RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

of June 1, 2020 No. 586

Some questions of protection of children in the conditions of fight against consequences of sharp respiratory disease of COVID-19, of SARS-CoV-2 caused by coronavirus
(Extraction)

(as amended on 04-08-2021)

For the purpose of enhancement of mechanisms of social protection of children in the conditions of fight against consequences of sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus and the prevention of hit of children in organizations which perform institutional leaving and education of children the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for transfer of children on the round-the-clock stay in organizations, irrespective of type, pattern of ownership and subordination which is applied.

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. To the ministry of social policy, the Ministry of Education and Science, the Ministry of Health till January 1, 2021:

bring own regulatory legal acts into accord with this resolution;

the paragraph third is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 04.08.2021 No. 843

4. No. 843 is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 04.08.2021

5. To the regional, Kiev and Sevastopol city, district public administrations:

The paragraph two is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 04.08.2021 No. 843

promote identification and ensuring social protection of the children who are in the difficult vital circumstances suffering from ill treatment, in particular domestic violence;

promote the organization of assessment of needs of each child and his family and provision according to the revealed requirements of social support;

provide carrying out the analysis and consideration on commission session concerning protection of the rights of the child of results of assessment of needs of each child who owing to introduction of quarantine in connection with spread of sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus returned to family from the organization performing institutional leaving and education of children and his families with determination of feasibility of continuation of stay and training of the child in the relevant organization;

promote providing in communities at the place of residence (stay) of children of conditions for their training in general education educational institutions at the place of residence (stay), the solution of question of dovoz of children, hot meals, work of day-care centers, introductions of inclusive training of children with special educational needs;

promote implementation according to the needs of families with children of basic social services for communities and positions of specialists in social work, patronage over the child for prevention of hit of children in the organizations performing institutional leaving and education of children;

promote reduction of constituent documents of organizations of education in compliance with the Law of Ukraine "About secondary education" taking into account provisions of the Procedure for transfer of children on the round-the-clock stay in the institutions performing institutional leaving and education of children.

6. Recommend to local government bodies to perform the measures determined by Item 5 of this resolution.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine

1. In the resolution of the Cabinet of Ministers of Ukraine of August 26, 2002 No. 1243 "About urgent issues of activities of preschool and residential educational institutions" (The Official Bulletin of Ukraine, 2002, No. 35, Art. 1650; 2005, No. 25, Art. 1446; 2016, No. 7, Art. 349):

The paragraph the fifth Item 1 to exclude 1);

2) in Item 2:

third to state the paragraph in the following edition:

"for content of pupils in boarding schools (boards) of special facilities of education;";

after the paragraph of third to add Item with the new paragraph of such content:

"for content of pupils in boarding schools (boards) of organizations of vocational education - from the parents or persons replacing them from families who receive the help according to the Law of Ukraine "About the government public assistance to needy families";".

With respect thereto the fourth and fifth to consider paragraphs respectively paragraphs the fifth and sixth;

The paragraph the fourth Item 3 to exclude 3).

2. In the resolution of the Cabinet of Ministers of Ukraine of September 24, 2008 No. 866 "Questions of the activities of guardianship and custody bodies connected with protection of the rights of the child" (The Official Bulletin of Ukraine, 2008, No. 76, Art. 2561; 2014, No. 93, Art. 2684; 2018, No. 80, Art. 2674):

1) paragraphs third - the sixth Procedure Item 35 agencies of guardianship and cares of the activities connected with protection of the rights of the child approved by the specified resolution to state in the following edition:

"The materials prepared by service for children in whom the bases for the device of the orphan child or the child deprived of parent care in organization which performs institutional leaving and education of children, board (irrespective of pattern of ownership and subordination) are reasonably stated are considered on commission session concerning protection of the rights of the child.

The device of children in organizations which perform institutional leaving and education of children board (irrespective of pattern of ownership and subordination) is performed according to the direction (permit) of service for children in form according to appendix 12.

The direction (permit) to the child's device in organization which performs institutional leaving and education of children board district, city (district in the city), rural, settlement subordination issues service for children in the place of primary accounting of the child in coordination with relevant organ of management of education.

If the child gets a job in organization which performs institutional leaving and education of children, board of regional subordination, the direction (permit) is issued by service for children of the regional, Kiev or Sevastopol city state administration (executive body of the Autonomous Republic of Crimea) in the presence of all necessary documents. The structural division of science and education of the regional, Kiev or Sevastopol city state administration (executive body of the Autonomous Republic of Crimea) approves such direction (permit).";

2) in item 4 of the Standard regulations on the commission on questions of protection of the rights of the child approved by the specified resolution:
