About statistical declaration of goods

Based on part one of Item 1 of the Presidential decree of the Republic of Belarus of March 27, 2008 "About procedure for execution of agreements in foreign trade" the Council of Ministers of the Republic of Belarus DECIDES: No. 178

1. Determine that:

1.1. the statistical declaration * is submitted round the clock for registration in the Minsk central customs by the resident or according to its order the customs representative:

with use of the program and technical means providing interaction with information systems of customs authorities in case of exchange of electronic documents;

with observance of structure and format of the statistical declaration in the form of the electronic document, procedure for its filling determined by the State Customs Committee;

* For the purposes of this resolution the terms "foreign trade transaction", "agreement in foreign trade", "residents", "transaction" and "statistical declaration" are used in the values determined in appendix 1 to the Presidential decree of the Republic of Belarus of March 27, 2008 No. 178.

1.2. the statistical declaration is submitted no later than seven working days from the moment of goods receipt (for import statistical declarations) and no later than the 10th following for reporting (for export statistical declarations), on one and more facts of shipments (receipts) of goods which total cost constitutes the amount equivalent of 3000 euros and more, for reporting calendar month within:

the agreement in foreign trade providing paid transfer of goods;

transactions with the nonresident, except for the transaction which is not connected with movement of goods through Frontier of the Republic of Belarus.

If the 10th, following for reporting, or the expiration of the terms established in paragraph one of part one of this subitem falls on the day recognized according to the legislation in the day off and (or) non-working public holiday (in the non-working holiday), the next working day following it is considered day of the termination of term of submission of the statistical declaration.

Date is considered shipping date (receipt) of goods:

write-offs of goods in the financial accounting (acceptances of goods to financial accounting) according to the procedure established by accounting policy of the organization;

write-offs of goods in the accounting (acceptances of goods to accounting) according to the procedure established by the decision of the individual entrepreneur made in writing;

write-offs of goods in the accounting (acceptances of goods to accounting) according to the procedure established by the decision of the head of the organization which is applying simplified taxation system and not keeping financial accounting according to the legislation;

specified in shipping, business or other documents which draw up shipment (receipt) of goods if write-off of goods in financial accounting or accounting (acceptance of goods to financial accounting or accounting) is not made.

At the discretion of resident the statistical declaration can be provided concerning shipments (receipts) of goods which total cost constitutes the amount equivalent to less than 3000 euros;

1.3. the statistical declaration provided with observance of structure, format and procedure for its filling, including containing the reference to registration number of the currency agreement which is subject to registration according to the foreign exchange legislation is subject to registration by the Minsk central customs with use of the program and technical means providing interaction with information systems of customs authorities in case of exchange of electronic documents within two hours from the moment of its representation;

1.4. registration of the statistical declaration, modification of the registered statistical declaration, and also cancellation of the registered statistical declaration are performed according to the procedure, established by the State Customs Committee;

1.5. the form of external submission of the statistical declaration is determined by the State Customs Committee;

1.6. for representation to registration of the statistical declaration person representing it shall have available following documents from which data are used for filling of the statistical declaration:

in case of submission of the statistical declaration in the case specified in the paragraph the second Item 5 of appendix 1 to the Presidential decree of the Republic of Belarus of March 27, 2008 to No. 178, – the agreement in foreign trade and amendments (appendix) to it if data from the specified amendments (appendices) are used when filling of the represented statistical declaration;

in case of submission of the statistical declaration in case, the specified in paragraph three of Item 5 of appendix 1 to the Presidential decree of the Republic of Belarus of March 27, 2008 No. 178, – the document confirming the conclusion of the transaction;

shipping, business or other documents which draw up shipment (receipt) of goods;

the shipping document specified in part two of Item 10 of article 3 of the Protocol on some questions of import and the goods circulation on customs area of the Eurasian Economic Union of October 16, 2015 on the goods imported to the Republic of Belarus from the Republic of Kazakhstan included in the inventory to which the Republic of Kazakhstan according to obligations assumed as condition of accession to the World Trade Organization applies rates of import customs duties, lower in comparison with rates of duties of the Common customs tariff of the Eurasian Economic Union, and the sizes of such rates of duties, No. 59 approved by the Decision of Council of the Eurasian economic commission of October 14, 2015.

Submission of the documents specified in part one of this subitem to customs authorities for registration of the statistical declaration is not required. Data on these documents are entered in the statistical declaration. In case of shipment of goods from warehouse the road transport and their further transportation by other modes of transport in the statistical declaration in addition specifies data on the transport (transportation) document the goods delivery to the airport, the railway station, port;

1.7. in case of non-compliance with structure, format and procedure for filling of the statistical declaration, including lack in it of data on the documents specified in subitem 1.6 of this Item in registration of the statistical declaration refuses;
