About the organization of provision of social services

According to Item "About social services" the Cabinet of Ministers of Ukraine decides 17 parts one of article 1 of the Law of Ukraine:

1. Approve the Procedure for the organization of provision of social services which is applied.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

3. Recommend to local government bodies to be guided by the Procedure approved by this resolution.

Procedure for the organization of provision of social services

General questions

1. This Procedure determines the mechanism of identification of persons/families which are in difficult vital circumstances or have high risk of hit in such circumstances, and the organizations of provision of social services by it according to individual requirements.

The organization of stay and provision of social services to persons which were affected by domestic violence and/or violence on the basis of sex in specialized support services of injured persons is performed according to standards of provision of social services to such persons.

2. In this Procedure terms are used in the value given in the Laws of Ukraine "About social services" "About social work with families, children and youth", "About local self-government in Ukraine", "About child care", "About prevention and counteraction to domestic violence", "About counteraction to human trafficking", "About social adaptation of persons who serve or served sentence in the form of restriction of freedom or imprisonment for certain term", "About bases of social protection of homeless persons and street children", "About employment of the population", "About freedom of travel and the free choice of the place of residence in Ukraine", "About the Unified state demographic register and documents which confirm citizenship of Ukraine, prove the identity or her special status", "About provision public (electronic public) services in declaring and registration of the residence in Ukraine".

3. Ensuring provision of social services to persons/families according to their requirements in the territory of administrative and territorial unit is assigned to Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations.

Ensuring provision of basic social services to persons/families according to their requirements, taking measures to rendering other social services to such persons / families is assigned to the Kiev and Sevastopol city state administrations, executive bodies of village, settlement, city councils.

Identification of persons/families which are in difficult vital circumstances or have high risk of hit in such circumstances

4. Persons/families which cannot independently overcome negative impact of the circumstances caused by the following factors belong to the persons/families which are in difficult vital circumstances:

old age;

partial or total loss of physical activity, memory;

the incurable diseases, diseases requiring long-term treatment;

the mental and behavioural disturbances including connected with the use of psychoactive agents;

disability;

homelessness;

unemployment;

low-security;

behavioural frustration at children because of divorce of parents;

evasion by parents or persons who replace them, from execution of the obligations on education of the child;

loss of social communications, including during stay in places of detention;

child abuse;

domestic violence;

violence on the basis of sex;

hit in human trafficking situation;

damage caused by the fire, natural disaster, catastrophic crash, fighting, act of terrorism, armed conflict, temporary occupation. In this Procedure the term "the damage caused by armed conflict" belongs, in particular, to material, physical, psychological damage which was caused to person/family and led to the fact that such person / family got to difficult vital circumstances.

To persons/families which have the highest risk of hit in difficult vital circumstances because of influence of adverse external and/or internal factors (further - vulnerable categories of the population), except those, factors of influence on whom are determined in paragraphs the second - the seventeenth this Item, belong:

families in which children are taken away from parents without deprivation of their parent rights;

families where there is process of divorce of parents and the dispute between mother and the father on determination of the place of residence of children, participation of parents in their education is solved;

families with children at which the long illness of parents interferes with them to fulfill the parental responsibilities;

families in which children with disability, and families with children in which parents have disability are raised;

families in which parents are recovered in the parent rights;

families with children where parents are labor migrants;

needy families with children;

families from which children are in organizations of institutional leaving and education;

families from which children are arranged in family of the foster tutor;

families in which children systematically self-willedally leave the residence;

families in which children systematically without valid excuse do not visit organization of education;

women who expressed intention to refuse the newborn child;

minor lonely mothers (fathers);

children who are on education in families of guardians, custodians, foster homes, orphanages of family type;

persons from among the orphan children and children deprived of parent guardianship;

persons with special educational needs;

internally displaced persons;

full age incapacitated persons (in case of absence of the guardian at them);
