In pursuance of paragraph two of Item 3 of the Presidential decree of the Republic of Belarus of February 6, 2020 "About fuel cards" the Council of Ministers of the Republic of Belarus DECIDES: No. 40

1. Approve Regulations on order of registration of resident as the issuer of fuel cards in the territory of the Republic of Belarus it (is applied).

2. No. 175 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 25.03.2022

3. Determine that the residents issuing on the date of entry into force of this Item in the address in the territory of the Republic of Belarus the fuel cards having the right to submit till August 9, 2020 to Belneftekhim concern or the Ministry of Transport and Communications the statement for registration as the issuer of fuel cards in the territory of the Republic of Belarus with issue of the notice on registration.

4. This resolution becomes effective since August 9, 2020, except for Item 3 and this Item which are becoming effective after official publication of this resolution.

Regulations on order of registration of resident as the issuer of fuel cards in the territory of the Republic of Belarus

1. This Provision determines order of registration of resident as the issuer of fuel cards in the territory of the Republic of Belarus (further - the issuer of fuel cards) with issue of the notice on registration of resident as the issuer of fuel cards (further - the notice), the terminations (cancellation) of registration of resident as the issuer of fuel cards and cancellation, including cancellation, the notice, modification of the notice, issues of its duplicate, forming and maintaining registers of issuers of fuel cards (further - registers).

2. Registration of resident as the issuer of fuel cards is performed by the Belarusian state concern on oil and chemistry (further - Belneftekhim concern) and (or) the Ministry of Transport and Communications (further - Ministry of Transport) (further - registering bodies).

3. The statement for registration of resident as the issuer of fuel cards in the territory of the Republic of Belarus with issue of the notice on registration (further - the application for registration) is submitted in form according to appendix by 1 resident:

performing activities for wholesale trade by oil products and (or) retail trade by oil products, - in Belneftekhim concern;

performing activities for collection of fare for paid highways, - in Ministry of Transport;

performing activities for wholesale trade by oil products and (or) retail trade by oil products and activities for collection of fare for paid highways, - in Belneftekhim concern or in Ministry of Transport at the discretion of resident.

4. The application for registration is submitted in registering body by the authorized representative of resident, the courier (courier) or goes by mail the registered mail with the assurance of receipt.

5. In case of entering into the statement for registration not of all data provided in its form according to appendix 1, and also in other cases specified in article 17 of the Law of the Republic of Belarus of October 28, 2008 to No. 433-Z "About bases of ministerial procedures" the registering body refuses acceptance of this statement to consideration.

6. The adopted application for registration shall be considered by registering body within three working days from the date of its representation.

In case of need sending an inquiry in state bodies, other organizations the term specified in part one of this Item is prolonged up to thirteen working days.

The documents (data) requested by registering body shall be submitted by state bodies, other organizations within five working days from the date of receipt of the corresponding request.

7. The registering body makes the decision on refusal in registration of resident as the issuer of fuel cards with issue of the notice in cases:

if the decision on liquidation is made on the resident applying for registration as the issuer of fuel cards;

if concerning the resident applying for registration as the issuer of fuel cards, the court considering economic cases opens bankruptcy proceedings;

establishments of discrepancies of the data specified in the submitted application for registration with the data containing in the Single state register of legal entities and individual entrepreneurs;

absence at resident at the time of filing of application about registration of the license for wholesale and retail trade by oil products and non-realizations of activities for collection of fare on paid highways;

suspensions of the license for wholesale and retail trade by oil products (concerning the residents which are performing wholesale and (or) retail trade by oil products and not performing activities for collection of fare for paid highways);

obtaining by registering body before decision by results of consideration of the application about registration from the controlling (supervising) bodies of materials (information) with supporting documents on submission of false information by the resident for registration of resident as the issuer of fuel cards with issue of the notice;

in other cases determined in article 25 of the Law of the Republic of Belarus «About bases of ministerial procedures».

8. In the absence of the bases for refusal in registration of resident as the issuer of fuel cards with issue of the notice the registering body makes the decision on registration of resident as the issuer of fuel cards and issue of the notice (further - the decision on registration).

The notice on registration of resident as the issuer of fuel cards in the territory of the Republic of Belarus is issued in form according to appendix 2.

9. The resident is considered the registering body of the decision on registration registered as the issuer of fuel cards from acceptance date.
