About approval of the Procedure for provision of immediate compensation to subjects of managing, the Procedure for forming and maintaining the register of receivers of immediate compensation to subjects of managing and introduction of amendments to the resolution of the Cabinet of Ministers of Ukraine of April 22, 2020 No. 302

According to article 4 of the Law of Ukraine "About social support of insured persons and subjects of managing for implementation of the restrictive anti-epidemic actions entered for the purpose of prevention of distribution in the territory of Ukraine of sharp respiratory disease of COVID-19, of SARS-CoV-2 caused by coronavirus" the Cabinet of Ministers of Ukraine decides:

1. Approve such which are applied:

Procedure for provision of immediate compensation to subjects of managing;

Procedure for forming and maintaining register of receivers of immediate compensation to subjects of managing.

2. Bring in Item 2 of the Procedure for use of fund of fight against sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus and its consequences approved by the resolution of the Cabinet of Ministers of Ukraine of April 22, 2020 No. 302 (The Official Bulletin of Ukraine, 2020, No. 36, the Art. 1191, No. 43, the Art. 1394, No. 55, the Art. 1707), changes which are applied.

Procedure for provision of immediate compensation to subjects of managing

1. This Procedure determines procedure for granting of immediate compensation to subjects of managing for the purpose of expense recovery, suffered on payment of single fee on obligatory national social insurance (further - compensation), and information interaction of GNS, Treasury and Ministry of Economics in transfer process of compensation amounts by the subjects of managing confirmed to data from the register of receivers of immediate compensation (further - the register).

2. Compensation is provided to subjects of managing - legal entities (further - subjects of managing) who have as of October 31, 2020 main type of economic activity according to the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming treated the list of main types of economic activity concerning which the restrictive anti-epidemic actions connected with spread in the territory of Ukraine of sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus approved by the Cabinet of Ministers of Ukraine are performed. At the same time economic activity of such subjects of managing on the date of entry into force of the Law of Ukraine "About social support of insured persons and subjects of managing for implementation of the restrictive anti-epidemic actions entered for the purpose of prevention of distribution in the territory of Ukraine of sharp respiratory disease of COVID-19, of SARS-CoV-2 caused by coronavirus" (further - the Law) according to the specified Unified state register is not suspended.

3. For receipt of compensation the subject of managing till December 21, 2020 submits to territorial authority of GNS in the place of accounting as payer of single fee on obligatory national social insurance (further - single fee) the statement on receipt of immediate compensation by the subject of managing in form according to appendix to this Procedure (further - the statement). The application is submitted by means of electronic communication electronically in format (standard) approved in accordance with the established procedure with observance of requirements of the Laws of Ukraine "About electronic documents and electronic document management" and "About electronic confidential services" with indication of all obligatory details with use of means of the qualified digital signature.

Date of submission of the statement is the date fixed to receipts on receipt of the statement (the first receipt) which is created in the automatic mode (electronically) goes to the subject of managing during the operational day and is assurance of receipt of such statement.

Information on acceptance to consideration of the application is specified in the first receipt. If the submitted application does not meet the requirements of part two of article 18 of the Law of Ukraine "About electronic confidential services" and form according to appendix to this Procedure, are absent or obligatory details application forms are filled doubtfully in, in the first receipt it is reported about its rejection with indication of the reasons and it is offered to submit the new application.

The application is considered by territorial authority of GNS within three working days from the date of its obtaining. The current of three working days begins from the date of, the receipt of such statement following behind day. In case the last day of term of consideration of the application falls on output, festive or non-working day, the working day following for output, festive or non-working is considered last afternoon of term.

About results of consideration of the application of the subject of managing the receipt on entering of data of the statement into the register (the second receipt) which is created in the automatic mode (electronically) goes and is confirmation of entering of the statement into the register.

Receipts are sent to the e-mail address from which the statement arrived, and also are placed in electronic office.

If in the statement obligatory details are filled doubtfully in, these application forms do not correspond to data of the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming or in the statement there are no data on core activity according to requirements of part one of article 4 of the Law which implementation grants the right to compensation amount, in the second receipt is reported about rejection of the statement with indication of the reasons and it is offered to submit the new application.

After elimination of the revealed shortcomings the subject of managing can submit the new application, but no later than December 21, 2020.

The subject of managing which filed petition on receipt of compensation is considered approved the size of paid amount of single fee in ten months preceding month of entry into force of the Law by obtaining through electronic office of the statement confirming condition of its calculation for single fee on the first in which the Law became effective.
