RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

About implementation of the Presidential decree of the Republic of Belarus of June 23, 2020 No. 235

Based on Item 2 of the Presidential decree of the Republic of Belarus of June 23, 2020 "About additional terms of construction of apartment apartment houses" the Council of Ministers of the Republic of Belarus DECIDES: No. 235

1. Establish standard form of the contract for realization of the right of designing and construction of apartment apartment houses according to appendix.

2. Bring in the resolution of Council of Ministers of the Republic of Belarus of March 26, 2008 No. 462 "About some measures for implementation of the Presidential decree of the Republic of Belarus of December 27, 2007 No. 667" the following changes:

in Regulations on the procedure for the organization and holding auctions for sale of the parcels of land in private property approved by this resolution:

add Item 8 with part of the following content:

"In the decision on holding the auction selling the parcel of land in private property for construction and servicing of the apartment apartment house are specified obligation of the winner of auction (the single participant of cancelled auction) to sign the contract for realization of the right of designing and construction of apartment apartment houses and closing date of such contract with local executive committee.";

to add Item 13 part one after the paragraph of the tenth with the paragraph of the following content:

"data on obligation of the winner of auction (the single participant of cancelled auction) selling the parcel of land in private property for construction and servicing of the apartment apartment house to sign the contract for realization of the right of designing and construction of apartment apartment houses and closing date of such contract with local executive committee;";

in Regulations on the procedure for the organization and holding auctions on the right of the conclusion of lease agreements of the parcels of land approved by this resolution:

add Item 5 with part of the following content:

"In the decision on holding the auction for construction and servicing of the apartment apartment house are specified right to contract of lease of the parcel of land obligation of the winner of auction (the single participant of cancelled auction) to sign the contract for realization of the right of designing and construction of apartment apartment houses and closing date of such contract with local executive committee.";

to add Item 10 part one after the paragraph of the eleventh with the paragraph of the following content:

"data on obligation of the winner of auction (the single participant of cancelled auction) on right to contract of lease of the parcel of land for construction and servicing of the apartment apartment house to sign the contract for realization of the right of designing and construction of apartment apartment houses and closing date of such contract with local executive committee;";

Item 5 of the Regulations on procedure for the organization and holding auctions with conditions on the right of the designing and construction of capital structures (buildings, constructions) approved by this resolution to add with part of the following content:

"In the decision on holding the auction the obligation of the winner of auction (the single participant of cancelled auction) is specified to sign the contract for realization of the right of designing and construction of capital structures (buildings, constructions) with local executive committee.".

3. This resolution becomes effective since September 26, 2020.
