Some questions of payment of the rent for state-owned property during action of quarantine

Cabinet of Ministers of Ukraine decides:

1. Determine that for action of the quarantine established by the Cabinet of Ministers of Ukraine for the purpose of prevention of distribution in the territory of Ukraine of sharp respiratory disease of COVID-19, of SARS-CoV-2 caused by coronavirus:

1) lessees according to the list according to appendix 1 are exempted from the rent;

2) charge of the rent for use of real state-owned property calculated according to the Method of calculation of the rent for state-owned property and proportions of its distribution approved by the resolution of the Cabinet of Ministers of Ukraine of October 4, 1995 No. 786 (the joint venture of Ukraine, 1996, No. 2, Art. 57; The Official Bulletin of Ukraine, 2011, No. 71, of the Art. 2677), is performed in the amount of:

50 percent of the amount of the added rent for lessees according to the list according to appendix 2;

25 percent of the amount of the added rent for lessees according to the list according to appendix 3.

2. To lessors of state-owned property to provide charge of the rent to lessees according to Item 1 of this resolution, since date of establishment of quarantine.

Appendix 1

to the Resolution of the Cabinet of Ministers of Ukraine of July 15, 2020 No. 611

The list of the lessees exempted from the rent for use of real state-owned property *

1. Lessees who lease rooms (in educational cases) organizations of science and education of the state pattern of ownership for the purpose of placement:

cafe, cafeterias, dining rooms, buffets which are not performing sales of goods of excisable group;

kserokopirovalny equipment for provision to the population of services in photocopying of documents; shopping facilities selling printed material and stationery;

licensed video and audioproducts intended for educational institutions;

shopping facilities selling nonfoods;

the vending machines selling food products;

research establishments.

2. Lessees who lease rooms for placement:

private institutions of education;

the state educational institutions which are partially financed from the government budget, and organizations of education financed from the local budget;

the public and municipal institutions of out-of-school education (except improving institutions for children and youth) and organizations of preschool education;

publishing houses of printing mass media and publishing products which are published in Ukrainian;

shopping facilities selling the books, newspapers and magazines issued in Ukrainian;

sports institutions which activities are directed to the organization and training by different types of sport;

libraries, museums;

the institutions performing preparation, retraining and advanced training of transport drivers;

cultural institutions, irrespective of pattern of ownership, leasing rooms for implementation of authorized activities in the sphere of culture and arts;

beauty shops, saunas, Turkish baths, sunbeds, offices of massage, gyms.

3. Lessees who lease rooms on purpose:

organizations of concerts and other spectacular and entertaining activities;

consumer services of the population;

implementation of tour operator and tourist's agency activities.

Appendix 2

to the Resolution of the Cabinet of Ministers of Ukraine of July 15, 2020 No. 611

The list of lessees for whom charge of the rent for use of real state-owned property is performed in the amount of 50 percent *

1. Lessees who use real state-owned property for placement:

cafe, bars, cafe bars, snackbars, buffets, cafeterias performing sales of goods of excisable group;

cafe, bars, cafe bars, snackbars, cafeterias which are not performing sales of goods of excisable group;

restaurants, restaurants with night operating mode;

dining rooms, buffets which are not performing sales of goods of excisable group;

kserokopirovalny equipment for provision to the population of services in photocopying of documents;

computer clubs and Internet cafe;

shopping facilities selling manufactured goods (except performing retail trade by means of hygiene);

shopping facilities selling the nonfoods which were in the use;

holding exhibitions of the graphic and book products made in Ukraine;

exhibitions of nonfoods without trade implementation;

hotels;

transport enterprises on transportation of passengers;

office rooms (in particular, at the airports).

2. The domestic legal entities and physical persons which are small business entities, physical persons which perform productive activity directly on leased floor spaces (in particular, at the airports).

3. Subjects of cinematography which main activities is film production or technical supply and servicing of film production provided that they are entered in the State register of producers, distributors and demonstrators of movies.

Lessees who use real state-owned property for placement in the territory of the airports:

cafe, bars, cafe bars, snackbars, buffets, cafeterias performing sales of goods of excisable group;

cafe, bars, cafe bars, snackbars, cafeterias which are not performing sales of goods of excisable group;

restaurants, restaurants with night operating mode;

dining rooms, buffets which are not performing sales of goods of excisable group;

shopping facilities.
