PRESIDENTIAL DECREE OF THE REPUBLIC OF UZBEKISTAN

About additional measures for providing the population with housing by means of allocation of mortgage loans on the basis of the market principles

(as amended on 09-12-2021)

For the purpose of expansion of scale of the reforms aimed at providing the population with housing by means of mortgage loans, social and financial support of the families needing improvement of housing conditions and also creations of conditions for broad involvement of private contract organizations to the sphere of housing construction:

1. Determine that within new procedure for providing the population with housing by means of mortgage loans on the basis of the market principles (further - new procedure) implemented by the Presidential decree of the Republic of Uzbekistan of November 28, 2019 No. UP-5886:

apartment apartment houses are under construction in the rural zone of the Republic of Karakalpakstan and all areas (in the territories adjacent to the cities and the administrative centers of areas);

The Ministry of Finance allocates money to commercial banks, commercial banks - mortgage loans to the population for the term of 20 years (inclusive) with six-months grace period (at the request of the client);

the initial contribution on mortgage loans is established in the amount of at least 15 percent from the cost of the acquired apartment. At the same time to persons who received the notification on provision of subsidy before adoption of this Decree mortgage loans and subsidies on conditions and in the amount of, acting in 2020 are allocated;

the maximum size of mortgage loan and the size of subsidy for compensation of part of the initial contribution are annually determined by the Ministry of Economic Development and reducings poverty in coordination with the Ministry of Finance and the Ministry of construction proceeding from the settlement cost of housing and each six months are reviewed;

irrespective of the location, costs and the areas of the acquired apartment of subsidy for compensation of part of the initial contribution on mortgage loan are paid in the fixed size - 32 million sum, subsidies for compensation of part of interest payments - within the first five years of the credit period in the part exceeding 10 percent points;

subsidies for compensation of part of the initial contribution and interest payments are paid also in case the price of the acquired apartment exceeds the maximum size of mortgage loan. At the same time in case the price of the acquired apartment exceeds the maximum size of mortgage loan, the rest of cost is paid by the borrower at the expense of own means and other sources which are not forbidden by the legislation, way of increase in the amount of the initial contribution;

borrowers are at will granted the right to implementation of payments for mortgage loans by the annuity or differentiated method.

2. Approve developed by the Ministry of Economic Development and reducings poverty and the Ministry of Finance together with the Ministry of construction, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent:

Target parameters of allocation of mortgage loans within new procedure in 2021 according to appendix No. 1;

Target parameters of allocation of subsidies on mortgage loans within new procedure in 2021 according to appendix No. 2;

The settlement cost of housing, the maximum sizes of the mortgage loans allocated on one borrower and the subsidies allocated from the Government budget for compensation of part of the initial contribution on mortgage loans in 2021 according to appendix No. 3.

Determine that subsidies on the mortgage loans allocated on acquisition of the apartments, "turnkey" till January 1, 2022, finished by construction and handed over, are paid also if the area and the price of the acquired apartment exceed the maximum space allowance of the apartment and settlement cost of housing, specified in appendix No. 3 to this Decree.

At the same time, in case of excess of the price of the acquired apartment from the settlement cost of housing, the rest of cost is paid by the borrower at the expense of own means and other sources which are not forbidden by acts of the legislation.

3. And reducings poverty and the Ministry of Finance to provide to the ministry of construction together with the Ministry of Economic Development in 2021:

construction of the available multi-storey apartment houses in the rural zone consisting of 8 336 apartments with participation of IK Kishlok kurilish invest LLC according to appendix No. 4;

additional construction of available multi-storey apartment houses in the rural zone with participation of IK Kishlok kurilish invest LLC at the expense of means of Asian Development Bank according to appendix No. 4-1;

construction of the multi-storey apartment houses consisting of 3 550 apartments for separate category of citizens with participation of IK Uzshakhar kurilish invest LLC.

4. Determine that construction of housing specified:

in appendix No. 4 to this Decree, it is performed according to requirements of the Program for construction of affordable housing in the rural zone for 2020 with participation of IK Kishlok kurilish invest LLC at the expense of means of Asian Development Bank and Islamic development bank;

in paragraph three of Item 3 of this Decree, it is performed according to requirements of the Program for construction of apartment apartment houses for separate category of citizens in the cities with participation of IK Uzshakhar kurilish invest LLC at the expense of the funds allocated by the Ministry of Finance.

5. To the Cabinet of Ministers to approve key parameters on construction of apartment apartment houses for separate category of citizens with participation of IK Uzshakhar kurilish invest LLC in 2021 in a month.

6. Extend to all regions the procedure for allocation to physical persons of the credits for construction and reconstruction of individual housing implemented in the Andijan, Namangan and Fergana regions according to the resolution of the President of the Republic of Uzbekistan of May 1, 2020 No. PP-4701.

At the same time:

the credits are allocated on construction (reconstruction) in the Republic of Karakalpakstan and areas on 500 individual apartment houses, in total - 6 500;

the credits are allocated for the term of 20 years (inclusive) with six-months grace period in the amount of, not exceeding the maximum sizes of mortgage loans, and the initial contribution in the amount of at least 15 percent of cost of works on construction (reconstruction) of individual apartment houses;

the credits are allocated on purchase of construction materials and covering of the expenses connected with performance of works on construction (reconstruction) of individual apartment houses. At the same time construction works can be performed according to the legislation by own forces of the borrower, with involvement of the private contract organizations or wage workers who were registered by quality of self-employed persons;

as providing on the credits the individual housing belonging to physical persons or other types of providing as a deposit is provided;

if in case of receipt of the credit the borrower provided other type of providing, after completion of construction (reconstruction) of individual housing and execution of cadastral documentation providing on the credit is replaced with mortgage of this housing;

on the mortgage loans allocated on individual housing to citizens with low income level and needing improvement of housing conditions within the first five years from the Government budget subsidies for covering of interest rate, in the part exceeding 10 percent points are allocated;

subsidies are paid since the month following after month of execution of cadastral documentation of the built (reconstructed) individual housing.

7. Implement since June 1, 2021 the simplified payment procedure of subsidies for compensation of part of the initial contribution and interest payments on mortgage loans according to which:

applications can be submitted by citizens within year for receipt of subsidies;

to the income of the applicant who addressed for receipt of subsidy, the income of the close relatives who are not living together with it can be also included;

reclamation from the applicant who addressed for receipt of subsidy, documents (data) which can be received by means of the information system "Unified Register of Social Protection" is forbidden;

the notification on provision of subsidy for acquisition of housing is valid within 12 months from the moment of its issue.

8. To the Ministry of Economic Development and reducings poverty together with the Ministry of Finance till June 1, 2021 to make in the Cabinet of Ministers offers about:

full automation and reducing up to seven days of term of accomplishment of selection processes of citizens to which subsidies, and issues of notifications on provision of subsidy, and also allocation from the Government budget of funds for realization of these works are paid;
