About additional measures for deepening of reforms in building sector of the Republic of Uzbekistan
For the purpose of further deepening of reforms in building sector, decrease in bureaucratic barriers, widespread introduction of the innovative ideas, developments and the advanced information and communication technologies, and also ensuring transparency at all stages of construction:
1. Establish procedure according to which:
a) application till December 31, 2028 in the territory of the Republic of Uzbekistan of foreign regulating documents in the field of technical regulation in the field of town-planning activities (further - regulating documents) according to appendix No. 1 along with national regulating documents, including at stage of conducting examination of the project documentation is allowed, under condition:
adaptations with involvement of the local design and survey organizations of the project documentation prepared on the basis of foreign regulating documents with development of the special specifications providing compensating measures regarding discrepancy with national regulating documents;
coverings from the customer (investor) of expenses on fee of the independent foreign specialists and consultants involved, if necessary, by authorized body by consideration of the adapted project documentation irrespective of result of such consideration;
b) since July 1, 2020:
the electronic rating of the design and survey organizations automatically created according to tax and statistical statements takes root (work experience, the number of workers, including qualified, amount of fixed assets, the gained income and the paid taxes, the salary fund and other criteria);
c) since September 1, 2020:
the electronic rating of construction contract organizations automatically created according to tax and statistical statements (work experience, the number of workers, including qualified, amount of fixed assets, the gained income and the paid taxes, the salary fund and other criteria), and also the data of Inspectorate for control in the field of construction takes root under the Ministry of construction of the Republic of Uzbekistan (amount the completed by construction of facilities, availability of instructions on elimination of violations of the town-planning legislation and their execution, and also other criteria) with differentiation of rating on categories depending on amounts and construction objects;
d) since January 1, 2021:
procurement procedures within public procurements in the field of construction are performed electronically online with ability to integrate with other electronic systems and uses of these electronic ratings of design and survey and construction contract organizations in case of assessment of their compliance to the established qualification requirements of procurement procedures;
the design and survey and construction contract organizations included in electronic rating and having positive indicators by the corresponding criteria (work experience, financial stability, availability in staff of skilled workers which data are included in the interdepartmental hardware and software «Single National System of Work», and other criteria) are allowed to participation in public procurements in the field of construction;
the project documentation on the objects financed by means of the state customers and subjects of public procurements is subject to obligatory examination on conformance to requirements of energy efficiency in the terms allotted for conducting complex examination of the project documentation;
the requirement about accomplishment by own forces at least thirty percent from the cost of works (services) by design and survey and construction contract organizations, the declared winners of procurement procedures within public procurements in the field of construction is introduced.
2. Agree with the offer of the Ministry of construction, the Ministry of Economy and Industry, Ministry of Finance of the Republic of Uzbekistan and khokimiyat of Tashkent on carrying out experiment on involvement of subjects of private entrepreneurship to implementation of functions of the customer in the city of Tashkent (further - experiment) providing:
selection of 10 construction objects in the city of Tashkent, designing and which construction is planned for 2021-2022;
the conclusion of contracts for engineering services (including test authority and project management) with subjects of private entrepreneurship by results of selection of the best offers;
approval of the list of construction objects by the Cabinet of Ministers of the Republic of Uzbekistan and the subjects of private entrepreneurship participating in experiment.
Determine that the experiment is made till completion of building and construction works and input of the selected objects in operation.
3. Create the Center of technical regulation in construction under the Ministry of construction of the Republic of Uzbekistan (further - the Center) in the form of public institution.
4. Determine the main objectives of the Center:
studying of problems of system of regulation in construction and implementations of innovative technologies;
harmonization of national regulating documents with the international standards, rules and standards in construction on the basis of their studying and the analysis;
development of requirements for safety of buildings, constructions and their separate elements, and also actions for increase in energy efficiency of buildings and constructions;
creation and maintaining scientific and technical library and electronic base of regulating documents, including foreign;
interaction with the foreign and international organizations, consultants and specialists and their attraction to enhancement of base of national regulating documents.
5. Approve structure of the Center of technical regulation in construction under the Ministry of construction of the Republic of Uzbekistan with extreme number of managerial personnel in number of 20 units according to appendix No. 2.
activities of the Center are financed by the means of the Government budget of the Republic of Uzbekistan, fund of support of activities of the Ministry of construction of the Republic of Uzbekistan, means of technical assistance (grants) of MFI/IPFO and other sources which are not prohibited by the legislation;
the number of staff of the Center is completed due to optimization of managerial personnel of the relevant ministries and departments in 2020.
6. To the ministry of construction of the Republic of Uzbekistan in two-month time to approve the Program for development and review of national regulating documents in the field of technical regulation in the field of town-planning activities in 2020 - 2023 (further - the Program).
Determine that within program implementation:
development, review and enhancement of national regulating documents, including departmental, is performed with involvement of the foreign companies having work experience in the construction sphere;
the industry ministries and departments provide provision without fail to the Ministry of construction of the Republic of Uzbekistan of drafts of the developed and reviewed regulating documents, including departmental, on approval before their approval;
