About licensing of television broadcasting and broadcasting

1. Approve the enclosed Regulations on licensing of television broadcasting and broadcasting.

2. This resolution becomes effective since January 1, 2021 and is effective till January 1, 2027.

Regulations on licensing of television broadcasting and broadcasting

1. This Provision establishes procedure for licensing of television broadcasting and broadcasting, performed by legal entities in the territory of the Russian Federation.

2. Licensing of television broadcasting and broadcasting is performed by Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications (further - the licensing body).

3. The licensed requirements imposed to the license applicant on television broadcasting and broadcasting (further - the license), are:

a) availability at the license applicant of the status of editorial office of the TV channel planned to distribution by the license applicant or the radio channel confirmed by the charter of the editorial office or data from the state information system in the field of mass media - in the case provided by part three of article 31 of the Law of the Russian Federation "About mass media";

b) availability at the license applicant of the agreement with the editorial office of the TV channel planned to distribution by the license applicant or radio channel - in the case provided by part four of article 31 of the Law of the Russian Federation "About mass media";

c) observance by the license applicant of restrictions, the stipulated in Article 19.1 Laws of the Russian Federation "About mass media", and also the requirements established by part two of article 54 of the Law of the Russian Federation "About mass media".

4. The licensed requirements imposed to the licensee are:

a) observance by the licensee of the following parameters of television broadcasting or the broadcasting provided by the register of licenses:

broadcasting of the TV channel provided by the license or radio channel;

broadcasting within the territory of distribution of TV channel or radio channel provided by the license;

observance of amounts of broadcasting, frequency and time of broadcasting;

observance of start date of broadcasting;

broadcasting of TV channel or radio channel in certain license to the circle of broadcasting - for speakers, not being the editorial office of the TV channel extended by the licensee or radio channel;

broadcasting on the allocated specific radio frequencies - in case of land on-air or satellite broadcasting;

broadcasting of TV channel or radio channel on the provided license of specific line item in multiplex - in case of land on-air digital broadcasting;

observance of parameters of satellite broadcasting - for satellite broadcasting;

observance of program orientation of TV channel or radio channel, and for the speakers performing broadcasting with use of limited radio-frequency resource which right to use is acquired by results of the biddings - observance of the program concept of broadcasting;

b) availability at the licensee of the status of editorial office of the TV channel extended by the licensee or the radio channel confirmed by the charter of the editorial office or data from the state information system in the field of mass media - in the case provided by part three of article 31 of the Law of the Russian Federation "About mass media";

c) availability at the licensee of the agreement with the editorial office of the TV channel extended by the licensee or radio channel - in the case provided by part four of article 31 of the Law of the Russian Federation "About mass media";

d) submission to the licensing body of information about the telecom operators performing broadcast of TV channel or radio channel per the agreement with the speaker of such TV channel or radio channel, and about persons extending TV channel or radio channel in invariable type under the agreement with the speaker of such TV channel or radio channel, in the terms specified in article 31.9 of the Law of the Russian Federation "About mass media", according to the procedure, established by Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications;

e) observance by the speaker published according to Item 8 of the Regulations on carrying out tender on receipt of the right to perform land on-air broadcasting, satellite broadcasting with use of specific radio frequencies, No. 25 approved by the order of the Government of the Russian Federation of January 26, 2012 "About allocation of specific radio frequencies for broadcasting with use of limited radio-frequency resource (land on-air broadcasting, satellite broadcasting), carrying out tender, collection of one-time payment for the right to perform land on-air broadcasting, satellite broadcasting with use of specific radio frequencies and recognition voided some acts of the Government of the Russian Federation", conditions of implementation of on-air broadcasting with use of the specific radio frequencies determined by results of the biddings (tender, auction) - in case of implementation of on-air broadcasting with use of the radio frequencies determined by results of the biddings (tender, auction);

e) observance of requirements about the announcement of output data of TV channel, radio channel, TV program and radio program as a part of respectively TV channel or radio channel, the stipulated in Clause 27 Laws of the Russian Federation "About mass media";

g) distribution by the editorial office of the TV channel extended by the licensee or radio channel of obligatory messages, the stipulated in Article 35 Laws of the Russian Federation "About mass media";

h) observance of restrictions, the stipulated in Article 19.1 Laws of the Russian Federation "About mass media";

i) distribution of the relevant national obligatory public TV channels and (or) radio channels in the territory of accommodation of the population of the Russian Federation - for licensees - speakers of the national obligatory public TV channels and (or) radio channels;
