Rules of creation and activities in the territory of the closed administrative-territorial formation of the organizations with foreign investments

1. These rules determine procedure for creation and activities in the territory of the closed administrative-territorial formations of the organizations with foreign investments taking into account requirements of providing particular treatment in the territory of these educations.

2. During creation of the organization with foreign investments in the territory of the closed administrative-territorial education her founder represents to federal executive body, State Atomic Energy Corporation "Rosatom" or the State corporation on space activities Roskosmos under which authority the companies and (or) objects by the nature of which activities the corresponding closed administrative-territorial education is created (further - the interested body), the statement for state registration of the legal entity (further - the statement) in the form approved by the authorized Government of the Russian Federation federal executive body are.

3. The application is submitted in the interested body directly or goes the registered mail with the notification.

Date of submission of the statement is day of its actual obtaining by the interested body.

The interested body provides accounting and storage of statements.

4. Within 3 working days from the date of receipt from the founder of the organization with foreign investments (further - the founder) statements the interested body sends its copy for review to Federal Security Service of the Russian Federation and the Ministry of Internal Affairs of the Russian Federation.

5. The Federal Security Service of the Russian Federation and the Ministry of Internal Affairs of the Russian Federation within 30 days from the date of receipt of the copy of the application make the decision on consent on creation of the organization with foreign investments in the territory of the closed administrative-territorial education or on refusal in its creation and bring the relevant information to the interested body.

6. If the interested body, Federal Security Service of the Russian Federation and the Ministry of Internal Affairs of the Russian Federation agree to creation of the organization with foreign investments in the territory of the closed administrative-territorial education, the official of the interested body within 5 working days from receipt date of information, stipulated in Item 5 these rules, puts down in appropriate section of the statement mark about approval with indication of the position, surname, name, middle name, assures her the signature, seals official the interested body and returns the application to the founder.

7. If the interested body, Federal Security Service of the Russian Federation or the Ministry of Internal Affairs of the Russian Federation makes the decision on refusal in creation of the organization with foreign investments in the territory of the closed administrative-territorial education, the interested body within 5 working days from receipt date of information, stipulated in Item 5 these rules, issues (sends) to the founder the adequate notice with motivated refusal.

8. The founder after receipt of the notification on decision making about creation of the organization with foreign investments in the territory of the closed administrative-territorial education submits the application in accordance with the legislation of the Russian Federation in the relevant territorial authority of the Federal Tax Service.

9. Organization activity with foreign investments in the territory of the closed administrative-territorial education is performed according to requirements of orders of the Government of the Russian Federation of June 11, 1996 No. 693 "About approval of the Regulations on procedure for providing particular treatment in the closed administrative-territorial education in the territory of which objects of State Atomic Energy Corporation "Rosatom", of June 26, 1998 No. 655 "About approval of the Regulations on providing particular treatment in the closed administrative-territorial education in the territory of which objects of the Ministry of Defence of the Russian Federation", of June 29, 2011 No. 519 "About providing particular treatment in the closed administrative-territorial education are located are located, in the territory of which objects of space infrastructure" and of June 22, 2017 No. 735 "About approval of the Regulations on providing specific mode of safe functioning in the closed administrative-territorial education in the territory of which the organizations and (or) objects which are under authority of the Ministry of Industry and Trade of the Russian Federation are located" are located.
