About procedure of payments of the planned salary fund of employees of state-financed organizations

(as amended on 23-06-2021)

Based on subitem 7.1.9 of Item 7 of the Regulations on the Ministry of Labour and Social Protection of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1589, the Ministry of Labour and Social Protection of the Republic of Belarus DECIDES:

1. Approve the Instruction about procedure of payments of the planned salary fund of employees of state-financed organizations it (is applied).

2. This resolution becomes effective after its official publication and extends the action to the relations which arose since January 1, 2021.

The instruction about procedure of payments of the planned salary fund of employees of state-financed organizations

Chapter 1. General provisions

1. This Instruction determines procedure of payments of the planned salary fund of employees of the state-financed organizations subordinated to the Ministry of Labour and Social Protection (except for "Research Institution of Work of the Ministry of Labour and Social Protection of the Republic of Belarus" organizations), organizations of social servicing, houses (centers) of temporary stay of the persons of no fixed abode subordinated to local executive and administrative organs (further - state-financed organizations).

This Instruction is developed for the purpose of ensuring single approaches when calculating the planned salary fund of employees of state-financed organizations (further - the planned salary fund) according to the Presidential decree of the Republic of Belarus of January 18, 2019 No. 27 "About compensation of employees of state-financed organizations" and other regulatory legal acts regulating payment terms of work of employees of state-financed organizations.

2. The funds provided in the relevant budgets, the means gained from implementation of the activities which are bringing in incomes (further - extrabudgetary funds), and also means from other sources which are not forbidden by the legislation are allocated for salary payment, implementation of lump sum payment on improvement and rendering financial support if other is not established by the President of the Republic of Belarus.

3. Calculation of the planned salary fund is perfromed by receivers of budgetary funds within the budgetary appropriations determined by it managers of budgetary funds in the budget list for the corresponding financial (calendar) year, and by extrabudgetary funds - proceeding from economically reasonable costs in the conditions similar applied when forming the planned salary fund in budget estimates.

Starting base for calculation of the size of the planned salary fund are: scale of charges, base rate, the planned indicators of activities of state-financed organization, the staff list.

For calculation of the size of the planned salary fund data of the staff list of state-financed organization as of January 1 about the number of staff of employees of state-financed organization are used (taking into account vacant positions of employees (professions of workers) and the operating work payment terms.

In case of change of the number of staff of employees of state-financed organization within year the corresponding changes brought in the staff list are considered when implementing calculations, stipulated in Item the 15th this Instruction.

As the lowest border of compensation of workers for work in normal conditions during the normal duration of working hours in case of accomplishment of the obligations of the worker following from the legislation, local legal acts and the employment contract, the employer applies minimum wage.

Chapter 2. Features of determination of salaries, allowances and surcharges on vacant positions of employees (professions of workers)

4. On vacant positions of employees on which intra official qualification categorization is provided the salary is determined by the second qualification category.

5. Stimulating (allowances) and compensating (surcharges) of payment for vacant positions of employees (professions of workers) are provided taking into account the following:

the allowance for length of service in state-financed organizations – by stazhevy group from 5 to 10 years in the amount of 15 percent of base rate;

the allowance for work in the rural zone – to heads and specialists in the amount of 15 percent of base rate according to subitem 2.1 of Item 2 of the Instruction on procedure and the sizes stimulating and the Republic of Belarus compensating payments, approved by the resolution of the Ministry of Labour and Social Protection of May 31, 2019 No. 23;

the allowance according to the paragraph third Item parts one 3 parts one of Article 261-2 of the Labor code of the Republic of Belarus – in the amount of the average percent which developed in state-financed organization for last year;

the allowance for professional activity peculiarities the employee holding positions of the social worker and nurse – in the amount of 10 percent of salary according to subitem 1.1 of Item 1 of the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of May 31, 2019 No. 23 "About compensation of workers";
