(as amended of the Order of the Government of the Republic of Moldova of 23.02.2022 No. 110)

Based on the Law No. 221/2007 on veterinary and sanitary activities (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 125-129, 396), with subsequent changes, DECIDES: the Government

1. Approve Veterinary health requirements for animals (are applied) to sterns.

2. From the effective date this resolution to declare invalid the Order of the Government No. 1405/2008 about approval of Veterinary sanitary standard on hygiene of forages and content of undesirable substances in sterns (The official monitor of the Republic of Moldova, 2008, Art. No. 230-232, 1441), with subsequent changes, and the Order of the Government No. 462/2013 about approval of requirements to sterns (The official monitor of the Republic of Moldova, 2013, Art. No. 141-144, 551), with subsequent changes.

3. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

Veterinary health requirements to sterns for animals

Veterinary health requirements to sterns for animals (further - Requirements):

- partially shift Regulations (CE) No. 183/2005 of the European Parliament and Council of January 12, 2005 establishing requirements to hygiene of forages (it is published in the Official magazine of the European Union by L 35 of February 8, 2005), with the last amendments made by Regulations (EU) 2019/1243 European Parliament and Council of June 20, 2019;

- partially shift the Regulations (SE) No. 767/2009 of the European Parliament and Council of July 13, 2009 about placement in the market and use of forages making amendments to Regulations (SE) No. 1831/2003 of the European Parliament and Council and canceling the Directive of Council 79/373/SEE, the Directive of the Commission 80/511/SEE, Directives of Council 82/471/CEE, 83/228/CEE, 93/74/CEE, 93/113/CE and 96/25/CE and the Decision of the Commission 2004/21/SE (it is published in the Official magazine of the European Union by L 229 of September 1, 2009), with the last amendments made by Regulations of the Commission (CE) 2018/1903 of December 5, 2018;

- shift Regulations of the Commission (EU) No. 68/2013 of January 16, 2013 about the Catalogue of fodder raw materials (it is published in the Official magazine of the European Union by L 29 of January 30, 2013), with the last amendments made by Regulations of the Commission (EU) 2020/764 of June 10, 2020;

- shift Regulations of the Commission (EU) 2015/786 of May 19, 2015, establishing criteria of admissibility for detoxication of the processes applied to products intended for feeding of animals as it is provided in the Directive 2002/32/SE of the European Parliament and Council (it is published in the Official magazine of the European Union by L 125 of May 21, 2015);

- shift Regulations of the Commission (EU) 2020/354 of March 4, 2020, the establishing list of intended use of the forages intended for the specific nutritious purposes and canceling the Directive 2008/38/EU (it is published in the Official magazine of the European Union by L 67 of March 5, 2020);

- shift the Directive of the Commission 82/475/SEE of June 23, 1982, establishing categories of fodder raw materials which can be used for marking of the combined forages for pets (it is published in the Official magazine of the European Union by L 213 of July 21, 1982), with the last amendments made by the Directive of the Commission 98/67/SE of September 7, 1998;

- shift the Directive 2002/32/SE of the European Parliament and Council of May 7, 2002 about undesirable substances in sterns (it is published in the Official magazine of the European Union by L 140 of May 30, 2002), with the last amendments made by Regulations of the Commission (EU) 2019/1869 of November 7, 2019;

- shift item 1. 1, p. 3-5 and 8; item 1.2. 1, h 3 appendices to the Recommendation of the Commission 2011/25/EC of January 14, 2011, establishing the guidelines on distinction of fodder raw materials, feed additives, biocidal products and veterinary medicines (it is published in the Official magazine of the European Union by L 11 of January 15, 2011).

I. Scope and terminology

1. Veterinary health requirements to sterns for animals are established:

1) general rules of hygiene of forages for animals;

2) conditions and procedure for ensuring traceability of forages for animals;

3) rules of placement in the market and uses of forages for the animals intended for production of foodstuff and for the animals who are not intended for production of foodstuff;

4) requirements to marking, packaging and trade dress of forages.

2. These Requirements extend on:

1) activities of operators of the fodder sector at all stages, from production of raw materials for forages before their placement in the market;

2) feeding of the animals intended for production of foodstuff;

3) import and export of forages for animals;

4) undesirable substances of fodder raw materials.

3. Provisions of these Requirements concerning hygiene of forages are not applied to animals:

1) to private house production of forages;

a) for the animals intended for production of foodstuff for private house consumption;

b) for the animals who are not intended for production of foodstuff;

2) to feeding of the animals intended for production of foodstuff for private house consumption or for direct deliveries the producer of small amounts of fodder raw materials to final consumers;

3) to production of raw materials for the forages delivered by the producer in small amounts directly to local farms for the purpose of use in these farms;

4) to feeding of the animals who are not intended for production of foodstuff, except for Item 74 provisions;

5) to retail trade by sterns for pets.

4. For the purpose of application of these Requirements concepts of the Law No. 306/2018 on safety of foodstuff, the Law No. 211/2017 on protection of the animals used in experimental or other scientific purposes, the Law No. 211/2007 on veterinary and sanitary activities are used and also the following concepts are in addition determined:

mixing of fats - production of the combined forages or components received from the same type of plants or animals, fodder raw materials by mixing of crude oils, the refined oils, animal fats, oils received from operators of the food sector, or derivative products from them for production of mix of oils or fats, except for productions of the combined forages or products received from the same type of plants or animals.

the animal who is not intended for production of foodstuff - any animal who is brought up, gets divorced or contains, but is not intended for food of the person, for example, the fur animals, pets and animals containing in laboratories, zoos or circuses;

the fur animal - any animal who is not intended for consumption by the person and production of food which is brought up, gets divorced or contains for fur production;

the animal intended for production of foodstuff - any animal who is brought up, gets divorced or contains for production of foodstuff for consumption by the person;

technological additive - any substance which is not used as forage, used in case of conversion of forages or fodder raw materials for achievement of the technological purpose during processing and conversion that can lead to inadvertent, but inevitable presence of residual amounts of some substances or their derivatives at end product provided that this remaining balance does not render side effect on health of animals, the person or on the environment and have no technological impact on ready forages;

criterion of hygiene of process - the criterion specifying production process functioning acceptability degree. This criterion does not extend to the goods placed in the market. He establishes threshold of pollution for which excess the adjusting measures directed to maintenance of hygiene of process according to the legislation concerning forages for animals are applied;
