About measures for implementation of the Presidential decree of the Republic of Belarus of February 16, 2012 No. 71

Based on subitem 9.3 of Item 9 of the Regulations on the State military-industrial committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 8, 2009 No. 602, of Item part four 8, of Items 28 and 32 of the Regulations on procedure for licensing of the types of activity connected with specific goods (works, services) No. approved by the Presidential decree of the Republic of Belarus of February 16, 2012 71, the State military-industrial committee of the Republic of Belarus DECIDES:

1. Determine that:

1.1. statements for issue of special permissions (licenses) for implementation of the activities connected with military products (further - licenses), prolongation of effective period of licenses, introduction of changes in them and (or) amendments, issue of duplicates of licenses (further - the statement), requests of legal entities about provision of information containing in the register of licenses go to the State military-industrial committee (further - Goskomvoyenprom);

1.2. the actions specified in part one of Item 8 of the Regulations on procedure for licensing of the types of activity connected with specific goods (works, services) are performed by authorized structural division of Goskomvoyenprom (further - authorized structural division);

1.3. assessment of conformity of opportunities of the license applicant (licensee) to licensed requirements and conditions on implementation of the activities connected with military products (further, unless otherwise specified, - assessment), is carried out in the cases established by Regulations on procedure for licensing of the types of activity connected with specific goods (works, services).

For evaluating in Goskomvoyenprom the commission is created. The purpose of work of the commission is check of reliability of the data containing in the statement and the documents attached to it, availability at the license applicant (licensee) of opportunity to perform the activities connected with military products.

The commissions except representatives of Goskomvoyenprom can be included representatives of the interested state bodies and other organizations (according to their offers and from consent), and also, if necessary, employees of the organizations which are a part of the system of Goskomvoyenprom.

In need of conducting examination of compliance of opportunities of the license applicant (licensee) to licensed requirements and conditions on implementation of the activities connected with military products (further - examination), in Goskomvoyenprom the commission taking into account requirements of Items 30-37 of the Regulations on procedure for licensing of the types of activity connected with specific goods (works, services) is created.

Assessment and (or) examination are, as a rule, carried out in the location of the license applicant (licensee) and (or) the rooms used by it for performance of works of the licensed type of activity. At the same time in cases of prolongation of effective period of the license and in the presence in Goskomvoyenprom sufficient information about activities of the licensee, and also receipt of the conclusion of Committee for State Security about feasibility of prolongation of effective period of the license assessment can be carried out by studying and the analysis of the documents submitted by the licensee without departure in its location and (or) the location of the rooms used by it for performance of works.

Results of assessment are drawn up by the appraisal report of compliance of opportunities of the license applicant (licensee) to licensed requirements and conditions (further - the appraisal report).

If when evaluating expertize was carried out, then results of examination are applied to the appraisal report.

Based on the appraisal report the authorized structural division prepares the conclusion about compliance or discrepancy of opportunities of the license applicant (licensee) to licensed requirements and conditions with offers on determination of special licensed requirements and conditions and (or) on change (disaggregation) of the list constituting corresponding licensed type of activity of works and (or) services and (or) the list of specific goods concerning which works are performed and (or) services, and (or) license effective period are rendered;

1.4. maintaining the register of licenses is performed by Goskomvoyenprom according to the procedure, the established Chapter 8 of the Regulations on procedure for licensing of the types of activity connected with specific goods (works, services).

The register of licenses is kept on the electronic medium by the ranking officer of authorized structural division.

Entering of information about licensees into the register of licenses is made in day of execution of the license. Subsequent changes and (or) amendments of information about licensees in the register of licenses are performed based on the relevant decisions made by the Interdepartmental commission on military technically cooperation and export control under the Security Council of the Republic of Belarus or Goskomvoyenprom according to the procedure established by the legislation in the field of licensing.

The data containing in the register of licenses are provided based on the decision of the Chairman of Goskomvoyenprom or the official authorized by it.

2. Establish forms:

statements for issue of the duplicate of special permission (license) for the right of implementation of the activities connected with military products according to appendix 2;

the register of special permissions (licenses) for the right of implementation of the activities connected with military products, issued by the State military-industrial committee according to appendix 6.

3. Declare invalid the resolution of the State military-industrial committee of the Republic of Belarus of April 9, 2012 No. 5 "About measures for implementation of the Presidential decree of the Republic of Belarus of February 16, 2012 No. 71".

4. This resolution becomes effective after its official publication.
