About issue of allowing documents in the field of environmental protection for movement of separate types of goods through Frontier of the Republic of Belarus

Based on part seven of article 16 of the Law of the Republic of Belarus of November 12, 2001 No. 56-Z "About protection of ozone layer", and also for the purpose of implementation of the Convention on international trade in the types of wild fauna and flora which are under the threat of disappearance of March 3, 1973 (further, unless otherwise specified, - the Convention SITES) the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve:

Regulations on procedure and conditions of issue of the conclusions (allowing documents) for import to customs area of the Eurasian Economic Union and (or) export from customs area of the Eurasian Economic Union or import to the Republic of Belarus from the territory of state member of the Eurasian Economic Union and (or) export from the Republic of Belarus on the territory of state member of the Eurasian Economic Union of ozone-depleting substances and products containing them (are applied);

The regulations on procedure and conditions of issue of permissions to movement through Frontier of the Republic of Belarus of animal species and plants, their parts or derivative of them (derivatives) falling under operation of the Convention on international trade in the types of wild fauna and flora which are under the threat of disappearance of March 3, 1973 (are applied);

Regulations on procedure and conditions of issue, cancellation and cancellation of the conclusions (allowing documents) for import and (or) export of dangerous wastes (are applied).

2. Determine:

The Ministry of Natural Resources and Environmental Protection - administrative authority under the Convention SITES in the Republic of Belarus;

National academy of Sciences of Belarus - scientific body for the Convention SITES in the Republic of Belarus.

3. Make changes to the following resolutions of Council of Ministers of the Republic of Belarus:

3.1. No. 1397 "About some questions of procedure for movement of separate types of goods through Frontier of the Republic of Belarus" to exclude subitems 1.29 and 1.35 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of September 23, 2008;

3.2. No. 175 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 25.03.2022

4. Declare invalid the resolution of the Cabinet of Ministers of the Republic of Belarus of July 3, 1995 No. 350 "About measures for ensuring accomplishment by the Republic of Belarus of the obligations following from the Convention on international trade in the types of wild fauna and flora which are under the threat of disappearance".

5. This resolution becomes effective in the following procedure:

Item 1 paragraph two - in three months after official publication of this resolution;

other provisions of this resolution - after its official publication.

1. This Provision establishes procedure and conditions of issue by the Ministry of Natural Resources and Environmental Protection (further, unless otherwise specified, - Ministry for Protection of the Environment and Natural Resources) the conclusions (allowing documents) for import to customs area of the Eurasian Economic Union and (or) export from customs area of the Eurasian Economic Union or import to the Republic of Belarus from the territory of state member of the Eurasian Economic Union and (or) export from the Republic of Belarus on the territory of state member of the Eurasian Economic Union of ozone-depleting substances and products containing them (further, unless otherwise specified, - the conclusion (the allowing document), and also procedure and conditions of cancellation of these conclusions (allowing documents).

2. Action of this provision extends on legal entities and the individual entrepreneurs performing import to customs area of the Eurasian Economic Union and (or) export from customs area of the Eurasian Economic Union or import to the Republic of Belarus from the territory of state member of the Eurasian Economic Union and (or) export from the Republic of Belarus on the territory of state member of the Eurasian Economic Union of the ozone-depleting substances included in Section 1.1 of the inventory concerning which the prohibition of import to customs area of the Eurasian Economic Union and (or) export from customs area of the Eurasian Economic Union (appendix No. 1 to the Decision of Board of the Eurasian economic commission of April 21, 2015 No. 30 "About measures of non-tariff regulation"), and (or) Section 2.1 of the inventory is established concerning which the allowing procedure for import to customs area of the Eurasian Economic Union and (or) export from customs area of the Eurasian Economic Union is established (appendix No. 2 to the Decision of Board of the Eurasian economic commission of April 21, 2015 No. 30), and products containing them.

3. For receipt of the conclusion (the allowing document) the legal entity or the individual entrepreneur performing import to customs area of the Eurasian Economic Union and (or) export from customs area of the Eurasian Economic Union or import to the Republic of Belarus from the territory of state member of the Eurasian Economic Union and (or) export from the Republic of Belarus on the territory of state member of the Eurasian Economic Union of ozone-depleting substances and products containing them (further, unless otherwise specified, – the applicant), submit in Ministry for Protection of the Environment and Natural Resources the application on receipt of the conclusion (the allowing document) for import to customs area of the Eurasian Economic Union and (or) export from customs area of the Eurasian Economic Union or import to the Republic of Belarus from the territory of state member of the Eurasian Economic Union and (or) export from the Republic of Belarus on the territory of state member of the Eurasian Economic Union of ozone-depleting substances and products containing them in form according to appendix, and also the following documents:

the copy of the agreement (contract), and in case of lack of the agreement (contract) – the copy of other document confirming intentions of the parties;
