Rules of implementation of regional state supervision of technical condition and operation of self-propelled machines and other types of the equipment, attractions

1. These rules establish procedure of regional state supervision in the field of technical condition and operation of self-propelled machines and other types of the equipment, attractions (further - regional state supervision).

2. Subject of regional state supervision are:

a) assessment of observance by legal entities, their heads and other officials, individual entrepreneurs, their authorized representatives of mandatory requirements:

established by the Government of the Russian Federation, - to technical condition and operation of self-propelled machines and other types of the equipment;

established by the Government of the Russian Federation, - to technical condition and operation of attractions;

established by the technical regulation of the Eurasian Economic Union "About safety of attractions", the made decision of Council of the Eurasian economic commission of October 18, 2016 No. 114 "About the technical regulation of the Eurasian Economic Union "About safety of attractions", - to safety of attractions;

the single forms of the passport of the vehicle (passport of the vehicle chassis) established by the Agreement on introduction and the passport of the self-propelled machine and other types of the equipment and the organization of systems of electronic passports of August 15, 2014 and other acts constituting the right of the Eurasian Economic Union adopted according to the specified Agreement, and also the order of the Government of the Russian Federation of May 15, 1995 No. 460 "About introduction of passports of self-propelled machines and other types of the equipment in the Russian Federation" and approved according to the regulations on the passport of self-propelled machines and other types of the equipment specified by the resolution, - to procedure for issue and registration by the legal entities and individual entrepreneurs who are manufacturers of self-propelled machines and other types of the equipment, passports of self-propelled machines and other types of the equipment;

established by the Regulations on military transport obligation approved by the Presidential decree of the Russian Federation of October 2, 1998 No. 1175 "About approval of the Regulations on military transport obligation" - to mobilization readiness of the self-propelled machines and other types of the equipment provided to the Armed Forces of the Russian Federation, other troops, military forming and bodies, and also the special forming created on wartime regarding their availability and readiness for ensuring work;

b) assessment of observance by the physical persons who are not individual entrepreneurs, the requirements established by the Federal Law "About Obligatory Civil Liability Insurance of Owners of Vehicles" to civil responsibility insurance of owners of self-propelled machines and other types of the equipment according to the order of the Government of the Russian Federation of September 14, 2005 No. 567 "About exchange of information when implementing obligatory civil liability insurance of owners of vehicles".

3. Regulations of the Federal Law "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control" are applied to the relations connected with the organization and implementation of regional state supervision, the organization and conducting checks of legal entities and individual entrepreneurs.

4. Regional state supervision is exercised by executive bodies of subjects of the Russian Federation, authorized supreme executive bodies of the government of subjects of the Russian Federation on implementation of regional state supervision (further - bodies of Gostekhnadzor).

5. Bodies of Gostekhnadzor exercise regional state supervision using risk - the oriented approach.

6. The supreme executive body of the government of the subject of the Russian Federation taking into account requirements of these rules approves the procedure for the organization and implementation of regional state supervision in the territory of the subject of the Russian Federation including:

a) name of body of Gostekhnadzor;

b) list of officials of body of Gostekhnadzor and their power;

c) order of interaction of body of Gostekhnadzor with federal executive bodies and their territorial authorities, executive bodies of subjects of the Russian Federation, local government bodies, legal entities, individual entrepreneurs and other persons concerning the organization and implementation of regional state supervision;

d) procedure for registration and content of plan (raid) targets, procedure for registration of results of planned (raid) surveys, inspections of self-propelled machines and other types of the equipment, attractions in the course of their operation;

e) procedure for the organization and carrying out observation of observance of the mandatory requirements specified in Item 2 of these rules, information analysis on activities or actions of the legal entity and individual entrepreneur;

e) criteria and procedure for reference of activities of legal entities, individual entrepreneurs and (or) the self-propelled machines and other types of the equipment, attractions used by them to certain category of risk or certain class (category) of danger under the organization of regional state supervision;

g) list of categories of risk or classes (categories) of danger;

h) frequency of conducting planned inspections depending on category of risk.
