Section 1. General provisions

Chapter 1. Legislation on civil registration and basic concepts

Article 1. Subject of regulation of the Law

This Law regulates procedure and terms of state registration of acts of civil status, entering of corrections or amendments or changes into assembly registration of civil status, recovery and recognition invalid assembly registration of civil status, issue of certificates, duplicates of certificates and certificates of the state civil registrations, storage of the state civil registrations and the other related relations, and also competences of the body performing state registration of acts of civil status, and service centers are established.

Article 2. Legislation on civil registration

1. The legal relationship arising in the sphere of civil registration are regulated by the Family code of the Republic of Armenia, the Civil code of the Republic of Armenia, international treaties of the Republic of Armenia, this Law and other legal acts.

Article 3. The basic concepts used in the Law

1. In this Law the following basic concepts are used:

1) the act of civil status - such actions or cases characterizing legal status of citizens who cause change or stop their rights and obligations;

2) the applicant - the citizen of the Republic of Armenia, the foreign citizen or the stateless person who personally or through the authorized person for the purpose of accomplishment of the function established by this Law submits necessary documents or information to the body performing state registration of acts of civil status or to service center;

3) system of electronic control - single system of electronic control on civil registration by means of which all assembly registration of civil status provided by this Law, provided on their basis documents prepare;

4) the unified electronic register - the official electronic document of system of electronic control in which register by electronic method and all assembly registration of civil status established by this Law, all data provided for registration and also electronic copies of the documents which formed the basis for registration, the granted certificates, duplicates of certificates and the reference are stored;

5) state registration of the act of civil status - creation of assembly registration of civil status in the procedure established by this Law in the unified electronic register;

6) assembly registration of civil status (assembly registration) - the electronic or stored on the documentary carrier official document created as a result of input of necessary data in the procedure established by this Law in the unified electronic register which is subject to office use;

7) correction, amendment or change in assembly registration - change of data of the assembly registration registered in the unified electronic register;

8) the certificate - the electronic document based on state registration of the act of civil status and containing the information about her, certifying state registration of the act of civil status, automatically prepared in system of electronic control which upon the demand of the applicant is issued also on paper;

9) the duplicate of the certificate - the electronic document certifying state registration of the act of civil status, registered by the bodies registering acts of civil status of the Republic of Armenia till September 30, 2014, which remained in documentary archive and entered into the system of electronic control (digitized) which upon the demand of the applicant is issued also on paper;

10) the reference - the electronic document on state registration of the act of civil status based on state registration of the act of civil status and containing the information about her, automatically prepared in system of electronic control which upon the demand of the applicant is issued also on paper;

11) the agency - the office operating in the ministry developing and performing policy of the Government in the sphere of justice (further - the ministry) which in the territory of the Republic of Armenia directs and will organize process of civil registration and performs other functions established by this Law;

12) service center - department of the agency or the certain residence which performs provision of the consultations necessary for accomplishment of the functions connected with civil registration in the procedure established by this Law, reception of applications and issue of the documents constituted as a result of these functions;

13) body of diplomatic service - bodies of diplomatic service of the Republic of Armenia in foreign states (embassies and consular establishments) which according to the procedure and the cases established by the legislation of the Republic of Armenia perform certain functions of the agency;

14) special registration plate and code of quick response - 16-unit and digital code, certificates automatically generated by means of system of electronic control for the purpose of check of authenticity, the duplicate of the certificate and the reference;

15) code - the combination of figures and letters this to the applicant by means of which it is possible to watch the course of the corresponding statement and to receive its results, including the electronic document (the state certificate, the duplicate of the certificate, the reference) or the letter on refusal in state registration of the act of civil status or implementation of other function connected with it;

16) the official site of the agency - the official website which conducts the ministry.

Chapter 2. Purposes and principles of state registration of acts of civil status

Article 4. Purposes of state registration of acts of civil status

1. The purposes of state registration of acts of civil status are:

1) to promote establishment and protection of the property and personal non-property rights of persons;

2) to provide availability for each person of the document proving the status of civil status;

3) to promote forming of statistics of civil registration;

4) to promote protection of interests of the state.

