About approval of rules of conducting sanitary and epidemiologic examination

According to the subitem 10) article 9 of the Code of the Republic of Kazakhstan of July 7, 2020 "About health of the people and health care system", PRIKAZYVAYU:

1. Approve the enclosed rules of conducting sanitary and epidemiologic examination.

2. Declare invalid:

1) the order of the Minister of national economy of the Republic of Kazakhstan of February 27, 2015 No. 150 "About approval of Rules of conducting sanitary and epidemiologic examination" (it is registered in the Register of state registration of regulatory legal acts at No. 10970, it is published on June 5, 2015 in information system of law of Ad_let);

2) the order of the acting minister of health care of the Republic of Kazakhstan of May 5, 2017 No. 251 "About introduction of amendments to the order of the Minister of national economy of the Republic of Kazakhstan of February 27, 2015 No. 150 "About approval of Rules of conducting sanitary and epidemiologic examination" (it is registered in the Register of state registration of regulatory legal acts at No. 15276, it is published on July 11, 2017 Reference control bank of regulatory legal acts of the Republic of Kazakhstan).

3. To committee of sanitary and epidemiologic control of the Ministry of Health of the Republic of Kazakhstan, in the procedure established by the legislation of the Republic of Kazakhstan to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of conducting sanitary and epidemiologic examination

Chapter 1. General provisions

1. These rules of conducting sanitary and epidemiologic examination (further – Rules) are developed according to the subitem 10) of article 9 of the Code of the Republic of Kazakhstan of July 7, 2020 "About health of the people and health care system" (further – the Code) and determine procedure for conducting sanitary and epidemiologic examination.

2. The terms and determinations used in these rules:

1) the official – the official of sanitary and epidemiologic service authorized according to the Code to exercise the state sanitary and epidemiologic control and supervision and exercising sanitary and quarantine control at automobile check points through customs border of the Eurasian Economic Union:

The chief state health officer of the Republic of Kazakhstan and his deputies, the chief state health officers in the corresponding territories and transport, their deputies;

heads, their deputies and specialists of state body in the sphere of sanitary and epidemiologic wellbeing of the population;

heads, their deputies and specialists of territorial subdivisions of state body in the sphere of sanitary and epidemiologic wellbeing of the population in the corresponding territories and transport;

heads and specialists of structural divisions of the Ministry of Defence of the Republic of Kazakhstan, the bodies of homeland security and internal affairs performing activities in the sphere of sanitary and epidemiologic wellbeing of the population;

2) the contractor – state bodies and the organizations of sanitary and epidemiologic service, the experts certified according to the procedure, established by the legislation of the Republic of Kazakhstan on architectural, town-planning and construction activities, performing sanitary and epidemiologic examination;

3) the customer – the physical persons and legal entities providing the order for conducting sanitary and epidemiologic examination;

4) state body in the sphere of sanitary and epidemiologic wellbeing of the population – the state body realizing state policy in the sphere of sanitary and epidemiologic wellbeing of the population, control and supervision of observance of the requirements established by regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population and other legal acts of the Republic of Kazakhstan.

3. Sanitary and epidemiologic expertize is carried out by state bodies and the organizations of sanitary and epidemiologic service within competence under resolutions or instructions of officials of sanitary and epidemiologic service, customs authorities and statements of physical persons or legal entities, except for sanitary and epidemiologic examination of projects.

Sanitary and epidemiologic expertize is carried out for determination of possibility of carrying out utilization of food products expired, being stored in the state material reserve.

4. For conducting sanitary and epidemiologic examination of projects as a part of complex non-departmental examination, stipulated in Item 3 articles 46 of the Code the customer sends to the contractor documents according to the list determined by rules of rendering the state services in the sphere of sanitary and epidemiologic wellbeing of the population.

For conducting sanitary and epidemiologic examination of objects, projects in the state bodies and the organizations of sanitary and epidemiologic service which are not provided in Item 3 of article 46 of the Code the customer sends to the contractor the following documents:

1) the statement in form according to appendices 1 and 2 to Rules;

2) projects and the regulating documentation on maximum permissible emissions and maximum permissible dumpings of hazardous substances and physical factors into the environment, to zones of sanitary protection and sanitary protection to zones, on raw materials and products.
