About approval of the Procedure for forming and maintaining the licensed register

According to paragraph one of part one of article 18 of the Law of Ukraine "About licensing of types of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for forming and maintaining the licensed register which is applied.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Procedure for forming and maintaining the licensed register

1. This Procedure determines organizational bases of forming and maintaining the licensed register, and also the list of the data containing in the licensed register.

2. Terms in this Procedure are used in the value given in the Law of Ukraine "About licensing of types of economic activity".

3. The licensed register is created and kept by body of licensing electronically separately by each type of the economic activity which is subject to licensing taking into account requirements of the Law of Ukraine "About personal data protection".

4. The licensed register contains data relatively:

1) subject of managing to which the license is granted:

for the legal entity - full name, identification code of the legal entity in the Unified state register of the companies and organizations of Ukraine (further - identification code), the location, phone number, the e-mail address;

for physical person entrepreneur - surname, name, middle name (in the presence), the location (the residential address on which communication with physical person entrepreneur), registration number of accounting card of the taxpayer or series (in the presence), passport number, whom is performed and when it is issued (for physical persons which because of the religious beliefs in accordance with the established procedure refused adoption of registration number of accounting card of the taxpayer), phone number, the e-mail address;

2) type of economic activity or part of the type of economic activity which is subject to licensing and which has the right to perform the licensee based on the license;

3) the acceptance basis, acceptance date and number of the decision on licensing (with indication of the name, the location, identification code of body of licensing which granted the license);

4) license effective period (in case of establishment of effective period of the license the law);

5) the place of implementation by the licensee of type of the economic activity which is subject to licensing (including date of introduction of data on the place of implementation of type of economic activity);

6) material and technical resources which are used by the licensee of implementation of type of the economic activity which is subject to licensing (in case of availability in licensed conditions of requirements to such base);

7) acceptance basis, acceptance date and number of the decision of body of licensing on renewal of the license;

8) the acceptance basis, acceptance date and number of the decision of body of licensing on suspension of action of the license fully or partially (with indication of the name of part of type of economic activity which stops), date of its entry into force; the place of implementation of activities in which implementation of type of the economic activity which is subject to licensing stops;

9) term of suspension of action of the license fully or partially;

10) the acceptance basis, acceptance date and number of the decision of body of licensing on renewal of action of the license fully or partially (with indication of the name of part of type of economic activity which is recovered); the place of implementation of activities in which implementation of type of the economic activity which is subject to licensing is recovered;

11) the acceptance basis, acceptance date and number of the decision of body of licensing on cancellation of the license fully or partially (with indication of the name of part of type of economic activity on which implementation the license is cancelled), date of its entry into force; the place of implementation of activities in which implementation of type of the economic activity which is subject to licensing in case of cancellation of the license partially stops;

12) the acceptance basis, acceptance date and number of the decision of body of licensing concerning expansion or narrowing of implementation of type of economic activity by the licensee with indication of part of type of economic activity which it expanded or narrowed; the place of implementation of activities in which activities in case of expansion of type of the economic activity which is subject to licensing or activities implementation in which activities, in case of narrowing of type of economic activity by the licensee stop will be performed;

13) appeal by the licensee of the decision of body of licensing in court;

14) the judgment with indication of result of consideration of the appealed decision of body of licensing;

15) recognition of the invalid license in case of cancellation of licensing of type of economic activity;

16) the judgment about recognition of the invalid license (in the presence) with indication of date and number;

17) date and number of the notification of specially authorized body concerning licensing about adoption of the claim of licensees to actions (failure to act) of body of licensing concerning violation of the law in the field of licensing to consideration with indication of information on suspension of the decision of body of licensing which is appealed;

18) acceptance date and number of the decision of body of licensing on cancellation of the decision made by it based on the order of specially authorized body concerning licensing about consideration of the claim, court;

19) surname, name, middle name of the official who entered record in the licensed register.

The data entered in the licensed register are stored in the structured type; data of documents are stored in form, convenient for visual perception.

5. The body of licensing enters in the licensed register the data determined by item 4 of this Procedure based on the made decisions, and also information arriving in body of licensing according to the Law of Ukraine "About licensing of types of economic activity" and licensed conditions.
