About cargo rates on the territory of the Republic of Belarus railway transport public

Based on subitem 2.1 of Item 2 of the Presidential decree of the Republic of Belarus of February 25, 2011 "About some questions of price regulation (rates) in the Republic of Belarus" the Ministry of anti-monopoly regulation and trade of the Republic of Belarus DECIDES: No. 72

1. Establish cargo rates on the territory of the Republic of Belarus railway transport public, except the carriages of goods following transit across the territory of state members of the Eurasian Economic Union, and also work (service) connected with the organization and implementation of this transportation according to appendices 1-25.

2. Approve the Instruction about procedure for establishment and application of cargo rates on the territory of the Republic of Belarus by railway transport public, except the carriages of goods following transit across the territory of state members of the Eurasian Economic Union and also for works (services) connected with the organization and implementation of this transportation it (is applied).

3. Declare invalid the resolution of the Ministry of anti-monopoly regulation and trade of the Republic of Belarus of June 18, 2019 No. 51 "About cargo rates on the territory of the Republic of Belarus railway transport public".

4. This resolution becomes effective in 10 days after its official publication.

The instruction about procedure for establishment and application of cargo rates on the territory of the Republic of Belarus railway transport public, except the carriages of goods following transit across the territory of state members of the Eurasian Economic Union and also for works (services) connected with the organization and implementation of this transportation

Chapter 1. General provisions

1. This Instruction determines procedure for establishment and application of cargo rates by the territory of the Republic of Belarus railway transport public, except the carriages of goods following transit across the territory of state members of the Eurasian Economic Union (further – cargo hauling), rates for works (services) connected with the organization and implementation of this transportation in the following types of messages:

in the intra republican message;

in the international message (export, import, transit through the territory of the Republic of Belarus of the load following in the message between state members of the Eurasian Economic Union (further – state members), between the territories of one of state members with participation of the railroad of the Republic of Belarus, from the territory of one state member through the territory of the Republic of Belarus to the third countries through seaports of state members and  in the opposite direction).

2. This Instruction is obligatory for carriers of load railway transport public and consumers of their services.

3. For the purposes of this Instruction the following basic concepts and their determinations are applied:

the car concerning application of rate (further – the car) – the goods wagon of track of 1520 mm registered in accordance with the established procedure in the automated system applied by national association "Belarusian railroad" (further – the Belarusian railroad), with assignment of number according to the installed numbering system of goods wagons; the car of track of 1435 mm having numbering of goods wagon;

car-kilometer (further – vagono-km) – the unit of measurement corresponding to movement of one car on distance in one kilometer;

intra station transportation – cargo hauling with execution of the transport rail waybill (further – delivery note) with exit to railway tracks public within one tariff Item;

entrance frontier station – the next from Frontier of the Republic of Belarus (further – Frontier) railway station (further – the station) the Belarusian railroad through which cargo motion on the territory of the Republic of Belarus is performed;

output frontier station – the nearest station of the Belarusian railroad from Frontier through which cargo motion from the territory of the Republic of Belarus is performed;

load – the material values accepted for delivery by railway transport public in destination according to the transportation agreement including empty car of the consignor, consignee, load on the axes;

load on the axes –  the railway vehicles transported as a part of the freight, passenger-and-freight train according to complete carriage documents belonging to the consignor, the consignee on the property right or other legal cause (the car, the locomotive, the crane, snowplow on railway to the course and other railway vehicles), the passenger rail car of carrier which is not registered in accordance with the established procedure as goods wagon in the automated system applied on the Belarusian railroad with assignment of number according to the installed numbering system of goods wagons, except for the car of track of 1435 mm having numbering of goods wagon;

household things – load for personal, family, house and other needs of the physical persons which are not connected with business activity;

zone and degree of bulkiness – load exit indicators for loading dimension outline;

the container train – the train of the established length and rout to follow created from cars with large size containers and other cars included in the structure of the container train taking into account requirements of rules of carriages of goods by railway transport public (further – rules of carriages of goods) (the car with conductors, the car of cover and others) following assignment to one station of disbandment without conversion along the line. In case of cargo haulings by national (common network) carriers length of the container train is established by the Belarusian railroad;

container sending – the load accepted for shipment on one delivery note from one sender on one station of origin to one receiver on one station of destination in one container;

regulating authority – state body to which according to the legislation functions of price regulation (rates) for carriage of goods, and also works (service) connected with the organization and implementation of this transportation are assigned;

the axle-kilometer (further – wasp km) – the operational indicator characterizing car axis run on distance in one kilometer;

car sending – the load accepted for shipment on one delivery note from one sender on one station of origin to one receiver on one station of destination in one car;

train-kilometer (further – poyezdo-km) – the unit of measurement corresponding to movement of the train on one kilometer;

the transportation carriage charge – payment for transaction of cargo motion from station of origin to station of destination as a part of the freight, passenger-and-freight train;

transportation payments – the transportation carriage charge of load, and also payment for works (services) connected with the organization and implementation of this transportation, which arose for the period from cargo reception to transportation before its issue to the consignee;

works (service) connected with the organization and implementation of carriage of goods – works (service) rendered by carrier before acceptance of load to transportation during implementation of transportation and after issue of load to the consignee (further – works (service));

the national team concerning application of rate car sending (further – combined car sending) – the sending consisting of the loads (except loads on the axes, the autotractor machinery transported together with packagings of spare components, tools) allowed to joint transportation in one car on one delivery note and relating to different line items of the Single tariff and statistical nomenclature of loads approved by the decision of the 20th meeting of Council for rail transport of the State Parties of the Commonwealth of Independent States (further – ETSNG);

