About inland water transport

(as amended on 19-07-2022)

This Law determines legal, economic and organizational basis of functioning of inland water transport and is directed to creating favorable conditions for its development, requirements satisfaction of citizens in available, high-quality and safe transportations.

Section I General provisions

Article 1. Determination of terms

1. In this Law terms are used in such value:

Emergency event - event or the sequence of the events which took place during operation of the vessel or in connection with operation which brought or could lead of 1) to death or disappearance of the person from the vessel, to damnification to health of the person, death, flooding, damage of the vessel, vessel abandonment by crew, loss by the vessel of shipping condition, ship sitting on bank, to damage of hydraulic engineering constructions of inland waterways, pollution of the surrounding environment;

2) baggage - any subject or the vehicle transported by transportation contract carrier (except transported according to the contract for the carriage of goods, including charter agreements and bills of lading, and also except live animals and baggage, take place in cabin of the passenger or otherwise are in its ownership, under its protection or control) and is confirmed by the luggage receipt;

3) base for the parking of small ships - specially equipped property complex used by the subject of managing on legal causes including yacht-club, marine, the place of basing of vessels of the fleet of fish industry which provides services of safe storage of small and pleasure crafts, other services to courts and their crews (except bases for the parking of sports courts);

4) base for the parking of sports courts - specially equipped property complex used by subject of managing which, among other things, provides services in safe storage of exclusively sports courts and courts intended for ensuring holding sporting events;

5) the tow - the vessel constructed especially for accomplishment of transactions on towage, pushing, canting;

6) towage - movement of courts, floating constructions and floating objects by the tow or other vessel by means of the towing rope;

7) cargo waste - remaining balance from any load onboard in cargo holds or tanks which remain after completion of the procedures of loading, unloading and transactions on cleaning, including load remaining balance;

8) the paddle driven ship - the vessel without engine for which movement the muscular strength of the person is used;

9) exit in run - vessel exit (structure of courts) out of limits of the operational water area of berthing facility or removal of the vessel from anchoring berth for the purpose of following to other destination (sea or river port, the terminal, repair depot, etc.), or vessel exit to the ship course;

10) the waste (garbage) which is formed as a result of operation of the vessel - the waste which is formed in use and servicing of the vessel except the cargo waste and domestic waste which are formed on the vessel (economic garbage);

11) the owner of the vessel - physical person or legal entity which perform concerning the courts of the right assigned to them to which rules about the property right are applied;

12) inland waterways - the surface waters (except the water area of seaports, navigation canals and seawaters) referred by the Cabinet of Ministers of Ukraine in accordance with the established procedure to category shipping;

13) inland water transport - mode of transport to which vessels, the subjects of managing performing and providing transportations preferential with inland waterways of loads, passengers, baggage and mail, used for fishing activities which provide other services with use of inland navigation vessels belong provide navigation on inland waterways, contain the infrastructure facilities of inland waterways performing navigation and hydrographic ensuring navigation;

14) the water bike - the type of the self pleasure craft, the personal floating craft up to 4 meters long inclusive intended for sports activities or rest which is set in motion by water-cannon and is controlled person who is on the case, but not in means;

15) dimensions of the ship course - depth, width, surface height and rounding radius of the ship course on inland waterways in meters;

16) the guaranteed dimensions of the ship course - the smallest dimensions of the ship course established according to the legislation in case of project water-level;

17) the harmonized information services - the services provided for support of mission control and inland water transport including services in interaction with other modes of transport. Provision of information on waterway, information on movement, mission control, the help in prevention of emergency situations, provision of information for management of transport, concerning services of statistics and Customs Services, and also concerning taxes and fees on use of infrastructure of waterways and the harbor fees, in particular, belong to such services;

18) hydraulic engineering constructions of inland waterways - the technical constructions (moorings, piers, piers, other types of berthing facilities, dams, piers, breakwaters, other types of bank protection constructions, nagivation locks, navigation canals of inland waterways, other underwater constructions of artificial origin) intended for ensuring safe swimming, maneuvering, the parking, construction, repair, servicing and survey of courts, for protection of shore of inland waterways, the operational water area of the mooring (moorings), conducting economic activity by the companies of inland water transport, use of water resources and prevention of parasite effect of waters;

