Based on part two of Item 8 and Item 11 of appendix 2 to the Presidential decree of the Republic of Belarus of January 17, 2020 "About enhancement of procedure for the address with waste of goods and packagings" and subitem 4.4 of item 4 of the Regulations on the Ministry of Housing and Public Utilities of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 968, the Ministry of Housing and Public Utilities of the Republic of Belarus DECIDES: No. 16

1. Approve:

The regulations on procedure for the choice of receivers of the means arriving into the special account (are applied);

The regulations on procedure for evaluating reliability of the data represented by legal entities and individual entrepreneurs for receipt of compensation (are applied).

2. This resolution becomes effective after its official publication.

Regulations on procedure for the choice of receivers of the means arriving into the special account

1. This Provision determines procedure for the choice of receivers of the means arriving on the current (settlement) bank account of public institution "Operator of secondary material resources" (further - the operator) with the special mode of functioning, on implementation of actions, the provided in paragraphs six - the tenth item 4 of appendix 2 to the Presidential decree of the Republic of Belarus of January 17, 2020 No. 16, except for of actions for accomplishment of state programs (further if other is not provided, - action).

2. The choice of the legal entities or individual entrepreneurs enabling implementation of actions on accomplishment of state programs which source of financing are the means arriving on the current (settlement) bank account of the operator with the special mode of functioning (further - the special account) is performed according to the procedure, the determined Regulations on procedure for forming, financing, accomplishment and efficiency evaluation of implementation of state programs approved by the Presidential decree of the Republic of Belarus of July 25, 2016 No. 289.

3. The choice of receivers of the means arriving into the special account (further if other is not provided, - means), on implementation of actions is performed by the commission for determination of receivers of the means arriving into the special account (further - the commission) created by the Ministry of Housing and Public Utilities.

During creation of the commission the commission chairman, his deputy (deputies) and the secretary of the commission are appointed.

Republican state bodies, regional and Minsk city the executive committees, the state organizations subordinated to the Government of the Republic of Belarus, and other interested organizations by the direction of the representatives can take part in work of the commission.

4. The legal entity or the individual entrepreneur applying for receipt of means (further - the applicant) on realization of action, sends to the operator the request containing reasons for need of realization of action (further - reasons).

Reasons shall contain:

the description of action, including the characteristic of the purchased goods (works, services), assessment of total cost of action, the description of all expected sources of financing and terms of realization of action;

the description of the available problems which solution is possible in case of realization of action;

tseli1 actions and values of the target indicators characterizing achievement of these purposes (further - target indicators), including coordinated to the purposes of the state or other programs, strategy, concepts, actions plans or measures in the sphere of the address with waste;

assessment of financial performance of realization (payback period) of the action provided by paragraphs the ninth or tenth item 4 of appendix 2 to the Presidential decree of the Republic of Belarus of January 17, 2020 No. 16.

5. In addition to reasons go:

5.1. for the action provided by the paragraph the eighth item 4 of appendix 2 to the Presidential decree of the Republic of Belarus of January 17, 2020 No. 16, - the specification on performance of works;

5.2. for action for implementation of new technologies of use or neutralization of waste, construction (to reconstruction, upgrade) objects according to the address with waste:

business plan and (or) preproject (pre-investment) documentation, project documentation;

the description possible riskov2 in case of realization of action, including risks of not achievement of values of target indicators, and assessment of consequences of their approach, the description of possible actions for decrease in risks;

5.3. for the action provided by the paragraph the tenth item 4 of appendix 2 to the Presidential decree of the Republic of Belarus of January 17, 2020 No. 16:

comparison of the actual technical and economic and financial performance of the project with planned;

information on the obtained credits (the copy of credit agreements) and their repayment.

2 For the purposes of this provision risks are understood as the events leading to essential changes of sales terms of action, deficit of financing of realization of action, not achievement of values of target indicators and decrease in indicators of financial performance of realization of action.

6. The operator considers the reasons which arrived from the applicant on action compliance to purpose of means and compliance of reasons to requirements of items 4 and the 5th this provision:

for action for implementation of new technologies of use or neutralization of waste, construction (to reconstruction, upgrade) objects according to the address with waste - within two months;

for action for return (repayment) of the credits obtained on construction (reconstruction, upgrade) of objects for sorting, neutralization or use of waste, and interest for using such credits - within two months;

for other actions - within 20 working days.

If for consideration of reasons it is required to request additional documents and (or) data, the current of term of consideration of reasons stops from the date of the direction of the corresponding request till day of receipt of the answer to it.
