About Rules of maintaining the unified state electronic register of licenses and Standard rules of maintaining the register of licenses

1. Approve Rules of maintaining the unified state electronic register of licenses and Standard rules of maintaining the register of licenses (appendices 1 and 2).

2. To the state authorized body in the field of regulation of permit system and to licensing authorities to take necessary measures for implementation of this resolution.

Rules of maintaining the unified state electronic register of licenses

1. General provisions

1. Rules of maintaining the unified state electronic register of licenses (further - these rules) determine the maintaining the unified state electronic register of licenses and other questions connected with the unified state electronic register of licenses.

2. The unified state electronic register of licenses (further - the Electronic register) is available online and is summary source data according to the licenses granted by the licensing body to legal entities and individual entrepreneurs.

3. The electronic register, also covers set of electronic data on names of licensed activities, the performed works within licensed activity, rules of issue, renewal, suspension, renewal and cancellation of the license, data on payment for receipt of the license and other data on the licenses provided by appendix of these rules.

4. The electronic register is posted on the website of authorized state body in the field of regulation of permit system.

5. The code of electronic data is placed in the Electronic register in state language and in need cases in other foreign languages.

6. Entering into the Electronic register the code of the electronic data contradicting the legislation of the Republic of Tajikistan or the wrong data is forbidden.

2. Rules of development of the code of electronic data, their introduction and removal in/from the electronic register

7. For entering into the Electronic register the code of electronic data is provided by the licensing body, concerning the licensed types of activity, certain articles 17 and 18 of the Law of the Republic of Tajikistan "About licensing of separate types of activity".

8. The code of electronic data concerning activities on implementation which licenses are granted by the Government of the Republic of Tajikistan is submitted the licensing executive bodies according to these rules.

9. The code of electronic data according to the Approximate instruction on clerical work in state bodies, organizations, the companies and other organizations of the Republic of Tajikistan approved by the order of the Government of the Republic of Tajikistan of July 28, 2017 No. 358, is submitted licensing authorities in authorized state body in the field of regulation of permit system according to appendix to these rules and appendices 1 - 3 Standard rules of maintaining the register of licenses.

10. The licensing body (licensing executive body) bears responsibility for correctness of the provided code of electronic data.

11. The representative's head state body in the field of regulation of permit system considers the provided code of electronic data and according to its order the responsible person of authorized state body in the field of regulation of permit system places it in the Electronic register.

12. Removal of the code of electronic data is performed by authorized state body in the field of regulation of permit system according to requirements of these rules.

3. Tasks of the licensing body

13. The licensing body:

- at the request of authorized state body in the field of regulation of permit system represents the code of the electronic data provided by Items 2 and 3 of these rules;

- takes measures for reduction in compliance of the regulatory legal acts regulating licensed activity with requirements of the Law of the Republic of Tajikistan "About licensing of separate types of activity" or in accordance with the established procedure represents the offer to authorized state body in the field of permit system;

- represents to authorized state body in the field of regulation of permit system information on changes and amendments to the regulatory legal acts regulating licensing for their entering into the Electronic register;

- bears responsibility for implementation of requirements of the Law of the Republic of Tajikistan "About licensing of separate types of activity", the order of the Government of the Republic of Tajikistan of April 3, 2007 No. 172 "About approval of the Regulations on features of licensing of separate types of activity (in the new edition)" and for the decision of the arisen disputes on licensing in the body.

14. Concerning activities on which implementation licenses are issued by the Government of the Republic of Tajikistan requirements of Item 13 of these rules are performed by the relevant licensing executive bodies.

4. Tasks of the responsible person of authorized state body in the field of regulation of permit system

15. In the field of regulation of permit system enter tasks of responsible authorized state body:

- consideration of the data posted on the website of authorized state body in the field of regulation of permit system and submission of the official report on their enhancement to the head of authorized state body in the field of regulation of permit system;

- submission of written information to the head of authorized state body in the field of regulation of permit system concerning the questions which arrived on the website of authorized state body in the field of regulation of permit system and placement of answers on this website according to its order;
