About price regulation (rates) for construction materials, products, designs, services in road economy

Based on subitem 2.1 of Item 2 of the Presidential decree of the Republic of Belarus of February 25, 2011 No. 72 "About some questions of price regulation (rates) in the Republic of Belarus", subitem 5.9 of Item 5 of the Regulations on the Ministry of Transport and Communications of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 985, the Ministry of Transport and Communications of the Republic of Belarus DECIDES:

1. Establish the limiting standard rate of profitability used for determination of the amount of the profit which is subject to inclusion in the prices (rates) on the construction materials made and realized in the territory of the Republic of Belarus by legal entities and individual entrepreneurs, products, designs, services used (rendered) in case of construction, reconstruction, operation (content and running repair), capital repairs of the highways financed fully or partially by means republican and (or) local budgets, including the state trust budget funds, and also state non-budgetary funds, external state loans and external loans, the executive committees attracted under guarantees of the Government of the Republic of Belarus, the credits of banks of the Republic of Belarus under guarantees of the Government of the Republic of Belarus and regional, Minsk city (further - the budget and equated to them means) in the amount of 12 percent to planned cost.

2. Determine that for the legal entities and individual entrepreneurs performing import of construction materials, products, designs to the territory of the Republic of Belarus and realizing them for construction, reconstruction, operation (content and running repair), capital repairs of the highways financed fully or partially at the expense of budget and the means equated to them, the limiting maximum allowance which is subject to inclusion in selling price in the amount of 10 percent is applied to the contract price and expenses on import.

3. Establish the limiting wholesale allowance to the selling prices on construction materials, products, designs created by legal entities and individual entrepreneurs according to Items 1 and 2 of this resolution in the amount of 10 percent irrespective of the number of the participating intermediaries.

3-1. Approve the Instruction about procedure for establishment and use of regulated prices (rates) for construction materials, products, designs, services in road economy it (is applied).

3-2. This resolution is not applied when pricing (selling prices) on construction materials, products, designs, implementable:

according to the agreement in foreign trade, for production of goods for further realization according to the agreement in foreign trade, the subject of trade for further realization according to the agreement in foreign trade;

according to bargains which legal entities and individual entrepreneurs conclude at the exchange biddings of "Belarusian Universal Commodity Exchange" open joint stock company.

4. Declare invalid the resolution of the Ministry of Transport and Communications of the Republic of Belarus of December 19, 2014 No. 45 "About price regulation on the construction materials, products, designs used in case of construction and content of highways, bridges and tunnels".

5. This resolution becomes effective after its official publication.

The instruction about procedure for establishment and use of regulated prices (rates) for construction materials, products, designs, services in road economy

1. This Instruction determines procedure for establishment and use of the prices (rates) regulated according to the Presidential decree of the Republic of Belarus of February 25, 2011 No. 72 for the construction materials made (imported) and realized in the territory of the Republic of Belarus by legal entities and individual entrepreneurs, products, designs (further - goods), services for construction, reconstruction, operation (content and running repair), capital repairs of the highways public financed fully or partially at the expense of budget and the means equated to them.

2. For the purposes of this Instruction the following terms and their determinations are used:

the importer - the legal entity or the individual entrepreneur performing commodity importation on the territory of the Republic of Belarus for its further realization;

the wholesale allowance - the allowance to selling price of the producer or importer applied by the legal entity or the individual entrepreneur in case of wholesale trade by goods concerning which it or it is not producer or the importer;

selling price - the price of goods established by the producer on manufactured goods, the importer on the goods for its further sale imported by it into the Republic of Belarus;

planned costs (cost) - the estimated cost of the production costs of goods in the future (based on actual data of previous period or the confirmed information on the forthcoming expenses) including determined taking into account planned targets of production;

the producer - the legal entity or the individual entrepreneur performing production of goods or being the owner of the goods made according to the works agreement for conversion.

3. Selling prices are determined by the producer on the basis of planned costs (cost) for production and sales of goods, arrived taking into account market situation and restrictions, the stipulated in Item 1 resolution which approved this Instruction. Taxes, charges and other obligatory assignments are in addition accrued.
