This Federal Law according to the Constitution of the Russian Federation establishes the legal basis of functioning of the federal territory Sirius, including governs the relations arising in connection with its creation, the organization of activities of bodies of the public power and also with implementation of economic and other activity in borders of the specified territory.
1. The federal territory Sirius is recognized the public legal entity having nation-wide strategic importance in which according to this Federal Law for the purpose of ensuring complex sustainable social and economic and innovative development of the territory, increase in its investment appeal, need of preserving the Olympic sports, cultural and natural heritage, creating favorable conditions for detection, self-realization and development of talents, realization of priorities of scientific technology development of the Russian Federation is established features of the organization of the public power and implementation of economic and other activity.
2. Local self-government in the federal territory Sirius is performed by the citizens living in its territory directly in forms, stipulated by the legislation the Russian Federation, and also through the bodies of the public power of the federal territory Sirius performing including the powers of local government bodies of the city district (including according to the solution of questions of local value of the city district) determined by the Federal Law of October 6, 2003 No. 131-FZ "About the general principles of the organization of local self-government in the Russian Federation", other Federal Laws if such powers are not delegated for implementation to local government bodies of the municipality the city district the resort town of Sochi of Krasnodar Krai according to article 8 of this Federal Law.
3. In the federal territory Sirius is created system of the bodies of the public power of the federal territory Sirius allocated with competence according to this Federal Law.
1. The legal basis of creation and functioning of the federal territory Sirius is constituted:
1) Constitution of the Russian Federation;
2) conventional principles and rules of international law and international agreements of the Russian Federation;
3) Federal constitutional Laws;
4) this Federal Law and other Federal Laws;
5) regulatory legal acts of the President of the Russian Federation and regulatory legal acts of the Government of the Russian Federation;
6) acts of federal executive bodies and other federal state bodies;
7) Charter of the federal territory Sirius;
8) regulatory legal acts of bodies of the public power of the federal territory Sirius.
2. Concerning ensuring functioning of the federal territory Sirius, and also concerning implementation of innovative and scientific and technological activities within borders of the federal territory Sirius bodies of the public power of the federal territory Sirius have the right to introduce to the President of the Russian Federation, in the Government of the Russian Federation offers on project development of the Federal Laws and other regulatory legal acts of the Russian Federation.
1. The Federal Laws, other regulatory legal acts of the Russian Federation are effective in the federal territory Sirius taking into account the features established by this Federal Law.
2. The laws and other regulatory legal acts of Krasnodar Krai are effective in the federal territory Sirius only in the sphere of powers of public authorities of the subjects of the Russian Federation performed in the federal territory Sirius by public authorities of Krasnodar Krai taking into account the features established by this Federal Law.
3. If separate powers of public authorities of Krasnodar Krai are delegated according to the procedure, established by this Federal Law, for implementation to bodies of the public power of the federal territory Sirius, the legal acts adopted by public authorities of Krasnodar Krai are effective taking into account the features established by this Federal Law and regulatory legal acts of bodies of the public power of the federal territory Sirius.
4. The administrative responsibility established by the laws of Krasnodar Krai for violation of the laws and other regulatory legal acts of Krasnodar Krai, regulatory legal acts of local government bodies is applied for making of the corresponding act in the federal territory Sirius if in the federal territory Sirius according to this Article regulatory legal acts of Krasnodar Krai are applied.
5. Municipal legal acts of the municipality the city district the resort town of Sochi of Krasnodar Krai are effective in the federal territory Sirius in case of transfer to the specified municipality according to this Federal Law of powers of bodies of the public power of the federal territory Sirius.
6. Information on application specified in parts 2 - the 5th this Article of regulatory legal acts of Krasnodar Krai and municipal legal acts of the municipality the city district the resort town of Sochi of Krasnodar Krai is placed in online media for official publication (promulgation) of legal acts of bodies of the public power of the federal territory Sirius, other official information.
7. Concerning the powers performed according to this Federal Law in the federal territory Sirius public authorities of Krasnodar Krai, bodies of the public power of the federal territory Sirius have the right to send to the management official of Krasnodar Krai of the offer on acceptance of the corresponding regulatory legal acts.
1. Bodies of the public power of the federal territory Sirius in pursuance of the Constitution of the Russian Federation, the Federal constitutional Laws, this Federal Law, other Federal Laws, regulatory legal acts of the President of the Russian Federation and regulatory legal acts of the Government of the Russian Federation publish obligatory for execution in the specified territory regulatory legal acts.
2. The regulatory legal act determining questions of the organization and functioning of the federal territory Sirius is the Charter of the federal territory Sirius approved by Council of the federal territory Sirius according to this Federal Law.
3. The charter of the federal territory Sirius, and also changes in it before approval of the federal territory by Council Sirius are subject to coordination by the Government of the Russian Federation.
4. Sirius are established by the charter of the federal territory:
1) types, procedure for preparation, acceptance (edition), registration, official publication (promulgation) and entry into force of regulatory legal acts of bodies of the public power of the federal territory Sirius;
2) official symbols of the federal territory Sirius and procedure for their use;
3) the questions of the organization of activities of bodies of the public power of the federal territory Sirius which are not settled by this Federal Law;
4) procedure for introduction of amendments to the Charter of the federal territory Sirius;
5) other questions which are subject to reflection in the Charter of the federal territory Sirius according to this Federal Law, the Federal Law of October 6, 2003 No. 131-FZ "About the general principles of the organization of local self-government in the Russian Federation" taking into account the features established by this Federal Law.
