About approval of National strategy of the Republic of Uzbekistan on human rights

In recent years system work on strengthening of legislative and organization-legal base of human rights protection, implementation of international standards on human rights is carried out to the national legal system and to accomplishment of the international obligations, and also enhancing cooperation with the international organizations for human rights protection.

Now the Republic of Uzbekistan joined more than 80 international human rights documents, including 6 basic agreements and 4 optional protocols of the United Nations (further - the UN), on permanent basis represents national reports on their accomplishment to Human Rights Council and contractual UN committees.

Besides, practical measures on harmonization of the national legal system with international legal standards in the field of human rights are taken.

At the same time acceptance of long-term strategy in human rights serves effective realization of state policy in the field, to forming of respect for human rights and freedoms, further strengthening of the authority of the country on the international scene, in particular to improvement of line items of the Republic of Uzbekistan in economic and political and legal ratings and indexes.

For the purpose of further enhancement of the mechanism of protection of human rights and freedoms, ensuring execution of Strategy of actions in five priority directions of development of the Republic of Uzbekistan in 2017 - 2021, and also effective and timely realization of the tasks determined in the President's letter of the Republic of Uzbekistan to Oliy Majlis of January 24, 2020:

1. Determine the main activities of state bodies and organizations of the Republic of Uzbekistan, actionees of regulations of international treaties by human rights:

ensuring unconditional accomplishment of the national plans of action ("road maps") submitted on implementation of recommendations of the international organizations for human rights protection;

identification, the analysis, and also elimination of the reasons and conditions interfering accomplishment of recommendations of the authorized bodies and contractual Human Rights Committees of the UN, way of development and implementation of measures directed to enhancement of the legislation and law-enforcement practice;

implementation of effective cooperation with Public chamber in case of the President of the Republic of Uzbekistan and institutes of civil society in the field of accomplishment of the international obligations of the Republic of Uzbekistan on human rights.

2. In view of recommendations of the international organizations, including authorized bodies and contractual UN committees to approve the providing developed on the basis of comprehensive study of topical issues and human rights protection, the analysis of the current legislation, law-enforcement practice and the best foreign practices, and also results of extensive public discussion, the international and national consultations:

The national strategy of the Republic of Uzbekistan on human rights (further - National strategy) according to appendix No. 1;

"Road map" on realization of National strategy of the Republic of Uzbekistan on human rights (further - "Road map") according to appendix No. 2;

Regulations on order of interaction of state bodies of the Republic of Uzbekistan on consideration of messages and decisions of authorized bodies and contractual Human Rights Committees of the United Nations according to appendix No. 3.

3. Establish procedure according to which:

a) The national center of the Republic of Uzbekistan on human rights (further - the Center) for the purpose of realization of National strategy and "Road map":

conducts regular monitoring, brings in the relevant ministries and departments of the offer and recommendation of high-quality and timely implementation of measures;

on permanent basis posts the detailed information reflecting specific indicators and the achieved results on the website;

quarterly introduces the summarized information in Administration of the President of the Republic of Uzbekistan and the Cabinet of Ministers of the Republic of Uzbekistan;

provides preparation, the translation into foreign languages and publication of information and analytical comments;

b) the executives in charge specified in "Road map" to the 5th day of every month provide information on accomplishment of the tasks assigned to them in the Center. At the same time the first heads of the ministries and departments bear the personal responsibility for full, high-quality and timely implementation of the tasks determined in "Road map";

c) at meetings of Presidium of the Cabinet of Ministers of the Republic of Uzbekistan once in six months is heard information of the ministries and departments on the course of realization of National strategy and "Road map".

4. Recommend:

a) to chambers of Oliy Majlis of the Republic of Uzbekistan:

form the Parliamentary commission on observance of the international obligations in the field of human rights;

to quarterly hear information of heads of the ministries and departments on the course of realization of National strategy and "Road map" with carrying out their critical discussion;

b) To the Jokargi Kenes of the Republic of Karakalpakstan, Kengasham of People's Deputies of areas and the city of Tashkent quarterly to hear information of heads of territorial subdivisions of the ministries and departments on realization of National strategy and "Road map" by regions with carrying out their critical discussion.

5. Approve offers of the Center:

about organization of the breastplate "Inson of himoyasa hukuklara uchun", annually handed for merits in the sphere of human rights protection and increase in culture of respect for human rights in the International day of human rights;

about carrying out at the high organizational level of the Samarkand forum on human rights with participation of representatives of the international organizations, specialists from the foreign states and guests of honor every two years.

6. To the Cabinet of Ministers of the Republic of Uzbekistan in two-month time:

make the government decision on approval of the Regulations on the breastplate "Inson of himoyasa hukuklara uchun";

carry out the organizational measures connected with carrying out in 2020 in the city of Samarkand of the Samarkand forum on human rights.

7. To the center:

in a month to develop and introduce in the Cabinet of Ministers of the Republic of Uzbekistan the Concept of the Samarkand forum on human rights and regulations of its carrying out;

in three-months time together with the Ministry of the higher and secondary vocational education and the Ministry of national education of the Republic of Uzbekistan to make offers on implementation in the public highest educational institutions, organizations specialized on advanced training and retraining of personnel (universities, institutes, the centers, faculties, rates) and also organizations of general average and secondary vocational, professional education of training courses (textbooks) of "Human right", "The right of women", "The child's rights".

8. Determine that to the employees of the Center having academic degree of the candidate of science or doctor of philosophy (PhD) surcharge to 30 percent of official pay rate, having academic degree of the doctor of science (Doctor of Science) - to 60 percent of official pay rate is made.

9. To provide to the Ministry of Finance of the Republic of Uzbekistan allocation of financial resources within the parameters of the Government budget for 2020 for implementation of measures provided in this Decree in accordance with the established procedure.

10. To provide to the agency of information and mass communications under Administration of the President of the Republic of Uzbekistan in cooperation with National news agency of Uzbekistan, National broadcasting company of Uzbekistan, the International press club and National association of electronic mass media:

explanation of essence and contents of this Decree in mass media and the global information Internet;

operational bringing to the general public of the objective and complete information about realization of National strategy.

11. Make changes and addition to the Regulations on the National center of the Republic of Uzbekistan on human rights approved by the resolution of the President of the Republic of Uzbekistan of December 10, 2018 No. PP-4056, according to appendix No. 4.

12. To the center together with the interested ministries and departments in two-month time to make in the Cabinet of Ministers of the Republic of Uzbekistan offers on the changes and amendments in the legislation following from this Decree.

13. To impose control of execution of this Decree on the Prime Minister of the Republic of Uzbekistan A. N. Aripov and the Secretary of the Security Council in case of the President of the Republic of Uzbekistan V. V. Makhmudov.

The national strategy of the Republic of Uzbekistan on human rights

In Uzbekistan questions of encouragement, protection and respect for human rights are one of the priority directions of state policy. Within the Strategy of actions in five priority directions of development of the Republic of Uzbekistan in 2017 - 2021 purposeful measures in the sphere of providing the personal, political, economic, social and cultural rights are implemented.

The question of providing human rights and freedoms in the country turns into the main criterion of the democratic reforms directed to creation of safe and worthy living conditions for our people.

International standards on human rights are systemically and step by step implemented in the national legal system and law-enforcement practice. Now regulations more than 80 international documents in the sphere of the human rights and freedoms ratified by Uzbekistan find the reflection in the national legal system.

The performed large-scale reforms change life, outlook and conduct of life of people. In society the noble purpose "New Uzbekistan is created we will construct together", the new idea "Society - the initiator of reforms" is included into our daily activities more and more actively.

I. Progress in area of human rights

In providing human rights and freedoms specific place is held National and Virtual by receptions of the President of the Republic of Uzbekistan, and also the Prime Minister's receptions on consideration of addresses of entrepreneurs.

The package of measures for further democratization of the judicial and legal sphere, ensuring rule of the Constitution, equality before the law, humanity, justice, independence of judicial authority, implementation of the principle of competitiveness in legal procedure, increases in trust of the population to justice, expansion of Habeas Case institute, strengthening of judicial supervision behind the investigation is accepted.

Significantly powers of lawyers in providing human rights and freedoms, pre-judicial dispute settlement and conciliation of the parties extend.

For ensuring justice, openness and transparency by hearing of cases in courts the Electronic Justice system is implemented. Measures for expansion of system of rendering free legal aid to the population, opportunities of the legal information system "Advice.uz", and also support of the non-state non-profit organization "Madad" providing to citizens free legal advice bureaus are taken.

It is enhanced and more and more the administrative, penal, criminal procedure and criminal and executive legislation adapts to the principle of humanity. Absolutely new system of pardon and release of persons from punishment under the guarantee of public associations is implemented. Closing of the specialized colony on execution of punishments located in the settlement of Zhaslyk Respubliki of Karakalpakstan became important humane event. As a result of the taken measures the number of the convicts containing in places of detention decreased in time 2,5.

Uzbekistan actively participates in the World program of the United Nations (further - the UN) in the sphere of training in human rights. Large-scale measures for execution of the Concept of increase in legal culture in society and the National Action Programme on realization of provisions of the Declaration by training and education in the field of human rights of the UN are implemented. State bodies, institutes of civil society, mass media, educational institutions are widely involved in process of promoting among the population of universal values, the principles of respect and respect for human rights, and also ensuring access of citizens to legal information.

In ensuring the political rights and freedoms of citizens, freedom of thought, the word and beliefs large-scale cardinal transformations in public and public administration are of great importance. Effective mechanisms of parliamentary and public control become stronger. Responsibility of the Cabinet of Ministers to parliament is significantly strengthened. The Electronic Parliament and Electronic Government systems develop, measures for expansion of types, increase in opportunities, quality and efficiency of the state services are taken.

Organization-legal measures for strengthening of role of parliament, institutes of civil society, mass media, and also implementation of the principles "Are implemented the people are the single source and the author of the laws" and "All important decisions are made on the basis of direct dialogue with the people, taking into account opinion of the public".

Introduction of practice of approval by chambers of Oliy Majlis of reports on condition of human rights in the country, the national plans of action ("road maps") for development of cooperation with the international and regional mechanisms of ensuring human rights was new important step in lawmaking.

In Uzbekistan system measures for further strengthening and development of national mechanisms of observance and human rights protection are implemented.
