About approval of Rules of forming, check and use of electronic documents using service of digital documents

According to subitem 63-4) of article 7 of the Law of the Republic of Kazakhstan of November 24, 2015 "About informatization", PRIKAZYVAYU:

1. Approve the enclosed Rules of forming, check and use of electronic documents using service of digital documents.

2. To provide to committee of the state services of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming, check and use of electronic documents using service of digital documents

Chapter 1. General provisions

1. These rules of forming, check and use of electronic documents using service of digital documents (further - Rules) are developed according to subitem 63-4) of article 7 of the Law of the Republic of Kazakhstan of November 24, 2015 "About informatization" (further - the Law) and determine procedure for forming, check and use of electronic documents using service of digital documents.

2. The basic concepts used in these rules:

1) the one-time password - the password valid only for one session of authentication of subjects of receipt of services electronically;

2) the subject of personal data (further - the subject) - physical person to which personal data belong;

3) the third party - person which is not the subject, the owner and (or) the operator, but related circumstances or legal relationship on collection, processing and personal data protection;

4) the digital document - the electronic document created by service of digital documents necessary for receipt of the state services and other services electronically, and also in case of interaction with physical persons and legal entities;

5) service of digital documents - the object of information and communication infrastructure of "the electronic government" assigned to the operator and intended for creation, storage and use of electronic documents for the purpose of realization of the state functions and the state services following from them and also in case of interaction with physical persons and legal entities, obtaining and rendering services electronically;

6) the electronic document - the document in which information is provided in electronic and digital form and is certified by means of the electronic digital signature;

7) the electronic digital signature - set of electronic digital characters created by means of the electronic digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

8) mobile application of "the electronic government" (further - mobile application) - the software product installed and started on the subscriber structure of cellular communication and providing access to the state services and other services rendered electronically by means of cellular communication and the Internet;

9) QR code - type of matrix barcodes or two-dimensional bar codes.

Other concepts and terms used in these rules are applied according to the legislation of the Republic of Kazakhstan.

Chapter 2. Procedure for forming of digital documents using service of digital documents

3. Service of digital documents is part of mobile application of "the electronic government", access to which is provided by means of the Section "Digital Documents" of mobile application.

4. Digital documents are created in service of digital documents on the basis of data of information systems of the state bodies and the organizations received by integration.

5. Events for integration of information systems are held according to the order of the Acting Minister of information and communications of the Republic of Kazakhstan of March 29, 2018 No. 123 "About approval of Rules of integration of objects of informatization of "the electronic government" (it is registered in the Register of state registration of regulatory legal acts for No. 16777).

6. After realization of integration of mobile application with the corresponding system of state body or organization, the digital document will be available in the Section "Digital Documents" of mobile application.

7. Request for forming of digital documents in service of digital documents and receipt of results of processing of request are performed with use of the subscriber structure of cellular communication.

8. The digital documents created in service of digital documents are signed by the electronic digital signature of authorized state bodies and organizations.

Chapter 3. Procedure for test and uses of digital documents using service of digital documents

9. Access for the third parties to the digital documents created in service of digital documents is performed with the consent of the user.

10. Service of digital documents is available to the users authorized in mobile application.

11. The subject undergoes authorization in mobile application with use of the electronic digital signature (further - the EDS) or the one-time password, further passes into the Section "Digital Documents" and selects the necessary document.

12. Mobile application, by means of challenge of services of state bodies or the organization providing storage of electronic information resources obtains necessary data for generation of the document.

13. In case of successful result of check of data retrieved, in service of digital documents the required document is displayed.

14. When using the Open Access function, the protected QR code providing temporary or continuous access to the third parties to viewing of the document is generated.
