of the requirements established by Administrative regulations, and (or) submission of the documents attached to it not in full;

b) in case of filing of application about provision of the temporary license, drawn up with violation of the requirements established by Administrative regulations, and (or) submission of the documents attached to it not in full;

c) in case of filing of application about renewal of the license, drawn up with violation of the requirements established by Administrative regulations, and (or) submission of the documents attached to it not in full.

14. The list of the regulatory legal acts regulating provision of the state service is posted on the official site of Rosobrnadzor, in the federal register and on the Single portal.

15. For receipt of the license the license applicant submits to Rosobrnadzor the following documents (the copy of documents) and data:

a) the statement for provision of the license according to appendix No. 1 to Administrative regulations <4>;

c) the signed head of the organization performing educational activities, the certificate of material logistics of educational activities for educational programs according to appendix No. 2 to Administrative regulations <5>;

d) the signed head of the organization performing educational activities, the certificate of availability the developed and approved organization performing educational activities, educational programs according to appendix No. 3 to Administrative regulations <6>;

e) details of the issued sanitary and epidemiologic conclusion about compliance to health regulations of the buildings, structures, constructions, rooms, the equipment and other property necessary for implementation of educational activities;

e) the signed head of the organization performing educational activities, the certificate of availability at the professional educational organization, the educational organization of the higher education, the organization performing educational activities for the main programs of professional training, special conditions for education by students with limited opportunities of health according to appendix No. 4 to Administrative regulations <7>;

g) the signed head of the organization performing educational activities, the certificate of availability of conditions for functioning of the electronic information and education circle including electronic information resources, electronic educational resources, set of information technologies, telecommunication technologies, the appropriate technological means and providing development by students of educational programs in full irrespective of the location of students (in the presence of educational programs using exclusively electronic training, remote educational technologies) according to appendix No. 5 to Administrative regulations <8>;

h) details of the granted license for work with use of the data which are the state secret (for professional educational programs, the main programs of professional training providing bringing to the studying data in the period of their development, being the state secret, and (or) use in the educational purposes of confidential samples of arms, the military and special equipment, their components, special materials and substances);

i) the copy of the usage agreement of network form of implementation of educational programs (in the presence of the educational programs planned to realization with use of network form);

j) the copy of the agreement signed by the license applicant according to Item 2 parts 7, part 8 of Article 13 or part 5 of article 82 of the Federal Law No. 273-FZ confirming availability of conditions for implementation of educational programs (their part) in the form of practical training of students (for the main professional educational programs or for the main educational programs of medical and pharmaceutical education and additional professional programs of medical and pharmaceutical education);

k) the signed head of the organization performing educational activities, the guaranty letter with the obligation about attraction by it pedagogical and (or) the scientists having professional education, having the corresponding qualification and having the length of service necessary for implementation of educational activities for implementable educational programs prior to implementation of the educational program;

l) the data confirming compliance to requirements, the stipulated in Article 15.2 Laws of the Russian Federation of March 11, 1992 to No. 2487-1 "About private detective and security activities in the Russian Federation" <9> (further - the Law No. 2487-1) (for the main programs of professional training for work as private detectives, private security guards and additional professional programs of heads of the private security organizations);

m) the data confirming compliance to the requirements provided by part 6 of article 85 of the Federal Law No. 273-FZ (for educational programs in the field of training of specialists of aviation personnel of civil aviation, members of crews of vessel according to the international requirements, and also in the field of training of the workers of rail transport who are directly connected with train service and shunting work);

o) details of the Ministry of Internal Affairs of the Russian Federation issued by State Inspection for Road Traffic Safety of the conclusion about compliance of educational material resources to the established requirements (for the main programs of professional training of transport drivers);

o) the copy of the decision of the Ministry of Foreign Affairs of the Russian Federation on creation of specialized structural educational division of the foreign institution performing educational activities (if the foreign institution acts as the license applicant);

p) the copy of regulations on branch (if the license applicant intends to perform educational activities in branch);

c) the copy of regulations on structural division (if the organization performing training which structural division plans to realize educational programs acts as the license applicant);

r) representation to the religious organization (the centralized religious organization) (if license applicant is the educational organization which founder is the religious organization).

In case of intention of the spiritual educational organization to realize educational programs of secondary professional education and the higher education, additional professional programs and programs of professional training in representation information on availability of consent of the relevant centralized religious organization or the leading or coordinating body authorized by the centralized religious organization on implementation of the specified educational programs is specified;
