DECISION OF THE EURASIAN INTERGOVERNMENTAL COUNCIL

About not putting down of marks of customs authorities in transport (transportation), business and (or) other documents when making customs transactions in electronic form

Having taken into consideration information on demand of making of customs transactions in electronic form in state members of the Eurasian Economic Union (further - the Union) and for the purpose of its broad and effective application Eurasian intergovernmental council solved:

1. Determine that since March 1, 2021 when making customs transactions in electronic form in addition marks of customs authorities in transport (transportation), commercial and (or) other paper documents are not put down, except for the following cases:

registration of permission of customs authority to departure of goods from customs area of the Union according to Item 9 of Article 92 of the Customs code of the Eurasian Economic Union;

registration of change, removal, destruction or replacement of means of identification by customs authority according to the paragraph the second Item 5 of Article 341 of the Customs code of the Eurasian Economic Union;

making of the customs transactions connected with observance of the route of transportation of goods established concerning the goods placed under customs procedure of customs transit;

absence at customs authority of opportunity to provide committing by person of customs transactions in electronic form in connection with the defect of the information systems used by customs authorities caused by technical failures, violations in operation of means of communication (telecommunication networks and the Internet), electricity outage, and also in other cases established by the legislation of state members of the Union;

receipt in customs authority of the motivated address of person about putting down of marks of customs authorities in transport (transportation), commercial and (or) other paper documents, including due to the need of observance of provisions of other industries of the legislation of state members of the Union, in addition to the legislation in the field of customs regulation, taking into account Item 2 of this Decision.

2. To provide to the governments of state members of the Union till December 1, 2020 introduction of amendments to the legislation of state members of the Union for need exception for the purpose of observance of provisions of other industries of the legislation of state members of the Union, in addition to the legislation in the field of customs regulation, to provide transport (transportation), commercial and (or) other paper documents with marks of customs authorities in case customs transactions were made in electronic form, and to inform the Eurasian economic commission on results of work.

3. The Eurasian economic commission report on results of the done work on execution of Item 2 of this Decision on Eurasian intergovernmental council till February 1, 2021.

4. This Decision becomes effective from the date of its official publication.
