Some questions of single state information system in the sphere of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction

The Cabinet of Ministers of Ukraine decides:

1. Approve Regulations on single state information system in the sphere of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction which is applied.

2. Determine that ensuring functioning of single state information system in the sphere of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction is performed by subjects of the specified system for the account and in the expense limits provided by it in the government budget for the corresponding year.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

General part

1. This Provision regulates scoping of information, data from information, help systems, registers and databanks (further - the state electronic information resources), the necessary for accomplishment tasks assigned to Gosfinmonitoring, procedure for provision of such information, data (access to them) for ensuring functioning of single state information system in the sphere of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction (further - unified information system).

2. The terms used in this Provision have such value:

1) unified information system - information system which by consolidation of organizational and technical actions, technical and software provides data collection and processing and the data of the state electronic information resources necessary for carrying out by Gosfinmonitoring complex information analysis and data on the financial transactions which are subject to financial monitoring, other information and the data which can be connected with legalization (washing) of income gained in the criminal way, either financing of terrorism or financing of distribution of weapons of mass destruction;

2) information resources - the set of information, information of the state electronic information resources determined by Gosfinmonitoring which are provided to Gosfinmonitoring on the details approved with subjects of unified information system;

3) subjects of unified information system - Gosfinmonitoring, state bodies (except National Bank) and the local government bodies providing access to Gosfinmonioringu of the state electronic information resources which are necessary for accomplishment of the tasks assigned to it.

3. The unified information system functions for the benefit of homeland security, protection of the rights and legitimate interests of citizens, society and the state for the purpose of ensuring realization of state policy in the sphere of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction.

Scoping of information resources

4. State financial monitoring determines data (this) of the state electronic information resources which are necessary for accomplishment of the tasks assigned to Gosfinmonitoring, prepares and directs to the subject of unified information system reasons for provision of the information resources containing:

bases for provision of information resources;

amount of data (these) state electronic information resources necessary for implementation of powers according to the tasks assigned to Gosfinmonitoring;

method (technologies) and conditions of information exchange.

5. The subject of unified information system within ten working days after receipt of reasons submits to Gosfinmonitoring information on details of data (these) state electronic information resources and the offer on implementation of information exchange.

State financial monitoring together with the subject of unified information system is approved by details, formats of data (these) information resources, technologies and terms of information exchange which are determined adopted jointly by agreements and/or regulatory legal acts.

Procedure for information exchange

6. Information exchange between subjects of unified information system is performed:

on Gosfinmonitoring requests in the state electronic information resources according to the Procedure for the organization of electronic information interaction of the state electronic information resources approved by the resolution of the Cabinet of Ministers of Ukraine of May 10, 2018 No. 357, or other legislatively certain regulatory legal acts with use of the state information and telecommunication systems. Subjects of unified information system, if necessary, determine requirements concerning web services and web clients, and also procedure for their putting into operation;

by regular provision by subjects of unified information system of changes of information resources for their updating in information system of Gosfinmonitoring. The specified procedure is applied to information resources which are used for carrying out strategic analysis and/or contain information with limited access.

Information containing in Gosfinmonitoring request and also the fact of receipt of request and provision of information on such request is not subject to disclosure by subjects of unified information system.
