About transportation of dangerous goods and not neutralized container by road transport

Chapter 1. General provisions

Article 1. Subject of regulation of the Law

1. This Law establishes main routes and the principles of state policy in the field of transportation of dangerous goods and not neutralized container (further - dangerous goods) road transport in the territory of the Republic of Armenia, and also the rights, obligations and responsibility of the supplier, carrier and the receiver of dangerous goods (further - the subjects transporting dangerous goods).

Article 2. Law coverage

1. Operation of this Law extends to all subjects organizing and (or) performing activities for transportation of dangerous goods by road transport, and also providing the services connected with transportation of dangerous goods.

2. Operation of this Law does not extend if dangerous goods the vehicle transports in the territory of the organization where their production is performed, processing, storage, use or destruction, and are not transported by ways of general use.

3. Operation of this Law does not extend to transportations of the dangerous goods performed by the vehicles belonging to bodies of armed forces, polices and services of homeland security.

Article 3. The basic concepts used in the Law

1. In this Law the following basic concepts are used:

1) dangerous goods - dangerous substance, raw materials, dangerous wastes which during transportation because of the features can do harm to life and human health, to cause environmental pollution and to damage vehicles or buildings and structures according to classification of the European agreement on the international road delivery of dangerous goods (DOPOG);

2) carrier of dangerous goods - the legal entity having the corresponding authority for the move of dangerous goods which transports dangerous goods;

3) transportation of dangerous goods - the activities connected with transportation of dangerous goods from production site or storages (origin) to the destination (terminal point) which includes the works connected with implementation of actions for acceptance, transportation, delivery of dangerous goods, its container, vehicles, load and also with short-term storage of load at all stages of its transportation;

4) transportation route - the approved route for movement of vehicles for transportation of dangerous goods from origin to terminal point which includes places of their parking and Items of gas station;

5) the receiver of dangerous goods - the legal entity specified in carriage documents who is authorized to receive the dangerous goods dispatched (delivered) to his name;

6) the vehicle transporting dangerous goods - the cargo vehicle provided by the manufacturing plant or re-equiped by carrier in the procedure established by the legislation of the Republic of Armenia for transportation of this type of dangerous goods;

7) the emergency map - the document of the established sample on properties of dangerous goods and actions for elimination of the accidents or incidents arising during its transportation, and their effects completed by the supplier of load and provided to carrier together with load. The form of the emergency card is established by the Government of the Republic of Armenia;

8) the supplier of load - the legal entity specified in carriage documents who prepares packs and delivers dangerous goods;

9) not neutralized container - the container, containers, vessel, tanks provided for transportation and storage of dangerous goods which after unloading of dangerous goods did not undergo cleaning, disinfection, disinfecting or deactivation;

10) the certificate on occupational retraining - the document of the corresponding sample issued to drivers and specialists of safety based on positive result of professional verification of requirements to transportation of dangerous goods;

11) professional training - professional training of drivers and programs specialists of safety according to requirements of the European agreement "About the international motor transportation of dangerous goods (DOPOG)" regarding the organization of requirements to transportation of dangerous goods, realization of safe transportation, decrease in probability of emergence of accidents, and also emergency response which will be enabled by the organizations having the license for implementation of professional training on transportation of dangerous goods;

12) particular dangerous goods - dangerous goods which on the physical and chemical properties has high degree of harm for life and health of the person and danger to the environment and require any kind of isolation.

Article 4. Legislation on transportation of dangerous goods by road transport

1. The legislation on transportation of dangerous goods by road transport consists of the Civil code of the Republic of Armenia, the laws of the Republic of Armenia "About transport", "About road transport", "About waste", this Law and other legal acts.

2. If international treaties of the Republic of Armenia establish other regulations, than are provided by this Law, then regulations of international treaties are applied.

Chapter 2. State policy in the field of transportations of dangerous goods by road transport

Article 5. The basic principles of state policy in the field of transportations of dangerous goods

1. The basic principles of state policy in the field of transportation of dangerous goods by road transport are:

1) rule of requirements of ecological, radiation and fire safety, protection of life and health and physical protection of people, protection of work and environment, ensuring sanitary and epidemic safety of the population and safe traffic;

2) ensuring the state control of condition of carriages of dangerous goods.

Article 6. Main routes of state policy in the field of transportations of dangerous goods

1. Main routes of state policy in the field of transportations of dangerous goods are:

1) development and implementation of state policy in the field of transportations of dangerous goods;

2) establishment and implementation of the state control of criteria, standards, regulations, rules, requirements to the works and services concerning transportations of dangerous goods;

3) coordinating of activities of state bodies for the purpose of state regulation and safety management in the field of transportations of dangerous goods;

4) international cooperation in the field of transportations of dangerous goods.
