According to the Presidential decree of Ukraine of March 14, 1995 "About measures concerning ensuring activities of the National commission on questions of regulation of power industry of Ukraine" the National commission on questions of regulation of power industry of Ukraine DECIDES: No. 213/95

1. Approve Conditions and Rules of implementation of business activity on the wholesale supply of electrical energy (are attached).

Conditions and Rules of implementation of business activity on the wholesale supply of electrical energy

1. General provisions

1.1. Conditions and Rules of implementation of business activity on the wholesale supply of electrical energy (further Conditions and Rules) are developed according to the Laws of Ukraine "About entrepreneurship", "About power industry", "About natural monopolies".

1.2. The license cannot be transferred to the third parties.

1.3. In Conditions and Rules such determinations are used:

Producer electric participant of the wholesale market of electric
   energies                     of energy    which      makes
                                the electric power also   transfers  it  in
                                power supply network

   Gross violation of Conditions    one-time   violation  of Conditions and
   and Rules                    of Rules  which  witnesses about
                                explicit and deliberate neglect
                                their requirements from the licensee
                                and/or entailed effects in type
                                the significant  damage  caused
                                to the state,  surrounding  natural
                                to environment,  legal or physical
                                to persons; gross violation is considered
                                also  failure to carry out  by the licensee in
                                fixed term of the decision of NKREKP about
                                elimination of violations