Article 5. Principle of unity of system of state registration of acts of civil status

1. In the Republic of Armenia the single system of state registration of acts of civil status is effective.

2. Assembly registration of civil status is constituted in system of electronic control in one copy.

3. The agency provides forming and storage of the electronic documents registered in the unified electronic register and archive of the bases for registration in procedures and in the terms established by this Law.

Article 6. Electronic nature of the unified electronic register and state registration of acts of civil status

1. The single system of electronic control is available to the agency and service centers by means of the Internet, and also to bodies of diplomatic service - by means of electronic consular system.

2. Functions of state registration of acts of civil status and other functions following from this in the agency and bodies of diplomatic service are performed by exclusively electronic method.

3. Service centers of the statement for civil registration and accomplishment of other functions following from this are accepted by exclusively electronic method.

4. In case of technical impossibility of preparation of assembly registration of civil status and documents required functions are performed by system of electronic control in the paper version, and registration data are entered in system of electronic control no later than within one working day after performing the corresponding registration.

5. Assembly registration are automatically constituted in system of electronic control based on the data provided in the statement for performing assembly registration of civil status. Assembly registration are signed by the digital signature of the chief and relevant employee of the agency, and in case of registration of diplomatic service by body - the digital signature of the head of consular establishment and affirm electronic seal of body of diplomatic service.

6. The documents connected with the functions performed by the agency the certificates, duplicates of certificates and references issued from the unified electronic register are constituted by exclusively electronic method and can be printed out on paper.

7. For implementation the certificate or the duplicate of the certificate or the reference or the decision on refusal in the required function in time established by this Law required by the statement of function goes by means of system of electronic control to persons specified in assembly registration of civil status for e-mail addresses of the official site www.e-citizen.am, and also provided by the applicant.

8. Forms of statements, assembly registration of civil status, messages on their basis, certificates, duplicates of certificates and references are approved by the ministry developing and performing policy of the Government in the sphere of justice (further - the ministry).

9. Check of authenticity of the certificate, duplicate of the certificate and reference is performed by the input of special registration plate and code of quick response fixed by Item 14 of part 1 of article 4 of this Law on the official site of check of authenticity of official documents operating in the ministry or by means of quick response code with use of means of information technologies.

Article 7. Confidentiality of information which is available in the unified electronic register

1. Information which is available in the unified electronic register including the data which are stored in paper archive of assembly registration of civil status is not subject to publication.

2. Certificates, references or other information from the unified electronic register are provided in the cases provided by this Law and procedure.

3. The information on state registration of the act of civil status is provided to the relevant authorized bodies for the purpose of forming and maintaining the state register of the population of the Republic of Armenia, to court (judge), prosecutor's office, bodies of pretrial investigation, inquiry in connection with the initiated criminal or civil proceedings and upon the demand of other bodies or persons provided by the law.

4. In the cases provided by this Law and procedure for the data of the unified electronic register are available to also Statistical committee, the corresponding electronic system of the Ministry of Foreign Affairs of the Republic of Armenia, Welfare service, the Ministry of Health of the Republic of Armenia to both other competent authorities and legal entities by combination of electronic information systems.

5. Data of the unified electronic register can be transferred to the credit bureau operating in the territory of the Republic of Armenia. The list of the provided information, payment for them and procedure for provision are established by the Government.

Article 8. Principle of updating of data of the unified electronic register and mutual assistance

1. If the data containing in other databases kept by the Republic of Armenia are subject to registration also in the unified electronic register, then in case of change of information registered in these databases, the relevant information automatically is staticized also in the unified electronic register without additional statement or the requirement of person.

2. The list of the corresponding databases and the list of the data which are subject to automatic updating establishes the Government, proceeding from technical capabilities of such updating.

3. The body of state registration of the act of civil status can address other state bodies, local government bodies, competent authorities of foreign states for the purpose of receipt of certain data. In that case the term established by this Law for implementation of state registration of the act of civil status of this function by body stops.