19) soil - deposits (soil oozy, sandy, stony, clay and/or their mix) which create natural bottom configuration of inland waterway or were demolished in bed of this way under the influence of natural and/or anthropogenous factors and are withdrawn in the course of dredging;

20) vessel length - the maximum length of the case of the vessel without wheel and bowsprit;

21) boat team - the captain and other persons who are engaged at vessel board with fulfillment of duties connected with operation or servicing of the vessel, or fulfill other duties on the vessel and specified in the muster roll of this vessel;

22) operational dredging (repair scooping) - works on mitigation of consequences of zanosimost, withdrawal of the deposits from the soil located over the set level of project bottom on the ship courses of waterways, operational water areas of berthing facilities, navigation canals for the purpose of providing the guaranteed, navigation, passport dimensions of the ship course, operational water areas of berthing facilities, navigation canal;

23) operating organization - subject of managing which performs operation of the hydraulic engineering construction of inland waterways irrespective of whether he is owner of such construction, exploits him on other legal causes;

24) means for entertainments on water - floating crafts without power unit which are towed in any manner (water ski, water sledge, "bananas", "washers", etc.), constructed or are intended for sliding on surface of the water or accomplishment of sports figures;

25) aids to navigation - the inshore special fixed constructions, floating and stationary signal and obstruction lights and signs, designs equipped with special engineering devices and intended for orientation of boats barriers of navigation canals of inland waterways and the ship courses for the purpose of ensuring safe navigation of vessels;

26) side-by-side group - group of the courts (two or more) connected by board to board, any of which is not ahead of the motor ship providing movement of group;

27) individual life preserver - the means intended for deduction on water surface of the person who appeared behind board;

28) the foreign vessel - the vessel, flying the flag foreign state;

29) infrastructure of inland water transport - set of the objects providing navigation on inland waterways which turns on hydraulic engineering constructions of inland waterways, raids, backwaters, stalls of courts, means of navigation equipment and hydrographic ensuring navigation, the objects of river information service, network and construction of communication, the alarm system, informing and ship-traffic control, and also court and floating equipment intended for accomplishment of traveling works and other objects providing navigation on inland waterways;

30) near coastal voyage - run of the vessel between the Ukrainian ports (terminals) or destinations located in the territory of Ukraine without carrying out cargo operations, implementation of bunkering, replenishment of marine stores outside the territory of Ukraine;

31) the captain - person who performs command manages the vessel;

32) qualification documents of members of inland-water crews of vessel - the documents issued in the established form, confirming appropriate level of the professional competence necessary for safe work on the inland navigation vessel;

33) classification society - the legal entity who issues applies, supports and regularly updates own rules of classification (including technical requirements) concerning designing, design and survey of courts, will promulgate the register (register) of courts which are classified;

34) maximum draft of the vessel - the maximum draft of the vessel specified in ship's papers which is determined according to rules of measurement of courts;

35) small ship - any vessel up to 20 meters long (except the passenger carriers, tows and pushers intended for maintaining structure of the courts which are not small, floating equipment, icebreaker ships, ferry boats, floating equipment of cock boats and rafts, sports courts, and also water bikes and means of entertainments on water);

36) international flight - run of the vessel in which, at least, the destination or the place of departure of the vessel are located outside the territory of Ukraine;

37) the motor ship - any vessel using for movement own power unit, including the vessel which moves by means of sail and at the same time using the power unit placed on its board;

38) shipping season - the period during which navigation on inland waterways or their certain sites is performed;

39) navigation and hydrographic ensuring navigation - creation of conditions, favorable for navigation of vessels, by establishment and proper maintenance of aids to navigation according to traffic density and degree of danger, carrying out hydrographic surveys, the publication, updating and distribution of navigation and hydrographic information;

40) oil-containing mix - lyalny (podslanevy), oil refuse from engine-rooms of the vessel, other waters with any oil content which are formed on the vessel (except its stowage spaces);

41) the operational water area of berthing facilities - the hydraulic engineering construction of inland waterways (complex of constructions) which is directly adjoining berthing facilities, intended for safe approach of courts to berthing facilities and withdrawal from berthing facilities, maneuvering of courts when implementing mooring transactions, maneuverings courts between berthing facilities and also for the parking of courts;

