Some questions of appointment and payment of the government public assistance to persons with disability since the childhood and to children with disability

According to part six of article 1 of the Law of Ukraine "About the government public assistance to persons with disability since the childhood and to children with disability" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for appointment and payment of the government public assistance to persons with disability since the childhood and to children with disability which is applied.

2. Ceased to be valid according to the Resolution of the Cabinet of Ministers of Ukraine of 30.12.2022 No. 1474

Procedure for appointment and payment of the government public assistance to persons with disability since the childhood and to children with disability

1. This Procedure according to the Law of Ukraine "About the government public assistance to persons with disability since the childhood and to children with disability" determines conditions of appointment and payment, the list of the documents necessary for appointment:

the government public assistance to persons with disability since the childhood or to children with disability aged to 18 years (further - the government public assistance);

allowances on care of persons with disability since the childhood or children with disability aged to 18 years (further - the allowance on leaving);

benefits for burial of person with disability since the childhood or the child with disability aged to 18 years (further - benefit for burial).

Appointment and payment of the government public assistance, the allowance to leaving and the help on burial are performed with observance of requirements of the Law of Ukraine "About ministerial procedure".

2. The government public assistance is appointed and paid to citizens of Ukraine, foreigners and stateless persons who constantly live in the territory of Ukraine, and also to persons who are recognized in Ukraine as refugees or persons who need additional protection.

Action of this Procedure extend also to citizens of the Republic who are in the territory of Ukraine, with observance of provisions of the Law "About Establishment of Additional Legal and Social Guarantees for Citizens of the Republic Who Are in the territory of Ukraine".

3. Appointment and payment of the government public assistance, the allowance to leaving and the help on burial are performed by structural divisions concerning social protection of the population district, district in Kiev and Sevastopol of the state administrations (military authorities), executive bodies city, district in the cities (in case of their education) councils (further - social security authorities of the population) at the declared (registered) place of residence (stay) of person addressing for purpose of the government public assistance, allowances on leaving and the help on burial with use (in case of technical capability) functionality of the Unified information system of the social sphere (except the payments performed according to the resolution of the Cabinet of Ministers of Ukraine of March 7, 2022 No. 215 "About features of charge and payment of money allowances, privileges and housing subsidies for the period of action of warlike situation" (The Official Bulletin of Ukraine, 2022, No. 25, Art. 1302).

Statements for purpose of the government public assistance, the allowance on leaving, benefits for burial to which necessary documents are attached (further - the statement with documents) are accepted by social security authorities of the population.

Statements with documents are adopted by structural divisions concerning social protection of the population of the district state administrations only in case of the direction them by means of mail service or if technically possible electronically (through the official website of Minsotspolitiki, information systems of executive bodies and local government bodies integrated with it or the Single state web portal of electronic services).

In the period of warlike situation for purpose of the government public assistance the applicant who temporarily is outside Ukraine (except persons which are in the territory of the state recognized under the law as the state invader and/or the state aggressor concerning Ukraine) directs the application with necessary documents and/or data to social security authority of the population to the address of the declared/registered residence (stay).

If the applicant notes data on the address of the declared/registered residence (stay) in the territories in which are conducted fighting (was conducted) or the territories which are temporarily occupied by the Russian Federation, included in the list in which are conducted fighting or temporarily occupied by the Russian Federation, the approved Minreintegration for which date of completion of fighting (the termination of possibility of fighting) or temporary occupation is not determined (was conducted), such statement with necessary documents and/or data can go to the postal address of structural division concerning social protection of the population of the regional state administrations (further - regional social security authority of the population) in the respective region.
