About approval of the Regulations on procedure for carrying out the state qualification certification of specialists of construction industry

For the purpose of regulation of questions of issue and receipt of qualification certificates of specialists of construction industry, according to articles 3 and 4 of the Law of the Kyrgyz Republic "About town planning and architecture of the Kyrgyz Republic", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve:

- Regulations on procedure for carrying out the state qualification certification of specialists of construction industry according to appendix 1;

- The list of specialties on which qualification certification of specialists of construction industry, according to appendix 2 is carried out.

2. Determine that to the specialists performing professional activity based on the certificates issued and extended before entry into force of this resolution, replacement of certificates by termless is made based on their statements, before the termination of term of their action, or upon termination of effective period if the application for early replacement was not submitted.

3. Recognize invalid:

- the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for carrying out the state qualification certification of construction industry" of April 3, 1997 No. 188;

- the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of April 3, 1997 No. 188 "About approval of the Regulations on procedure for carrying out the state qualification certification of specialists of construction industry" of February 4, 2009 No. 75;

- the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of April 3, 1997 No. 188 "About approval of the Regulations on procedure for carrying out the state qualification certification of specialists of construction industry" of January 28, 2010 No. 47.

4. To the ministry of transport, architecture, construction and communications of the Kyrgyz Republic:

- bring the decisions into accord with this resolution;

- take the necessary measures following from this resolution.

5. To impose control of execution of this resolution on department of construction, transport and communications of Government office of the Kyrgyz Republic.

6. This resolution becomes effective after fifteen days from the date of official publication.

Regulations on procedure for carrying out the state qualification certification of specialists of construction industry

Chapter 1. General provisions

1. The regulations on procedure for carrying out the state qualification certification of specialists of construction industry (further - the Provision) determine procedure for carrying out the state qualification certification of specialists of construction industry.

2. The state qualification certification is performed by authorized state body on development and realization of policy in the sphere of architectural and construction activities (further - authorized state body).

3. The purpose of the state qualification certification of professional activity in the field of architecture and construction is protection of professional privileges of specialists of construction industry, increase in their professional level and responsibility for quality of construction products, protection of the rights and consumer interests of these products.

4. The state qualification certificate (further - the certificate) is the document confirming professional competence of the specialist of construction industry, conferring on it responsibility for quality and results carried out by it or under its works management.

5. The state qualification certification of specialists of construction industry is carried out according to the List of specialties on which qualification certification of specialists of construction industry, is carried out by the approved decision of the Cabinet of Ministers of the Kyrgyz Republic (further - the List of specialties).

6. The certificate is issued to physical persons - the citizens of the Kyrgyz Republic who are carrying out at the companies in organizations and the organizations, irrespective of pattern of ownership, and also according to the procedure of individual labor activity the corresponding work types in the field of architecture and the constructions provided in the List of specialties.

7. The certificates issued by authorized state body are valid for the territories of the Kyrgyz Republic, and also in the territories of foreign states according to the international treaties which came in the procedure established by the law into force which participant is the Kyrgyz Republic.

8. 8-1. Issue of the state qualification certificate is carried out in the form of inclusion in the online register of the issued certificates without provision of the paper certificate.

Chapter 2. Functions of authorized state body when carrying out the state qualification certification

9. The authorized state body performs the following functions when carrying out the state qualification certification:

1) development and approval of the list of questions for conducting testing on the basis of regulatory legal acts in the sphere of construction and architecture;

2) consideration of the documents submitted by applicants and their acceptance in the online mode in case of representation of complete document package;

3) decision about refusal in consideration of the applications;

4) scheduling of testing in process of receipt of statements;

5) registration and issue of certificates;

6) decision about the prevention, suspension and cancellation of certificates;