42) the deck crew - crew members of the vessel who perform onboard the vessel the work connected with its movement, loading, unloading and carriage of goods, public conveyance, mails, baggage, maintenance and repair of the vessel, use and servicing of communicating device, labor protection, pollution prevention of waterways (except crew members who fulfill the duties connected only with operation of engines, cargo gears, electrical and electronic equipment);

43) the passenger - the physical person who is not crew member and is transported on the vessel according to the transportation agreement of the passenger;

44) the passenger ship - the vessel constructed and equipped for transportation more than 12 passengers;

45) carrier - subject of managing which performs carriages of goods, passengers and their baggage, mail by inland navigation vessels;

46) approach the channel - the hydraulic engineering construction of inland waterways intended for safe approach of courts to berthing facilities and locks;

47) floating construction - any floating installation constructed for stationary use afloat, including the parking vessel, floating landing stage, pier, the pontoon, landing stage, workshop, dock, the pool, shed, hotel, institution of public catering, entertaining institution, and, as a rule, not intended for movement;

48) floating equipment - the vessel (floating installation) on which working mechanisms are located (cranes, the equipment of dredges, copras or elevators);

49) floating object - fence or other design, object or the device capable to swimming which is not the vessel, floating equipment or construction floating;

50) the domestic waste which is formed on the vessel (economic garbage) - organic and inorganic domestic waste which does not contain the waste (garbage) which is formed as a result of operation of the vessel;

51) the ferry boat - the vessel performing on ferry crossings regular public conveyances, transportations on open and/or enclosed deck of wheeled vehicles with fuel in tanks and/or railway rolling stock with horizontal method of loading and unloading;

52) the obedient book - the personal document in which data, including in electronic form, about labor activity of the crew member, including about years of service of swimming and the performed runs are entered;

53) berthing facility - the hydraulic engineering construction of inland waterways (complex of constructions) having mooring and fender gears and intended for the parking, servicing and repair of courts, servicing of passengers including for their landing to vessels and deembarkations, carrying out cargo operations;

54) the recreational sailing ship - the vessel which moves only by means of sail, including the vessel equipped with the power unit which does not use it during movement;

55) the pleasure craft - the vessel up to 24 meters long intended for sports activities or rest which is not the passenger ship;

56) project water-level - settlement low shipping water-level;

57) run - navigation of the vessel from the place of departure to the destination, including swimming with in advance not certain destination;

58) river information service - service which provides the harmonized information services for safe and effective functioning of inland water transport, and also other modes of transport in bulk transportations;

59) the river craft - the vessel which on technical characteristics is suitable and is in accordance with the established procedure allowed to operation only in certain zones of inland waterways;

60) river port (terminal) - subject of managing of any pattern of ownership which on legal causes uses infrastructure facilities of inland water transport for the parking and servicing on inland waterways of courts, servicing of passengers, carrying out cargo operations, and also other types of economic activity connected with it;

61) structure of courts - group of the courts (two or more) connected among themselves in such a way that separately taken vessel has no complete freedom of movement which is set in motion by means of one or several tows (towed barge train) or pushers (structure of courts that is pushed);

62) the sports vessel - the motor, paddle or sailing ship used only for sports activities is also serviced during swimming by specially prepared persons (servicing);

63) years of service of swimming of the crew member - swimming term in days during which the crew member was onboard the vessel during implementation of runs and cargo operations;

64) strategic infrastructure facilities of inland water transport - navigation canals of inland waterways (except approach channels to berthing facilities and navigation canals of internal seawaters), shipping hydraulic engineering constructions, aids to navigation and navigation and hydrographic ensuring navigation, objects of river information service of the state pattern of ownership;

65) the vessel - the self-propelled or non-self-propelled floating vehicle which is used:

for carriage of goods, passengers, baggage and mail, for fishing activities, exploration and production of minerals, search and rescuing of people and courts, in distress on water, towages, pushing or maintaining structure of other courts or floating objects, implementation of rescue, road, hydrotechnical, navigation and hydrographic works, servicing of courts and passengers in river port (terminal) or raising of the sunk property;

for implementation of the state supervision of safety of navigation, environmental protection and water bioresources;

for rest (walks, tourism, amateur fishery);

for sports activities;

for the scientific, research, educational and cultural purposes;

