Rules of import to the territory of the Kyrgyz Republic of live quarantine objects, soils and soil for carrying out scientific research

2. Subject of state regulation of live quarantine objects, the soil and soil (further - objects) are:

- live quarantine types of pincers, nematodes and insects (the Commodity Nomenclature of Foreign Economic Activity code from 0106 41 000 8, from 0106 49 000 1), included in the Single list of quarantine objects of the Eurasian Economic Union approved by the Decision of Council of the Eurasian economic commission of November 30, 2016 No. 158;

- live quarantine phytopathogenic bacteria, viruses (the Commodity Nomenclature of Foreign Economic Activity code from 3002 90 500 0, from 3002 90 900 0), included in the Single list of quarantine objects of the Eurasian Economic Union approved by the Decision of Council of the Eurasian economic commission of November 30, 2016 No. 158;

3. Import to the territory of the Kyrgyz Republic of objects for carrying out scientific research is allowed to the scientific organizations (further - the applicant) which authorized purposes provide implementation of scientific and (or) scientific and technical activities.

4. These rules are not applied to the objects imported into the Kyrgyz Republic in the research purposes from state members of the Eurasian Economic Union.

5. Objects are imported on the territory of the Kyrgyz Republic for scientific research in the presence of issued by authorized state body in the field of quarantine of plants (further - authorized body) import permits on the territory of the Kyrgyz Republic of live quarantine objects, soils and soil for carrying out scientific research in form according to appendix 1 to these rules (further - permission).

6. For receipt of permission the applicant submits to authorized body the application for issue of the import permit to the Kyrgyz Republic of live quarantine objects, soils and soil for carrying out scientific research in form according to appendix 2 to these rules (further - the Statement), with appendix of the verified copy of the agreement (agreement) of delivery and the document confirming state registration (certificate) of the scientific organization in judicial authorities.

7. Responsibility for reliability of the data stated in the Application and the documents attached to it, the applicant bears.

8. The authorized body within 10 working days considers the documents submitted for receipt of permission and makes the decision on issue of permission or on refusal in issue of permission, and within 1 working day in writing notifies on it the applicant. In case of refusal in issue of permission, in the decision causes of failure are specified.

9. In case of disagreement with refusal in issue of permission, the applicant has the right to address to authorized body according to the legislation in the field of administrative activities and ministerial procedures.

10. Conditions of isolation of each sample of objects during the importing, storage and movement on the territory of the Kyrgyz Republic shall provide total absence of risk of distribution in the territory of the Kyrgyz Republic of quarantine harmful organisms.

11. The authorized body within 5 working days from the date of registration of a statement performs venues of scientific research of the objects specified in the Statement on object compliance to isolation conditions when carrying out scientific research.

The official of authorized body performing check notifies the applicant on date and time of its carrying out.

12. By results of check the official of authorized body within 1 working day from the date of its carrying out draws up the inspection statement of venues of scientific research of live quarantine objects, soils and soil on compliance to isolation conditions (further - the Act) according to appendix 3 to these rules in which results of check, with conclusions about compliance or discrepancy of the venue of scientific research of objects to isolation conditions when carrying out scientific research are specified.

13. Based on the Act, and also taking into account the data containing in the Statement, the authorized body makes the following decisions:

1) import of the soil and soil is allowed if:

- in the Statement it is specified about absence/availability in the soil and soil of quarantine harmful organism, or availability in the soil and soil of the organisms which are not quarantine harmful objects;

- in venues of scientific research of objects there are conditions for ensuring deprivation of quarantine harmful objects of viability and disinfection of packaging after completion of scientific research;

2) import of live quarantine harmful objects is allowed:

- in case of observance of conditions of isolation in venues of scientific research of objects;

- if in venues of scientific research of objects there are conditions for ensuring deprivation of quarantine harmful objects of viability and disinfection of packaging;

3) import of objects is not allowed:

- on condition of incomplete or inexact filling the Statement and (or) non-compliance by the applicant with the measures excluding possibilities of infection and (or) contamination of the territory of the Kyrgyz Republic with quarantine harmful organisms;

- in case of discrepancy of the venue of scientific research of objects to isolation conditions when carrying out scientific research.

14. Permission is (in triplicate) signed by the head of authorized body and certified by official stamp.

One copy of permission is issued to the applicant, the second copy goes to the respective check point through Frontier of the Kyrgyz Republic, the third copy with the Statement and is stored by the enclosed documents in authorized body.

Permission is effective within 6 months from the date of its issue and is issued on a grant basis.

15. Permission is terminated:

- after the term for which it is issued;

- in case of liquidation (reorganization) of the scientific organization;

- in case of identification, after issue of permission, false information in the documents submitted for its obtaining.
