About questions of creation of non-commercial joint-stock company "Turar Healthcare"

The government of the Republic of Kazakhstan DECIDES:

1. Create non-commercial joint-stock company "Turar Healthcare" (further - society) with absolute participation of the state in the authorized capital.

2. Determine:

1) society the national operator in the field of health care;

2) powers of society on implementation of investment projects and projects of public-private partnership in the field of health care;

3) the main object of activity of society implementation of activities in the field of health care, including on development of infrastructure of health care.

3. Functions of the national operator in the field of health care to determine:

1) implementation of the activities directed to creation and functioning of clinics of the organizations of education in the field of health care;

2) implementation of activities for investment attraction and borrowings for the purposes of designing, construction, reconstruction, repair, content and servicing of health care facilities;

3) projects implementation in the field of health care, including investment projects and projects of public-private partnership;

4) implementation of coordination of project works of construction, reconstruction, repair, content and servicing of health care facilities, including on projects of public-private partnership and concession;

5) implementation of activities for approbation, implementation and implementation of transfer of innovative medical technologies in the medical organizations and the organizations of education in the field of health care of the Republic of Kazakhstan;

6) participation in performing preclinical (not clinical) and clinical trials of medicines and medical products;

7) implementation of activities for medical planning of health care facilities;

8) implementation of activities for planning and administration of providing with medical and not medical personnel for projectible and health care facilities under construction;

9) implementation of activities for development of preproject and project and estimate documentation of health care facilities, including using projects of repeated application;

10) implementation of activities for conducting designer's service on health care facilities;

11) implementation of activities for rendering engineering services in the field of architectural, town-planning and construction activities for health care facilities;

12) implementation of activities for advisory support of concessionary projects in the field of health care;

13) implementation of activities for advisory support of projects of public-private partnership in the field of health care;

14) implementation of activities for advisory support of investment projects in the field of health care.

4. To create the authorized capital of society for the transfer account in payment of shares of the republican property which is on balance of the Ministry of Health of the Republic of Kazakhstan according to appendix to this resolution.

5. To provide to committee of state-owned property and privatization of the Ministry of Finance of the Republic of Kazakhstan together with the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) approval of the charter of society;

2) election of person authorized on behalf of society on signing of documents for state registration, implementation of financial and economic activities and representation of its interests before the third parties before formation of bodies of society;

3) state registration of society in judicial authorities;

4) transfer to the Ministry of Health of the Republic of Kazakhstan of rights of possession and use of the state block of shares of society;

5) acceptance of other measures following from this resolution.

6. Approve the enclosed additions which are made to some decisions of the Government of the Republic of Kazakhstan.

7. This resolution becomes effective from the date of its signing.
