About approval of Rules of rendering the state service "Licensing for Import of Remedies of Plants (Pesticides)"

1. Approve the enclosed Rules of rendering the state service "Licensing for Import of Remedies of Plants (Pesticides)".

2. To provide to department of veterinary, phytosanitary and food safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of rendering the state service "Licensing for Import of Remedies of Plants (Pesticides)"

Chapter 1. General provisions

1. These rules of rendering the state service "Licensing for Import of Remedies of Plants (Pesticides)" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and determine procedure for rendering the state service "Licensing for Import of Remedies of Plants (Pesticides)" (further – the state service).

2. In these rules the following basic concepts are used:

1) remedies of plants - pesticides, bioagents, and also the technical and other means applied for the purpose of protection of plants;

2) pesticides - chemical and (or) biological medicines (insecticides, rodenticides, fungicides, herbicides, plant growth inhibitors and regulators of growth of plants, defoliants, desiccants) used for fight against harmful and especially dangerous harmful organisms, quarantine objects and alien types, wreckers of the stored agricultural products and also for protravlivaniye of seeds, preharvesting drying, removal of leaves and regulation of growth of plants;

3) the web portal of "the electronic government" (further - the portal) - the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

4) payment gateway of "the electronic government" (further - PShEP) - the information system automating processes of information transfer about carrying out payments within rendering the paid services rendered electronically;

5) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

3. Import of remedies of plants (pesticides) included in the inventory concerning which the allowing procedure for import to customs area of the Eurasian Economic Union and (or) export from customs area of the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of April 21, 2015 No. 30, is established is performed in the presence of the license which is drawn up according to the Instruction about execution of the statement on licensing for export and (or) import of separate types of goods and about execution of such license approved by the Decision of Board of the Eurasian economic commission of November 6, 2014 No. 199 (further - the Instruction).

Chapter 2. Procedure for rendering the state service

4. The state service appears Committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan (further - the service provider).

5. The list of the main requirements to rendering the state service "Licensing for Import of Remedies of Plants (Pesticides)" is specified in appendix 1 to these rules (further – the List).

6. For receipt of the license the physical person or legal entity (further – uslugopoluchatel) sends to the service provider by means of the portal the documents specified in Item 8 of the List.

Data on the identity document of physical person, on state registration (re-registration) of the legal entity, on registration of the individual entrepreneur, or on the beginning of activities as the individual entrepreneur, about availability of the license for production (formulyation) of pesticides, realization of pesticides, use of pesticides aerosol or fumigatsionny by methods, about registration in tax authority, about payment in the budget of the license fee for the occupation right by separate types of activity (in case of payment through PShEP), the service provider receives from the state information systems through lock of "the electronic government".

Reclamation from uslugopoluchatel of documents which can be received from information systems is not allowed.

Information exchange of the portal and information systems is performed according to article 43 of the Law of the Republic of Kazakhstan "About informatization".

7. Aggregate term of rendering the state service constitutes 5 (five) working days from the moment of document registration.
