About the Commission on regulation of gamblings and lotteries

According to Item "About the Cabinet of Ministers of Ukraine" and parts seven of article 6 of the Law of Ukraine "About state regulation of activities for the organization and carrying out gamblings" the Cabinet of Ministers of Ukraine decides 6 parts one of article 20 of the Law of Ukraine:

1. Form the Commission on regulation of gamblings and lotteries.

2. Approve Regulations on the Commission on regulation of gamblings and lotteries which are applied.

3. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

4. Place the Commission on regulation of gamblings and lotteries on the address: Kiev, Lesya Ukrainka Blvd., 26.

5. This resolution becomes effective from the date of its publication, except requirements of the Regulations on the Commission on regulation of gamblings and lotteries regarding implementation of state regulation of activities in the lottery sphere and Item of 3 changes approved by this resolution which become effective from start date of work of the Commission of regulation of gamblings and lotteries according to the Law of Ukraine "About state regulation of activities for the organization and carrying out gamblings".

Regulations on the Commission on regulation of gamblings and lotteries

1. The commission on regulation of gamblings and lotteries (KRAIL) is the central executive body with the special status providing state regulation of activities in the field of the organization and carrying out gamblings and lotteries which activities go and coordinated by the Cabinet of Ministers of Ukraine.

2. KRAIL in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine accepted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

3. The main objectives of KRAIL are:

realization of state policy in the field of the organization and carrying out gamblings;

realization of state policy in the lottery sphere;

implementation of the state supervision (control) of the market of gamblings, and also in the lottery sphere.

4. KRAIL according to the tasks assigned to it:

1) implements state policy in the field of the organization and carrying out gamblings in the way:

entering into public authorities of offers concerning drafts of the laws and other regulatory legal acts in the field of gamblings;

editions of regulations on the questions which are within the competence KRAIL and control of their accomplishment;

acceptances within the competence of decisions which are obligatory for accomplishment by organizers of gamblings;

development and representation to the Cabinet of Ministers of Ukraine for approval of licensed conditions of implementation of economic activity in the field of the organization and carrying out gamblings;

appeals to the court in the cases determined by the law;

creations of favorable organizational and economic conditions for investment attraction to the sphere of the organization and carrying out gamblings;

ensuring creation of equal conditions of economic activity in the field of the organization and carrying out gamblings;

implementation of cooperation with relevant organs of regulation in the field of the organization and carrying out gamblings of foreign states;

accomplishment of function of body of licensing of economic activity in the field of the organization and carrying out gamblings, decision making about issue and the cancellation of licenses according to the procedure established by the Law of Ukraine "About state regulation of activities for the organization and carrying out gamblings" (further - the Law);

forming and maintaining the licensed register;

forming and conducting licensed cases, ensuring their storage, transfer and obtaining in paper and/or electronic form;

implementation of information and methodical maintenance of licensing;

provisions of information from licensed cases according to the procedure, established by the Law of Ukraine "About access to public information";

checks of reliability of data in the documents submitted by the applicant for receipt of licenses, permissions and compliance of the organizer of gamblings (job seeker) and the submitted documents to licensed conditions;

considerations, checks and introduction of information about physical persons concerning which there are restrictions in visit of gambling institutions and participation in gamblings, in the Register of persons which limits access to gambling institutions and/or participation in gamblings in the cases established by the Law;

approvals of the list, form and procedure for submission of the reporting by organizers of gamblings;

maintaining the registers provided by the Law;

approvals of procedure for maintaining registers in the field of the organization and carrying out gamblings, procedure for inclusion of information, modification of such registers, exceptions of data of registers;

considerations of claims of players and other persons to actions of organizers of gamblings, implementation, in case of identification of violations by results of their consideration, died according to the Law;

government relations, local government bodies, public associations and other organizations when implementing the powers;

maintaining the list of subjects of certification, and also determination of the list of the gambling equipment which is subject to certification;

determinations according to the Law of the Ukrainian and/or foreign laboratory which issues the certificate of conformity to the State system of online monitoring according to the Law;

establishments of procedure for transfer by organizers of gamblings of accumulated information in case of stop of functioning of the State system of online monitoring for technical or any other reasons;

establishments of procedure for conducting inspection of the gambling equipment;