66) the inland navigation vessel - the river craft or the vessel of the mixed swimming 20 meters long and more or the vessel, the work of length which width and rainfall the amount in 100 cubic meters and makes more, the tows and pushers intended for maintaining structure of such courts or floating equipment and also passenger carriers and floating equipment;

67) the vessel of the mixed swimming - the vessel intended for operation on inland waterways and suitable for limited operation on sea waterways;

68) the vessel of the technical fleet - the vessel constructed and equipped for carrying out traveling works (dredging dredger or the suction dredger, the dredge, dump-scow, the pontoon barge, the pontoon, the erector arm tunnel driver, the floating crane and others);

69) the shipping agent - the marine agent or other person who under the agreement of agency service for remuneration shall render services to the shipowner and the ship master in the field of navigation by inland waterways;

70) the logbook - the official document in which information on the runs performed by the inland navigation vessel, floating equipment, and also the crew members and persons which are onboard is entered;

71) the ship course (waterway) - the pass, safe for navigation, by inland waterway designated on the card, and if necessary - also navigation marks (aids to navigation) on the area;

72) ship drain waters (household drains) - the drains arriving from galleys, table, shower, wash basins, laundries and also fecal drains;

73) the shipowner - the subject of managing or the physical person operating the vessel on its own behalf irrespective of whether it is owner of the vessel or uses it on other legal causes;

74) the boatmaster - person who has the right of management of ship, the water bike;

75) the shipping hydraulic engineering construction - nagivation locks with local and riding approach channels, dams, guides and berthing facilities, foreport;

76) navigation canal of inland waterways - the hydraulic engineering construction, the artificial waterway for safe approach of courts in river ports (terminals) or for passage of the vessels;

77) shipping bridge span (shipping flight) - the bridge span intended for the omission of floating crafts;

78) shipping adjustable flight (adjustable flight) - bridge span with vertical climb, turn or disclosure of flying structure (all or its part) which is intended for the omission of floating crafts;

79) nagivation lock (lock) - the pressure head hydraulic engineering construction intended for movement of courts from one byef in another;

80) navigation - the activities connected with use of courts on waterways;

81) the territory of river port (terminal) - the parcels of land (their part) on lands of inland water transport, and also artificially created (washed, filled, created using other technologies) the parcels of land used by river port (terminal) and to other subjects of managing on legal causes for the parking and servicing of courts, landing, disembarkation and servicing of passengers, carrying out cargo operations, transport and expeditionary works, and also others, the types of economic activity connected with it;

82) the Ukrainian vessel - the vessel which floats under National Flag of Ukraine;

83) mooring buoy - the floating construction equipped on inland waterways outside the ship course, intended for providing the safe parking of the courts moored to it including during execution of cargo and other operations;

84) the high-speed vessel - the motor ship which can move with speed of 40 and more kilometers per hour concerning water surface;

85) vessel width - the maximum hull beam of the vessel measured to external edges of outside skin of the case (except for paddle wheels, rubbing bands and so forth);

86) traveling works - promerochny, dredging works, operational dredging (corrective works, trawlings, works on clearing of bottom), raising of the sunk property, prospecting works which are carried out on inland waterways for the purpose of maintenance of the guaranteed dimensions of the ship course of navigation canal, inland waterways for the purpose of navigation safety control, and also work on installation, servicing and money withdrawal of the aid to navigation on inland waterways;

87) pusher - the vessel which is specially equipped for ensuring movement of other vessel, structure of courts which are pushed;

88) anchoring berth - the hydraulic engineering construction equipped on inland waterways outside the ship course and intended for the parking of courts on anchor.

Article 2. Law coverage

1. This Law governs the relations in the field of inland water transport, uses of courts, inland waterways and their shores for navigation, determines legal regime of river ports and terminals, infrastructure facilities of inland water transport.

Regulates the relations connected with small, sports ships, water bikes and means for entertainments on water, this Law regarding the organization of their safe use on waterways public.

2. Operation of this Law does not extend to the stationing sites and vessels which are part of the Armed Forces of Ukraine and others, the military forming and law enforcement agencies of special purpose formed according to the laws of Ukraine, seaports, maritime terminals and navigation canals, and also bases for the parking of sports courts except the cases which are directly provided by this Law.

