Article 1. Subject of regulation of this Federal Law

1. This Federal Law establishes legal and organizational basis of application of the electronic certificate, regulates procedure for its forming and change, procedure for acquisition and payment of separate types of goods, works, services with use of the electronic certificate.

2. Operation of this Federal Law does not extend to the relations arising in connection with provision of the state (municipal) services included in lists (qualifiers) of the state and municipal services rendered to physical persons which forming, maintaining and approval are performed according to the procedure, established according to Item 3 of Article 69.2 of the Budget code of the Russian Federation.

3. In the cases which are not settled by this Federal Law, the rights, obligations and responsibility of participants of the relations connected with acquisition of separate types of goods, works, services with use of the electronic certificate are determined according to the civil legislation of the Russian Federation, at the same time the legislation of the Russian Federation on consumer protection is applied to the relations between consumers and sellers (contractors) in the part which is not settled by this Federal Law.

Article 2. The basic concepts used in this Federal Law

1. For the purposes of this Federal Law the following concepts are used:

1) consumers are the citizens of the Russian Federation having the right to acquisition of separate types of goods, works, services with use of the electronic certificate;

2) sellers (contractors) - the legal entities, individual entrepreneurs, physical persons performing sales of goods, performance of works, rendering the services included in the lists of separate types of goods, works, services provided by part 6 of article 3 of this Federal Law;

3) the electronic certificate - the record placed in the State information system of electronic certificates electronically containing data on the right of the citizen of the Russian Federation to independent acquisition of separate types of goods, works, services at the expense of means of the relevant budget of the budget system of the Russian Federation and used for payment confirmation of such goods, works, services in the amount established by the legislation of the Russian Federation;

4) the register of electronic certificates - the information resource containing the data received as a result of forming, change and use of electronic certificates and placed in the State information system of electronic certificates;

5) the body providing support measures - the public authority, state non-budgetary fund management authority of the Russian Federation or governing body of territorial state non-budgetary fund authorized on decision making about provision of measures of support;

6) the State information system of electronic certificates (further also - information system) - the federal state information system created for the purpose of ensuring realization of the right of citizens of the Russian Federation to independent acquisition of separate types of goods, works, services with use of the electronic certificate.

2. Concepts "National Payment Card System", "national payment instrument", NSPK are used in the values determined by the Federal Law of June 27, 2011 No. 161-FZ "About national payment system".

Article 3. Right to acquisition of separate types of goods, works, services with use of the electronic certificate

1. The right to acquisition of separate types of goods, works, services with use of the electronic certificate arises in the presence at the citizen of legal basis on receipt of measure of social protection (support), social service within social servicing and the government public assistance, other social guarantee provided in accordance with the legislation of the Russian Federation in natural form at the expense of means of the relevant budget of the budget system of the Russian Federation (further - support measures), and does not exclude the right to measures of support by the different ways established in accordance with the legislation of the Russian Federation.

2. The application for provision of adequate measure of support is submitted to the body providing support measures, according to the procedure, determined by the Government of the Russian Federation or the supreme body of the executive authority of the subject of the Russian Federation, according to the powers established by the legislation of the Russian Federation for this measure of support. The specified application can be directed to the body providing support measures including with use of the federal state information system "Single Portal of the State and Municipal Services (Functions)" (further - the single portal).

4. Have the right to acquisition of separate types of goods, works, services with use of the electronic certificate:

1) disabled veterans;

2) participants of the Great Patriotic War;

4) the military personnel passing military service in the military units, organizations, military schools which were not part of field army during the period from June 22, 1941 to September 3, 1945 at least six months, the military personnel awarded with awards or medals of the USSR for service during the specified period;

5) persons awarded with sign to "The resident of besieged Leningrad";

6) persons awarded with the sign "The Resident of the Besieged Sevastopol";

6. 1) persons awarded with the sign "The Inhabitant of the Besieged Stalingrad";

7) persons working in the period of the Great Patriotic War at objects of air defense, local air defense, construction of defensive works, naval bases, airfields and other military facilities within rear borders of the operating fronts, operational zones of the operating fleet on front sites iron and highways, and also members of the crews of vessel of the transport fleet interned at the beginning of the Great Patriotic War in ports of other states;

8) members of families of the died (died) disabled veterans, participants of the Great Patriotic War and combat veterans, members of families of persons who died in the Great Patriotic War from among staff of groups of self-defense of object and crash teams of local air defense, and also members of families of the died employees of hospitals and city hospitals of Leningrad;

9) disabled people;

10) handicapped children;

11) persons which are subject to compulsory social insurance from labor accidents and occupational diseases in case of the right to measures of support for loss occurrence according to the Federal Law of July 24, 1998 No. 125-FZ "About compulsory social insurance from labor accidents and occupational diseases";

12) persons which were affected by radiation owing to catastrophic crash on the Chernobyl NPP, and also owing to nuclear testing at Semipalatinsk Test Site, and the categories of citizens equated to them;
