The Cabinet of Ministers of Ukraine decides:

1. According to article 87 of the Law of Ukraine "About notariate" to approve the list of documents according to which debt collection is carried out in indisputable procedure based on executive texts of notaries it (is applied).

2. Declare invalid the List of documents according to which debt collection is carried out in indisputable procedure based on executive texts of offices of notary public, USSR approved by the resolution of Council of Ministers of October 12, 1976 No. 483 (JV USSR, 1976, No. 10, Art. 60; 1985, No. 7, hundred. 61; 1991, No. 8, Art. 62; 1996, No. 3, Art. 89).

Debt collection under notarially certified agreements

1. Notarially certified agreements which provide payment of sums of money, transfer or return of property (except case, the stipulated in Item 1-1 this list), and also the right of the address of collection to pledged property.

For receipt of executive text are shown:

a) the original of notarially certified agreement (agreements);

b) documents which confirm indisputability of debt of the debtor and establish delay of accomplishment of the obligation.

1-1. The mortgage agreements providing the right of the address of collection regarding mortgage in case of delay of payments on primary obligation before the expiration of execution of primary obligation.

For receipt of executive text are represented:

a) the original of notarially certified mortgage agreement;

b) original or properly verified copy of the agreement, primary obligation;

c) the copy of the written requirement about obligation fulfillment violation elimination certified by the claimant which was sent to the debtor and the property guarantor (in case of its availability), with mark of the claimant about debt default;

d) the originals of the settlement document about provision of services of mail service and the inventory of investment confirming the direction to the debtor of the written requirement about obligation fulfillment violation elimination;

e) certificate of financial institution of not payment receipt.

3. Documents which establish debt of the companies, organizations, organizations for assignments (through the State committee on questions of science and intellectual property) to the creative unions of Ukraine for use of literary works and art:

1) to Literary fund of National union of writers of Ukraine:

a) publishing houses and the publishing organizations for assignments in the amount of 10 percent of total amount of the remuneration added to authors for original and translated works of fiction;

b) theaters (stationary, portable), and also the companies, organizations, the organizations which provide under agreements of the platform for holding performances and concerts to collectives and contractors who perform tour activities in Ukraine, on assignments in the amount of 2 percent of the amount of gross collection (or the amounts under the agreement);

c) theaters and other organizations on assignments for performances of small drama forms (sketches, one-act vaudevilles), and also cultural and educational institutions on assignments for works of all genres in the amount of 0,5 of percent of the amount of gross collection (or the amounts under the agreement);

d) the companies which go in for publishing activities and replication of literary works, on assignments for use of all types of literary works;

on assignments for use of all types of literary and art works of domestic and foreign authors which are not protected by copyright, in the amount of 2 percent of sales amount.

For receipt of executive text the pay slip ratified the head and the chief (senior) accountant of the company, organization, the organization with indication of the debt size is shown;

2) to Musical fund of Ukraine:

a) the organizations which pay award for public performance of pieces of music, the companies, organizations, the organizations which provide under agreements of the platform for holding performances and concerts to collectives and contractors who perform tour activities in Ukraine for assignments in the amount of 2 percent of the amount of the gross collection received from sale of tickets, or the amount of the guaranteed payment it agrees with the agreement, and also the spectacular companies on the same assignments for musical performances (the opera, the operetta, the ballet and so forth) and variety concerts;

b) the companies, organizations, the organizations for assignments in the amount of 1 percent of the amount of the gross collection (sales proceeds) received for use of pieces of music which are issued in record on magnetic film, compact cartridges, plates and laser disks;

c) publishing houses and the publishing organizations, printing mass media for assignments in the amount of 10 percent of total amount of the award added for the edition of musical and musicological works.

For receipt of performing text the pay slip ratified the head and the chief (senior) accountant of the company, organization, the organization, newspaper editorial office (magazine) with indication of the debt size is shown;

3) to National union of theatrical figures of Ukraine:

theaters (stationary and portable) on assignments in the amount of 1 percent of the amount of gross collection from theatrical performances.

For receipt of executive text the pay slip ratified the head and the chief (senior) accountant of theater with indication of the debt size is shown;

4) to Journalistic fund of Ukraine:

the teleradio organizations, DINAU, the Ukrainian independent news agency "Novosti", regional news agencies and printing mass media, publishing houses and the publishing organizations for assignments in the amount of 6 percent of total amount of the award added for social and political, publicistic, popular scientific works, information and illustrative material (except the fee from which contributions to funds of other creative unions are carried out).

For receipt of executive text the pay slip ratified the head and the chief (senior) accountant of the teleradio organization, news agency, publishing house, the publishing organization, printing mass media with indication of the debt size is shown;

5) to National union of cinematographers of Ukraine:

film spectacular institutions (except located in the rural zone) on assignments in the amount of 1 percent of the amount of the gross collection received for distribution and demonstration of movies.