Article 3. Legislation on inland water transport

1. The relations in the field of inland water transport are governed by this Law, the Merchant Marine Code of Ukraine, the Water code of Ukraine, the Civil code of Ukraine, the Economic code of Ukraine, the Law of Ukraine "About transport", the Law of Ukraine "About transportation of dangerous goods", the Law of Ukraine "About personal data protection" and other acts of the legislation.

2. If the international treaty of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine establishes other rules, than those which are provided in this Law are applied rules of the international treaty of Ukraine.

The Section II State regulation in the field of inland water transport

Article 4. Main routes of state policy in the field of inland water transport

1. State regulation in the field of inland water transport is performed for the purpose of realization of single state economic, investment, scientific and technical and social policy in the following directions:

1) investment attraction and ensuring their protection;

2) integration of national transport system in European and world transport networks, development multimodal (combined), including international, transportations with participation of inland water transport;

3) ensuring development of inland water transport and inland waterways of Ukraine for adjustment of the strengthened economic and trade relations which will provide gradual integration of Ukraine in the domestic market of the European Union;

4) adaptation legislative and regulatory legal acts of acquis of the EU;

5) assistance to development on the competitive beginnings of the market of services in the field of inland water transport;

6) implementation of the state supervision and control of observance of requirements of the legislation in the field of inland water transport;

7) normative legal support of activities of inland water transport;

8) management of state-owned property;

9) implementation of state registration of courts;

10) creation and development of infrastructure of inland water transport;

11) organization, carriages of goods, passengers and baggage inland water transport;

12) ensuring consumer protection of the services provided on inland water transport;

13) organization of international cooperation;

14) ensuring compliance with the legislation on protection of the surrounding environment for preserving ecosystem, requirements satisfaction of the population, the industry, agricultural industry.

Article 5. Subjects of state regulation in the field of inland water transport and their power

1. State regulation in the field of inland water transport is performed by the Cabinet of Ministers of Ukraine, the central executive body which provides forming of state policy in the field of inland water transport, the central executive body which realizes state policy in the field of inland water transport, the national commission performing state regulation in the field of transport, the public specialized expert institution on technical investigation of incidents on transport, National police of Ukraine, local public administrations, other executive bodies within the powers.

2. The Cabinet of Ministers of Ukraine in the field of inland water transport:

1) is approved by the list of the internal seawaters and inland waterways referred to category of shipping;

2) approves the Strategy of development for inland water transport of Ukraine;

3) is approved by procedure for maintaining the Register of infrastructure facilities of inland water transport;

4) performs other powers provided by this Law.

3. The central executive body which provides forming of state policy in the field of inland water transport:

1) monitoring of international law in the field of inland water transport will organize, uses of inland waterways, provides project development of acts of the legislation in pursuance of international treaties of Ukraine, participates in work of the international organizations in the respective spheres;

2) develops in connection therewith the Law the Strategy of development for inland water transport of Ukraine;

Develops 3) and approves rules of carriage of goods, passengers and baggage by inland water transport, procedure for application for near coastal voyages of international treaties of Ukraine on transportation of dangerous goods in international flights, rules of navigation on inland waterways, classification sea and inland waterways, standard form of local rules of swimming for small, sports ships and water bikes and use of means for entertainments on water, rules of the omission of courts through locks, rules of control of inland navigation vessels, technical requirements to inland navigation vessels, operational regulations of hydraulic engineering constructions of inland waterways, procedure of technical advice behind hydraulic engineering constructions of inland waterways, rules of safe operation of bases for the parking of small ships, procedure for investigation and accounting of the emergency incidents connected with navigation regulations on assignment and confirmation of qualification of members of inland-water crews of vessel, procedure for preparation and confirmation of qualification of boatmasters of small ships and water bikes, procedure for issue of the international certificate on the right of control of the pleasure craft, procedure of technical advice behind courts, fire safety regulations in courts, rules of registration of transactions with hazardous substances in courts, in sea and river ports and terminals, order of registration of courts in the Ship book of Ukraine, order of registration of courts in the State ship register of Ukraine, and also other documents in the field of inland water transport, procedure for determination of sites of inland waterways with special risks;

4) determines the organizations performing preparation and skill test of persons for establishment of compliance of subjects to requirements of this Law;

5) performs the powers determined by the legislation concerning management of infrastructure facilities of inland water transport of the state pattern of ownership;

6) provides the organization of effective and safe use of inland waterways and strategic infrastructure facilities of inland water transport for navigation;

7) provides the organization of carrying out traveling works, control and maintenance of dimensions of the ship course, navigation canals and inland waterways;

8) will organize navigation and hydrographic ensuring navigation on inland waterways;

9) will be organized by ensuring functioning of river information service and information system of the automated accounting of transportations by inland waterways;

10) participates in the organization of providing the omission of courts via shipping hydraulic engineering constructions;

11) performs other powers provided by this Law.