5. Other regulatory legal acts of bodies of the public power of the federal territory Sirius are published in the form of decisions of Council of the federal territory Sirius and resolutions of the head of administration of the federal territory Sirius.
6. The state accounting of regulatory legal acts of bodies of the public power of the federal territory Sirius is performed by the federal executive body authorized by the Government of the Russian Federation.
7. For official publication (promulgation) of regulatory legal acts of bodies of the public power of the federal territory Sirius, other official information printing mass media and online media are established.
8. According to the Charter of the federal territory Sirius bodies of the public power of the federal territory Sirius for operational and other current issues, including questions of implementation of economic and other activity in the federal territory Sirius, can publish the legal acts which do not have normative nature.
Borders of the federal territory Sirius are established according to appendices 1 and 2 to this Federal Law.
1. Change of the borders of the federal territory Sirius established by this Federal Law is performed by introduction of amendments to this Federal Law.
2. In case of creation of the artificial parcels of land in the internal sea waters of the Russian Federation adjoining the federal territory Sirius and in the territorial sea of the Russian Federation such parcels of land are included the territories of the federal territory Sirius.
1. Bodies of the public power of the federal territory Sirius perform:
1) separate powers of the Russian Federation on areas of jurisdiction of the Russian Federation and joint maintaining the Russian Federation and the subjects of the Russian Federation transferred for implementation to bodies of the public power of the federal territory Sirius according to the Federal Laws, presidential decrees of the Russian Federation, and also orders of the Government of the Russian Federation in coordination with Administration of the President of the Russian Federation;
2) the separate powers of the Russian Federation delegated for implementation to public authorities of subjects of the Russian Federation by the Federal Laws in cases if according to the specified Federal Laws and the laws of Krasnodar Krai such powers are delegated to local government bodies or it is directly provided in them that such powers are performed by bodies of the public power of the federal territory Sirius;
3) powers of public authorities of the subject of the Russian Federation in objects of joint maintaining the Russian Federation and subjects of the Russian Federation according to the Federal Laws and other regulatory legal acts, except for the powers specified in Items 1, of 2, of 5, of 6, of 7, of 10, of 11, of 26, of 45, of 54, of 65, of 67, of 69, of 70, of 72, of 87, of 88, of 89, of 91, of 92, of 93, of 94, of 95, of 98, of 103, of 109, of 110, of 122, of 128, of 133, of 137, of 141, of 143, of 144, of 161, of 168, 170 parts 1 of article 44 of the Federal Law of December 21, 2021 to No. 414-FZ "About the general principles of the organization of the public power in subjects of the Russian Federation" in part 1, Items 1, 4, 6, 7, 9 and 10 parts 2 of article 5.1 of the Federal Law of March 6, 2006 No. 35-FZ "About counteraction to terrorism";
4) the separate powers of Krasnodar Krai delegated for implementation to bodies of the public power of the federal territory Sirius by regulatory legal acts of Krasnodar Krai;
5) the powers of local government bodies of the city district (including according to the solution of questions of local value of the city district) determined by the Federal Law of October 6, 2003 No. 131-FZ "About the general principles of the organization of local self-government in the Russian Federation", other Federal Laws;
6) powers in the sphere of the organization and ensuring activities of bodies of the public power of the federal territory Sirius and the organizations and organizations subordinated to them.
2. The powers provided by part of 1 this Article are performed by bodies of the public power of the federal territory Sirius by budget funds of the federal territory Sirius, and also subventions from budgets of the budget system of the Russian Federation on realization of the delegated powers conferred according to the budget legislation of the Russian Federation.
3. The government of the Russian Federation has the right to transfer to the federal territory Sirius federal property, and also to transfer functions and the powers of the founder of federal state institutions necessary for implementation of delegated powers.
4. The bases and procedure for cancellation of acts of the bodies of the public power of the federal territory Sirius adopted concerning implementation of delegated powers of the Russian Federation are established by the Government of the Russian Federation.
5. Bodies of the public power of the federal territory Sirius have the right:
1) to participate in implementation of powers of the Russian Federation on areas of jurisdiction of the Russian Federation, and also in objects of joint maintaining according to the procedure and on conditions which are stipulated in Clause 48 Federal Laws of December 21, 2021 No. 414-FZ "About the general principles of the organization of the public power in subjects of the Russian Federation" for participation of public authorities of subjects of the Russian Federation in implementation of the powers which are not delegated to them on areas of jurisdiction of the Russian Federation, and also powers in objects of joint maintaining;
2) to exercise the rights of local government bodies of the city district established by the Federal Laws;
3) to establish features of regulation of the separate relations in the federal territory Sirius, to introduce experimental legal regime in the federal territory Sirius in the cases established by the Federal Laws and presidential decrees of the Russian Federation, orders of the Government of the Russian Federation accepted according to them and to apply the regulatory legal acts establishing the corresponding features.
