About additional measures for attraction of private sector to the spheres regulated by the state

In the country the measures directed to reducing the state participation in economy, forming of effective competitive environment and creation of more favorable conditions for entrepreneurs are consistently performed.

At the same time still found cases of excessive state regulation of separate industries negatively influence the level of participation of private sector in realization of the state functions.

In particular, lack of the system promoting studying of possibility of transfer to private sector of the state functions and creation of the corresponding conditions in this direction results in lack of attention of state bodies to the matters.

For the purpose of further development of the competition in market conditions, creations of additional opportunities for development of the new directions of entrepreneurship, increase in business activity of citizens, further enhancement of system of rendering services to the population, and also according to the Strategy of actions in five priority directions of development of the Republic of Uzbekistan in 2017 - 2021:

1. Agree with the offer of the Ministry of Justice, Ministry of Economic Development and reducing poverty, the Ministry of Finance, Antimonopoly Committee and Chamber of Commerce and Industry on project implementation "The state functions - opportunity for business", providing:

the initial directions for attraction of private sector to the sphere of public administration according to appendix No. 1;

step-by-step transfer to private sector of the state functions by outsourcing, crowdsourcing, the state social order, accreditation, certification and other methods, and also expansion of the available opportunities in the field of public administration;

realization of the state functions by also state bodies and organizations before creation in the corresponding territories of enough subjects of private sector in spheres in which the state functions are transferred to private sector;

start of electronic platform for publication and discussion of the state functions recommended for transfer to private sector and also relevant proposals of private sector;

forming of the unified register of the state functions directed to implementation of mechanisms of the analysis of the state functions which can be transferred to private sector by the ministries and departments.

2. In the field of accomplishment of cadastral works:

a) take into account that No. PP-4270 "About measures for further enhancement of system of state registration of the rights to real estate" since January 1, 2020 in the Tashkent region and the city of Tashkent, according to the procedure of experiment, is implemented by the resolution of the President of the Republic of Uzbekistan of April 5, 2019 institute of the cadastral engineer on the real estate;

b) determine that this experiment made in the Tashkent region and the city of Tashkent is effective till December 31, 2022, within which:

since April 1, 2021 the cadastral real estate engineers having the competence certificate issued by the Agency according to the inventory are granted the right including to preparation of primary cadastral case to real estate units;

service prices on preparation of cadastral case on real estate units, including primary cadastral case, are established by subjects of entrepreneurship independently in the amount of at least minimum rates, approved by the Cabinet of Ministers, and the arriving money remains at their order in full.

3. In the field of traffic safety, since March 1, 2021 to grant to subjects of entrepreneurship the right to the organization of installation on highways of the special automated program technical means of photo and video fixing of road traffic offenses. At the same time:

The Ministry of Internal Affairs and Committee on highways on the separate web page of the E-AUKSION system regularly publish data on dislocation of places of possible installation of the special automated program technical means of photo and video fixing, transport flow in this territory and types of the road traffic offenses revealed in the last two years;

fixing to subjects of entrepreneurship of installation sites of the special automated program technical means of photo and video fixing is performed by carrying out electronic biddings;

the minimal cost (the starting price) of installation sites of the special automated program technical means of photo and video fixing for exposure to electronic biddings is determined according to the procedure, established by the Ministry of Internal Affairs and the Ministry of Finance;

installation sites of the special automated program technical means of photo and video fixing are assigned to the subjects of entrepreneurship who won electronic biddings for unrestricted term and with right of disposal to other subject of entrepreneurship;

the subjects of entrepreneurship who won electronic biddings acquire the special automated program technical means of photo and video fixing on the basis of the specific criteria and specifications determined by the Ministry of Internal Affairs and also establish them in the fixed places according to the requirements and other necessary conditions determined by the Ministry of Internal Affairs and Committee on highways;

integration of the automated program technical means of photo and video fixing established special into the complex automated information system "Administrative Practice" of Public service of traffic safety is performed by the Ministry of Internal Affairs;

technical operation and ensuring smooth operation of the automated program technical means of photo and video fixing established special, including compensation of current costs on the electric power, are assigned to entrepreneurship subjects;

the amount of assignments from the penalties for road traffic offenses fixed by means of the corresponding special automated program technical means of photo and video fixing belonging to subjects of entrepreneurship is distributed according to the procedure, established by the Cabinet of Ministers.

4. In the field of issue of the national car driver license, since April 1, 2021 to provide to the subjects of entrepreneurship having the license for rendering non-state educational services in preparation, retraining and advanced training of drivers of automotor-vehicles and means of urban electric transportation, the right to carrying out theoretical and practice examinations to receipt of the car driver license to the right of management of all categories of automotor-vehicles (except for the tram and the trolleybus). At the same time:

for subjects of entrepreneurship are provided in the state requirements imposed to preparation, retraining and advanced training of drivers including additional obligations on creation of modern autodromes and their equipment by the automated special vehicles;

carrying out and assessment of theoretical and practice examinations on receipt of the car driver license are performed without participation of human factor, completely in the automated mode;

theoretical and practice examinations on receipt of the car driver license are carried out under direct or online control of the representative of Public service of traffic safety;

the amount of payments for services in carrying out theoretical and practice examinations on receipt of the car driver license is established by subjects of entrepreneurship independently, and the arriving money remains at their order in full;

to persons who successfully passed theoretical and practice examinations the special protected certificates which are the basis for receipt of the car driver license are issued;

all necessary details of the special protected certificates are provided by subjects of entrepreneurship in the centers of the state services and law-enforcement bodies in the automated mode.

5. In the field of ensuring safe movement of vehicles, since March 1, 2021 to grant to subjects of entrepreneurship the right to installation on highways of the stationary Items of weight and dimensional control equipped with the automated measuring means. At the same time:

installation sites of stationary Items of weight and dimensional control are assigned to the subjects of entrepreneurship who won electronic biddings for unrestricted term and with right of disposal to other subject of entrepreneurship;

the subjects of entrepreneurship who won on electronic biddings acquire stationary Items of weight and dimensional control according to specific criteria, specifications, requirements imposed to installation and other necessary conditions determined by Committee on highways and the Ministry of Internal Affairs and establish them in places of fixing;

integration of the established stationary Items of weight and dimensional control into the complex automated information system "Administrative Practice" of Public service of traffic safety is performed by the Ministry of Internal Affairs;