station of destination – the station specified by the consignor in delivery note at which the load shall be issued by carrier to the consignee;

station of origin – the station of cargo reception specified by the consignor in delivery note to transportation;

tariff distance – the shortest or in the cases determined by the Belarusian railroad, the actual distance of implementation of cargo hauling for which the transportation carriage charge is charged;

rates of tariff schemes No. And 1, And 2, I3 – infrastructure component of cargo rate the locomotive of carrier in the car of carrier, the consignor, consignee;

rates of the tariff scheme No. B – car component of cargo rate the locomotive of carrier in the car of carrier;

rates of tariff schemes No. L1, L2, L3 – locomotive component of cargo rate the locomotive of carrier in the car of carrier, the consignor, consignee;

rates without allocation of tariff components – the rates established based on total expenses of carrier: rates of tariff schemes No. 4-54; the rates established for 1 kilometer of transportation (poyezdo-km, wasp km, konteynero-km, km).

Other terms and their determinations applied in this Instruction are used in the values established by the Law of the Republic of Belarus of    January 6, 1999 No. 237-Z "About rail transport", the Charter of rail transport public approved by the resolution of Council of Ministers of the Republic of Belarus of   August 2, 1999 No. 1196, the Agreement on the international railway freight traffic of   November 1, 1951 (further – SMGS), the Agreement on the Eurasian Economic Union of  May 29, 2014.

4. The rates given according to appendices 1-25 to the resolution which approved this Instruction are established without the value added tax. The value added tax is levied according to the legislation.

Chapter 2. General procedure for determination of the transportation carriage charge

5. The transportation carriage charge is determined:

in the intra republican message – for tariff distance from station of origin to station of destination;

in case of cargo importation on the territory of the Republic of Belarus – for tariff distance from entrance frontier station, including distance from Frontier, to station of destination;

in case of cargo exportation out of limits of the Republic of Belarus – for tariff distance from station of origin to output frontier station, including distance to Frontier;

in case of transit transportation through the territory of the Republic of Belarus – for tariff distance from entrance frontier station, including distance from Frontier, to output frontier station, including distance to Frontier.

6. The minimum tariff distance of transportation (including intra station transportation and transportation with the separate locomotive) for which the transportation carriage charge is determined, – 50 km.

In case of determination of transportation payment for the amount of tariff distances when readdressing load each of distances shall be at least 50 km.

7. The transportation carriage charge is calculated on rates which were effective in day of putting down in delivery note of calendar stamp of carrier:

on station of origin – for load which transportation is drawn up by delivery note of the intra republican message or delivery note of the through international traffic;

at the station (place) of reshipping – in transit load on the delivery note provided by SMGS.

8. The transportation carriage charge is determined:

by summing of rates of the corresponding tariff schemes (with allocation of tariff components) given in appendices 1-6 to the resolution which approved this Instruction, with the subsequent multiplication the received sums on coefficients determined by this Instruction;

by multiplication of rates of the corresponding tariff schemes (without allocation of components) given in appendices 7-17 to the resolution which approved this Instruction on the coefficients established by this Instruction;

by multiplication of the rates established for 1 kilometer of transportation (poyezdo-km, wasp km, konteynero-km, km), given in appendix 18 to the resolution which approved this Instruction on the corresponding unit of measurement.

9. Numbers of tariff schemes for determination of the transportation carriage charge of load are established according to appendices 1 and 2  .

10. The coefficients applied in case of determination of the transportation carriage charge of load by car sending depending on sort of load, type and accessory of the car are established according to appendix 3. Coefficients are not applied in case of determination of the transportation carriage charge of the automotive vehicle (further – automatic telephone exchange), intermodal transport unit (further – ITE).

In case of determination of the transportation carriage charge of load in the specialized car of carrier of track of 1520 mm sent carrier instead of the load of the universal car of carrier provided by the shipping request the coefficients established for the corresponding universal car are applied.

11. Numbers of tariff schemes, coefficients to rates, the corresponding rates without allocation of components, conditions of application of rates are determined based on data and the corresponding marks in delivery note provided by rules of carriages of goods, SMGS, other international treaties.

12. The transportation carriage charge of load determined according to this Instruction is rounded to the whole kopeks.

In case of determination of the transportation carriage charge of load according to Item 24 of this Instruction the payment in US dollars is rounded to within two signs after comma with intermediate rounding in similar procedure for the rate calculated in US dollars.

When rounding payment calculation is made using rules of mathematical rounding of final value to within two signs after comma.

13. Rates of tariff schemes No. And 1, And 2, are determined by L1, L2 proceeding from the settlement mass of load. The procedure for determination of settlement mass of load for charge of the transportation carriage charge is established in Chapter 3 of this Instruction.

14. The transportation carriage charge of load in the universal car of the consignor, consignee, carrier with wheel gage of 1520 mm including entering coupling of cars and also in the specialized car of carrier of track of 1520 mm sent carrier instead of the load of the universal car of carrier provided by the shipping request is determined taking into account the minimum weight loading rate of the corresponding universal car (further – MVN), except carriages of goods by combined car sending.

MVN of the universal car of the consignor, the consignee, carrier with wheel gage of 1520 mm are established according to appendix 4.

15. The transportation carriage charge of loads, including on coupling of cars, is determined by combined car sending according to the procedure, established by this Instruction, as for load with the highest level of the transportation carriage charge as a part of combined car sending.

16. The transportation payment for intra station cargo hauling is determined according to the procedure, established by this Instruction, using 0,5 coefficient.

17. The transportation carriage charge is determined by car sending coffins with bodies of the dead according to the procedure, established by this Instruction, using 0,45 coefficient.
