Regulations on licensing of activities for production and realization of the printed material protected from counterfeits

I. General provisions

1. This Provision determines procedure for licensing of activities of legal entities for production and realization of the printed material protected from counterfeits.

2. Licensing of activities for production and realization of the printed material protected from counterfeits (further - the licensed type of activity) is performed by the Federal Tax Service (further - the licensing body).

2(1). Authorized officers of the licensing body when implementing licensing carry out assessment of conformity of the license applicant (licensee) to licensed requirements, and also exercise federal state licensed control (supervision) of production and realization of the printed material protected from counterfeits (further - licensed control) concerning licensees.

3. In this Provision the following concepts are used:

"protective complex" - the set of elements of protection against counterfeit and protective technologies providing to the printed material protected from counterfeits the necessary level of security from counterfeits and also steady identification using different control methods;

"the printed material protected from counterfeits" - the printed material having 2 elements and more protection for which need of protection against counterfeits is established by regulatory legal acts of the Russian Federation, subjects of the Russian Federation, municipalities, or documentation on purchase of subject to purchase (about competitive purchase of subject of purchase), or the agreement (contract) for production and delivery of such products;

"production of the printed material protected from counterfeits" - the complete cycle of printing works on production of the printed material protected from counterfeits including development of the prototype, production of printing forms, seal and finishing of products with use of highly protected hard to reproduce production technologies, information on which is confidential, drawing numbering, and also accounting at all production phases and storages of the printed material protected from counterfeits, its semifinished products, scrap, printing forms, special paper, special paints, other objects of accounting bearing on themselves the elements of protection against counterfeit and (or) used for forming of protective complex;

"realization of the printed material protected from counterfeits" - sale of the printed material protected from counterfeits by the producer to the customer;

"the special computer program" - the program for electronic computers intended for creation of graphical elements of protection against counterfeit;

"security level" - the degree of security of the printed material protected from counterfeits provided with protective complex, established taking into account functional purpose, circulation period, conditions of application, damage level in case of falsification and attractiveness of counterfeit of these products;
