According to the subitem 63) of part two of article 15 of the Law of the Republic of Kazakhstan "About National Bank of the Republic of Kazakhstan", subitems 1) and 3-4) Items 6 of article 20 of the Law of the Republic of Kazakhstan "About financial accounting and the financial reporting", the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" the Board of National Bank of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of submission of the reporting under accounting data by branches of nonresident banks of the Republic of Kazakhstan, branches of the insurance (reinsurance) nonresident organizations of the Republic of Kazakhstan, branches of insurance nonresident brokers of the Republic of Kazakhstan.

2. To provide to accounting department in the procedure established by the legislation of the Republic of Kazakhstan:

1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this resolution on official Internet resource of National Bank of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the actions provided by the subitem 2) of this Item and Item 3 of this resolution.

3. To department of information and communications - the press service of National Bank to provide within ten calendar days after state registration of this resolution the direction it to the copy on official publication in periodic printing editions.

4. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Baymagambetov A. M.

5. This resolution becomes effective since December 16, 2020 and is subject to official publication.

Rules of submission of the reporting under accounting data by branches of nonresident banks of the Republic of Kazakhstan, branches of the insurance (reinsurance) nonresident organizations of the Republic of Kazakhstan, branches of insurance nonresident brokers of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of submission of the reporting under accounting data by branches of banks - nonresidents of the Republic of Kazakhstan, by branches of the insurance (reinsurance) organizations - nonresidents of the Republic of Kazakhstan, branches of insurance brokers - nonresidents of the Republic of Kazakhstan (further – Rules) parts two of article 15 of the Law of the Republic of Kazakhstan "About National Bank of the Republic of Kazakhstan", subitem 3-4) of Item 6 of article 20 of the Law of the Republic of Kazakhstan "About financial accounting and the financial reporting" are developed according to the subitem 63), the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics and determine procedure for submission of the reporting under accounting data by branches of banks - nonresidents of the Republic of Kazakhstan, branches of the insurance (reinsurance) organizations - nonresidents of the Republic of Kazakhstan, branches of insurance brokers - nonresidents of the Republic of Kazakhstan (further – branches), including forms, list, frequency and terms of its representation.

2. In the reporting under accounting data the amount less than 500 (five hundred) tenges are rounded to 0 (zero), and the amount equal of 500 (five hundred) tenges and above, is rounded to 1000 (thousand) tenges.

3. The reporting under accounting data is submitted in electronic format.

4. The reporting under accounting data is on paper signed by the head of branch or person fulfilling its duties the chief accountant, the contractor and stored at branch. Upon the demand of authorized body on regulation, control and supervision of the financial market and the financial organizations the branch no later than 2 (two) working days from the date of receipt of request represents the reporting under accounting data on paper which does not contain corrections and erasures.

5. The reporting under accounting data provided in electronic format corresponds to the reporting under accounting data on paper. Identity of the data represented in electronic format, to data on paper is provided with the head of branch or person fulfilling its duties.

In annual accounts according to accounting data availability of 2 (two) or more comparatives period is on paper allowed.

6. In case of identification of mistakes in the Republic of Kazakhstan which is earlier provided to National Bank (further - National Bank) the branch provides to the reporting under accounting data error correction by implementation of the following events in the specified sequence:

1) corrects the found error by implementation of accounting entry and retrospective adjustment in the reporting under accounting data of that accounting period in which corrective accounting entry was performed;

2) is sent to National Bank by the written notice with indication of the description of the revealed mistake in earlier provided reporting under accounting data.

7. Branches represent to National Bank together with the monthly, quarterly and annual reporting under accounting data the explanatory note in electronic format in which disaggregation and disaggregation of accounts on Articles of the report on assets and liabilities "other assets" and "other obligations", and also according to income statement items and expenses "other incomes" and "other expenses" reveal.

Branches of nonresident banks of the Republic of Kazakhstan in addition represent disaggregation of the articles "interest incomes" and "interest expenses" of the income and expenditure statement and cash flow statement in the explanatory note.

8. Cash flow statements are constituted according to international accounting standards on direct method.

Chapter 2. Submission of annual accounts according to accounting data

9. Branches annually till April 30 (inclusive) the year following after accounting year represent to National Bank in electronic format the annual accounts according to accounting data constituted according to international accounting standards in the following forms:

1) the report on assets and liabilities on form according to appendix 1 to Rules;

2) the income and expenditure statement in form according to appendix 2 to Rules;

3) the cash flow statement in form according to appendix 3 to Rules.

In addition the branches of the insurance nonresident organizations of the Republic of Kazakhstan having the license in industry "life insurance" and performing the conclusion of the insurance contracts providing conditions of participation of the insurer in investments represent to National Bank annually till April 30 (inclusive) the year following after accounting year, the report on assets of investment fund (clients) on form according to appendix 4 to Rules and the income and expenditure statement on assets of investment fund (clients) in form according to appendix 5 to Rules.

Chapter 3. Representation of quarterly and monthly otchetnost according to accounting data

10. In National Bank the quarterly reporting under accounting data:

Branches of nonresident banks of the Republic of Kazakhstan represent 1) no later than 60 (sixty) calendar days following reporting quarter in the following forms:

the report on assets and liabilities on form according to appendix 1 to Rules;

the income and expenditure statement in form according to appendix 2 to Rules;
