Some questions connected using customs declarations of separate types

According to article 12 of the Law of Ukraine "About the mode of general transit and introduction of national electronic transit system", Article 257 of the Customs code of Ukraine the Cabinet of Ministers of Ukraine decides:

1. Approve such which are applied:

Regulations on customs declarations of separate types;

form of the transit accompanying document.

2. Bring in the Regulations on customs declarations approved by the resolution of the Cabinet of Ministers of Ukraine of May 21, 2012 No. 450 "The questions connected using customs declarations" (The Official Bulletin of Ukraine, 2012, No. 40, the Art. 1545, No. 91, Art. 3674; 2019, No. 24, the Art. 847, No. 58, the Art. 1999), changes which are applied.

3. This resolution becomes effective from the date of its publication.

Regulations on customs declarations of separate types

General questions

1. This Provision determines requirements to registration and use of customs declarations of separate types based on which the goods moved under customs control between two customs authorities of Ukraine or within zone of activities of one customs authority are declared in the mode of general transit, and also procedure for modification of such customs declarations, their response and recognition by invalid.

2. In this Provision terms are used in the value given in the Law of Ukraine "About the mode of general transit and introduction of national electronic transit system" and the Customs code of Ukraine.

3. The customs declaration of separate type is the statement in which the subject of the mode or on behalf of the subject of the mode declares the company providing services in declaration of goods intention of the subject of the mode to place goods in the mode of joint transit in the way:

departures of the authorized structured electronic message in electronic transit system - the main procedure of declaring;

submissions of the paper document to customs authority - contingency procedure of declaring.

4. Contingency procedure of declaring is applied in the cases provided by part three of article 3 of the Law of Ukraine "About the mode of general transit and introduction of national electronic transit system".

5. Declaration of goods and/or accomplishment of customs formalities concerning such goods using at the same time main and contingency procedure of declaring is not allowed.

6. Declaring using contingency procedure of declaring is possible on condition of confirmation by authorized division of State Customs Service of temporary refusal of electronic transit system or electronic management system guarantees, or the single automated information system and after approval of application of contingency procedure of declaring by customs authority to which the customs declaration of separate type on contingency procedure of declaring moves.

7. Customs declarations of separate type are on paper filled in:

on the form of the single administrative document with use of set which consists of one leaf with the designation "1/6" and two copies of leaf with the designation "4/5" of the MD-2 form. During declaring more than one goods the specified sheets of the MD-2 form are supplemented with additional sheets of the MD-3 form with the designations "1/6" and "4/5". The MD-2 and MD-3 forms of forms of the single administrative document are approved by the resolution of the Cabinet of Ministers of Ukraine of May 21, 2012 No. 450 (The Official Bulletin of Ukraine, 2012, No. 40, the Art. 1545). Forms of the single administrative document of the MD-2 form and additional leaf of the MD-3 form to it are made on the self-copying paper with a density at least 40 grams on sq.m and detachable part of the A4 format (210 by 297 millimeters). Additional sheets of the MD-3 form in case of their application are integral part of the customs declaration of separate type on paper on the form of the single administrative document of the MD-2 form; or

by means of the computer are also printed on sheets of paper of the A4 format (210 by 297 millimeters) in form of the single administrative document with use of set which consists of one leaf with the designation "1/6" and two copies of leaf with the designation "4/5" of the MD-2 form. 8. The customs declaration of separate type is filled in on goods which move or are subject to movement in the mode of joint transit by one vehicle from one customs of departure or one authorized consignor to one customs of appointment or one authorized consignee in separate cargo piece or other packet, container or the vehicle of commercial appointment.

One customs declaration of separate type can be also filled in on goods in several separate cargo pieces or other packets, containers provided that these goods are loaded and move or are subject to movement by one vehicle.

9. In one customs declaration of separate type no more than 999 goods can be declared.

10. The customs declaration of separate type is filled in in state language.
