About licensing of geodetic and cartographic activities

According to part 2 of article 21 of the Federal law "About Geodesy, Cartography and Space Data and on Modification of Separate Legal Acts of the Russian Federation" Government of the Russian Federation decides:

1. Approve the enclosed Regulations on licensing of geodetic and cartographic activities.

2. To Federal Registration Service in 4-month time from the date of official publication of this resolution to approve form of checking leaf (the list of control questions) applied when implementing of licensed control of geodetic and cartographic activities by Service.

3. Realization of the powers provided by this resolution is performed within the number of employees of central office and territorial authorities of Federal Registration Service, and also budgetary appropriations provided to Service in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

4. This resolution becomes effective since January 1, 2021, except for Item 2 of this resolution which is becoming effective from the date of official publication of this resolution.

5. This resolution is effective till March 1, 2026.

Regulations on licensing of geodetic and cartographic activities

1. This Provision determines procedure for licensing of geodetic and cartographic activities (except for the specified types of activity performed by staff of the Armed Forces of the Russian Federation for the purpose of ensuring defense of the Russian Federation and also when implementing town-planning and cadastral activities, subsurface use) as a result of which creation (updating) of the state topographic maps or state topographical plans, the state geodetic networks, state leveling networks and state gravimetric networks, geodetic networks of special purpose, including networks of differential geodetic stations, determination of parameters of figure of Earth and gravitational field for this purpose, establishment, change and refining of passing of frontier of the Russian Federation are performed, establishment and change of borders between subjects of the Russian Federation and borders of municipalities, borders of settlements, borders of zones with special conditions of use of the territory (further - geodetic and cartographic activities).

2. Licensing of geodetic and cartographic activities is performed by Federal Registration Service and its territorial authorities (further - the licensing body).

3. The list of the performed works which are constituting geodetic and cartographic activities subject to licensing (further - geodetic and cartographic works), and also professions, necessary for their accomplishment, or the directions of training of workers of the legal entity (individual entrepreneur) who filed in the licensing body petition for provision of the license (further - the license applicant), or workers of the legal entity (individual entrepreneur) having the license (further - the licensee), is given in appendix.

4. The licensed requirements imposed to the license applicant (licensee) on implementation of geodetic and cartographic activities are:

a) availability at the license applicant (licensee) belonging to it on the property right or other legal cause of the technical means and the equipment which underwent checking (calibration) according to the Federal Law "About Ensuring Unity of Measurements", necessary for performance of works, specified in the statement for provision of the license (modification of the register of licenses);

b) availability at the legal entity (the license applicant, the licensee) of the workers who signed employment contracts with it for implementation of the geodetic and cartographic works on position according to the staff list having the higher or secondary professional education on the specialties or the directions of preparation specified in appendix to this Provision and also length of service at least one year on the corresponding specialty or the direction of preparation;

c) availability at the individual entrepreneur (the license applicant, the licensee) and (or) workers who signed employment contracts with it for implementation of geodetic and cartographic works on position according to the staff list, the higher or secondary professional education on the specialties or the directions of preparation specified in appendix to this Provision and also length of service at least one year on the corresponding specialty or the direction of preparation;

d) availability at the license applicant (licensee) of the system of production supervision providing control of observance of requirements to the geodetic and cartographic works and their results established according to part 4 of article 5 of the Federal law "About Geodesy, Cartography and Space Data and on Modification of Separate Legal Acts of the Russian Federation";

e) use by the licensee of the space data and materials containing in federal fund of space data, and also data of unified electronic cartographic basis according to the Federal Law "About Geodesy, Cartography and Space Data and on Modification of Separate Legal Acts of the Russian Federation" when implementing cartographic activities for needs of public authorities and local government bodies.

5. Gross violation of licensed requirements is failure to carry out by the licensee of the requirements provided by subitems "an" - "in", "d" item 4 of this provision, entailed the effects provided by part 10 of article 19.2 of the Federal law "About Licensing of Separate Types of Activity".

6. The license applicant sends to the licensing body according to part 1 of article 13 of the Federal law "About Licensing of Separate Types of Activity" the statement for provision of the license in which are specified:

a) data on surname, name, middle name (in the presence) and insurance numbers of individual personal accounts of persons specified in subitems "b" and "v" of item 4 of this provision, and also about availability at such persons of the higher or secondary professional education on necessary for performance of works, specified in the statement for provision of the license, to specialties or the directions of preparation, about registration number and date of issue of the education document;

b) ceased to be valid
