Regulations on procedure for consideration by the Government of the Russian Federation for addresses on determination of the single supplier (contractor, contractor)

1. This Provision establishes procedure for consideration by the Government of the Russian Federation for the addresses containing the offer on determination of the single supplier (the contractor, the contractor) (further respectively - the address, the single contractor).

2. This Provision does not extend to the following cases:

determination of the single contractor during the forming and approval of the state defensive order by the Government of the Russian Federation according to the Federal Law "About the State Defensive Order";

preparation of drafts of the legal acts of the Government of the Russian Federation directed to execution of the instructions of the President of the Russian Federation given before approval of the Procedure for preparation of drafts of legal acts and orders of the President of the Russian Federation, drafts of legal acts of the Government of the Russian Federation about determination of the single supplier (the contractor, the contractor) approved by the Presidential decree of the Russian Federation of September 14, 2020 No. 558 "About approval of the Procedure for preparation of drafts of legal acts and orders of the President of the Russian Federation, drafts of legal acts of the Government of the Russian Federation about determination of the single supplier (the contractor, the contractor)". By preparation of such drafts of acts are represented prepared according to article 22 of the Federal law "About Contractual System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" (further - the Federal Law) and the reasons for the price of the contract signed by the customer, and also information which is provided by subitems "a", - "l" of Item 3 this provision.

3. In the appeal sent to the Government of the Russian Federation are specified (contain):

a) the subject of the contract and the description of subject to purchase including functional, technical and quality characteristics, operational characteristics of subject to purchase (if necessary);

b) economic and (or) technological case of inexpediency of implementation of purchase with use of competitive methods of determination of suppliers (contractors, contractors), except as specified, stipulated in Item the 8th this provision;

c) financial and economic reasons for the offer on determination of the single contractor, except as specified, stipulated in Item 8th this provision;

d) name of the customer;

e) information on the expected single contractor, including its name, identification taxpayer number, reasons for the choice of such contractor;

e) reasons for expected term of implementation of purchase at the single contractor;

g) results performed by the customer of compliance of the expected single contractor to requirements of the Federal Law, including to requirements of article 31 of the Federal Law;

h) information on execution by the assumed single contractor of the contract obligations personally or with attraction to its execution of subcontractors, collaborators and reasons for need of their attraction, and also the requirement to amount of execution by this contractor of the obligations under such contract personally established in the form of percent from the price of the contract signed with it in case of attraction to its execution of subcontractors, collaborators;

i) information on establishment of the requirement to ensuring execution of the contract or reasons for inexpediency of establishment of such requirement;

j) information on purchase financing sources;

k) information on compliance of the expected single contractor to the criteria shown to the single contractors when implementing purchases of medicines for medical application and also information on compliance of medicines for medical application to the selection criteria of such medicines established by the Government of the Russian Federation for the purpose of realization of the Procedure for preparation of drafts of legal acts and orders of the President of the Russian Federation, drafts of legal acts of the Government of the Russian Federation about determination of the single supplier (the contractor, the contractor) approved by the Presidential decree of the Russian Federation of September 14, 2020 No. 558 "About approval of the Procedure for preparation of drafts of legal acts and orders of the President of the Russian Federation, drafts of legal acts of the Government of the Russian Federation about determination of the single supplier (the contractor, the contractor)".

4. The conclusions, stipulated in Item the 10th this provision, except as specified, provided by Items 11 and 12 of this provision are attached to the appeal sent to the Government of the Russian Federation.