4. The central executive body which realizes state policy in the field of inland water transport:

1) participates in development of the Strategy of development for inland water transport of Ukraine, provides collection and information analysis about functioning of inland water transport, its interrelation with other components of transportation network of Ukraine and the European Union, prepares necessary forecast documents;

2) participates in work of the international organizations which activities are connected with inland water transport, navigation on inland waterways, provides accomplishment of the obligations following from membership in such international organizations;

3) provides relations with foreign state bodies and the organizations in spheres of inland water transport, navigation on inland waterways;

4) exercises the state supervision of condition of inland waterways and strategic infrastructure facilities of inland water transport, implementation of navigation and hydrographic ensuring navigation, roadwork and pilotage duty of courts on inland waterways, functioning of river information service and information system of the automated accounting of transportations by inland waterways;

5) exercises the state supervision of safety of navigation on inland waterways, behind observance by river ports (terminals), other subjects of inland water transport of requirements for safety of navigation;

6) exercises the state supervision of observance in courts, including foreign, being on inland waterways, safety requirements of navigation and pollution prevention of the environment;

7) performs check of courts, verification of ship's papers and qualification documents of ship crew;

8) prohibits swimming or operation of the vessel in the cases established by this Law;

9) is provided by accounting of emergency incidents with courts;

10) is competent authority concerning control of observance of technical requirements to inland navigation vessels, interacts with the relevant competent authorities of other states;

11) performs registration of courts in the State ship register of Ukraine and the Ship book of Ukraine with issue of the relevant documents;

12) placement of floating constructions on waterways public approves local rules of swimming for small, sports ships and water bikes and use of means for entertainments on water;

13) carries out skill test of boatmasters of small ships and water bikes, issues the international certificates on the right of control of the pleasure craft;

14) is provided by functioning of single electronic recording system and accounting of small, sports ships and water bikes, the international certificates on the right of control of the pleasure craft, bases for the parking of small ships;

15) is provided by maintaining the Register of infrastructure facilities of inland water transport;

16) exercises the state supervision of condition of observance of local rules of swimming for small, sports ships and water bikes and use of means for entertainments on water on waterways public;

17) participates in providing the organization of effective and safe use of inland waterways and strategic infrastructure facilities of inland water transport for navigation;

18) exercises supervision of ensuring LOC ARM of mitigation of consequences of the accidents and organization of events directed to prevention of the emergency events connected with navigation or functioning of strategic infrastructure facilities of inland water transport;

19) performs other powers determined by the law.

5. The national commission performing state regulation in the field of transport:

1) establishes rates for the specialized services provided on inland waterways by subjects of natural monopolies;

2) establishes the sizes of pilotage service on inland waterways;

3) performs other powers determined by the law.

6. National police of Ukraine:

1) is controlled by accomplishment of local rules of swimming for small, sports ships and water bikes and use of means for entertainments on water;

2) performs ship's papers, the international certificates on the right of control of the pleasure craft and certificates of the boatmaster of small ship or the water bike, and also documents granting the right of control of the pleasure craft, small ship, the water bike issued before entry into force of this Law stops such vessels for implementation of such check.

7. Local public administrations perform regulation of activities of inland water transport in connection therewith the Law and other legal acts, in particular:

1) is established by rates for socially important regular public conveyances in courts;

2) are developed and in coordination with the central executive body realizing state policy in the field of inland water transport approve local rules of swimming for small, sports ships and water bikes and use of means for entertainments on water, placement of floating constructions;

3) approve holding sporting and other mass events on water;

4) according to the procedure which affirms the central executive body providing forming of state policy in the field of sea and inland water transport:
