About the state support of business activity in the Arctic zone of the Russian Federation

Chapter 1. General provisions

Article 1. Subject and purposes of regulation of this Federal Law

1. This Federal Law determines legal regime of the Arctic zone of the Russian Federation, measure of the state support and procedure of business activity in the Arctic zone of the Russian Federation.

2. The purposes of this Federal Law are:

1) economic development of the Arctic zone of the Russian Federation;

2) stimulation and activization of investing and business activity in the Arctic zone of the Russian Federation;

3) creation of economic basis for the advancing social development and improvement of quality of life in the Arctic zone of the Russian Federation.

Article 2. The basic concepts used in this Federal Law

1. In this Federal Law the following basic concepts are used:

1) infrastructure of the Arctic zone - the building, construction, including the objects of transport, energy, municipal, engineering, social, innovative infrastructures, infrastructure facilities of seaports and objects of other infrastructures located in the territory of the Arctic zone of the Russian Federation;

2) resident of the Arctic zone - the individual entrepreneur or being the commercial organization the legal entity which state registration is performed in the Arctic zone of the Russian Federation according to the legislation of the Russian Federation (except for state and municipal unitary enterprises) which concluded according to this Federal Law the agreement on implementation of investing activities in the Arctic zone of the Russian Federation (further - the agreement on implementation of investing activities) and are included in the register of residents of the Arctic zone of the Russian Federation;

3) authorized federal body - the federal executive body performing functions on development of state policy and normative legal regulation in the sphere of development of the Arctic zone of the Russian Federation;

4) managing company - managing company which according to the Federal Law of December 29, 2014 No. 473-FZ "About the territories of the advancing development in the Russian Federation" is determined by the Government of the Russian Federation for ensuring functioning of the territories of the advancing development in the territory of the Far Eastern Federal District, or its subsidiary.

2. For the purpose of this Federal Law the Arctic zone of the Russian Federation (further - the Arctic zone) is understood as the overland territories and the internal sea waters of the Russian Federation adjoining them and the territorial sea of the Russian Federation, sites of the continental shelf of the Russian Federation, and also lands and islands which can be in the future open are not the territories of foreign states, are located in the Arctic Ocean to the North from the coast of the Russian Federation to the North Pole in limits between the meridian thirty two degrees four minutes thirty five seconds of east longitude from Greenwich passing on East side Wajda lip through triangulable sign on the cape Kekursky and the meridian hundred sixty eight degrees forty nine minutes thirty seconds of the western longitude from Greenwich passing on the middle of the passage, the dividing Big Diomede Island and Krusenstern of group of the Diomede Islands in the Bering Strait on which according to this Federal Law and other Federal Laws measures of the state support of business activity are established.

3. Treat the overland territories of the Arctic zone:

1) territories of the following subjects of the Russian Federation:

a) Murmansk region;

b) Nenets Autonomous Okrug;

c) Chukotka Autonomous Okrug;

d) Yamalo-Nenets Autonomous Area;

2) parts of the territories of the following subjects of the Russian Federation:

a) Republic of Karelia: municipality "White Sea Municipal District", municipality "Kalevalsky National Municipal District", Kemsky municipal district, municipality "Kostomukshsky City District", Loukhsky municipal district, municipality "Segezha Municipal District";

b) Komi Republic: municipality of the city district Vorkuta, municipality of the city district of Int, municipality of the city district Usinsk, municipal district Ust-Tsilemsky;

c) Republic of Sakha (Yakutia): municipal district "Abyysky ulus (area)", municipality "Allaikhovsky Ulus (Area)", municipality "Anabar National (Dolgan-Evenki) Ulus (Area)", municipality "Bulunsky Ulus (Area)", municipal district "Verkhnekolymsky ulus (area)", municipality "Verkhoyansk District", municipal district "Zhigansky national Evenki area", municipality "Momsky District", municipal district "Nizhnekolymsky district", municipal district "Oleneksky Evenki national area", municipality "Srednekolymsky Ulus (Area)", municipal district "Ust-Yansky ulus (area)", municipality "Eveno-Bytantaysky National Ulus (Area)";

d) Krasnoyarsk Krai: municipality city of Norilsk, Taimyr Dolgan-Nenets municipal district, municipality Turukhansky district, rural settlement "Settlement of Surinda", rural settlement "Settlement of Tura", rural settlement "Settlement of Nidym", rural settlement "Settlement of Uchami", rural settlement "Settlement of Tutonchany", rural settlement "Settlement of Yessey", rural settlement "Settlement of Chirinda", rural settlement "Settlement of Ekonda", rural settlement "Settlement of Kislokan", rural settlement "Settlement of Yukta" of the Evenki municipal district;

e) Arkhangelsk region: municipality "City of Arkhangelsk", municipality "Mezen Municipal District", municipality city district Novaya Zemlya, municipality "City of Novodvinsk", municipality "Onega Municipal District", municipality "Primorsky Municipal District", city district Severodvinsk, municipality "Leshukonsky Municipal District", municipality "Pinega Municipal District";

e) Khanty-Mansi Autonomous Okrug: municipality Beloyarsk municipal district, municipality Berezovsky municipal district.

4. Sites of the continental shelf of the Russian Federation on which the measures of the state support provided by this Federal Law are applied are determined by the Government of the Russian Federation.

Article 3. Financial provision of creation (upgrade) of infrastructure facilities of the Arctic zone

Financial provision of creation (upgrade) of infrastructure facilities of the Arctic zone is performed at the expense of means of non-budgetary sources, including using mechanisms of public-private partnership, municipal and private partnership, and also according to the procedure, provided by the budget legislation of the Russian Federation, due to assignments of the federal budget, budgets of subjects of the Russian Federation and budgets of municipalities.

Article 4. Implementation of business activity in the Arctic zone

1. In the Arctic zone implementation of any business activity which is not forbidden by the legislation to the Russian Federation, except for types of business activity which have no right to perform residents of the Arctic zone according to the decision of the Government of the Russian Federation is allowed.

2. The government of the Russian Federation has the right to determine types of business activity in the Arctic zone when which implementing separate measures of the state support of business activity are not applied.

Chapter 2. Management of the Arctic zone

Article 5. Authorized federal body

Authorized federal body:

1) performs issue of construction licenses, permissions to input of objects in operation when implementing construction and reconstruction of infrastructure facilities of the Arctic zone which builders are residents of the Arctic zone or managing company and which are located on the parcels of land provided to managing company according to article 15 of this Federal Law (except for subjects to defense and safety, subjects to use of atomic energy, objects which construction is performed in borders of especially protected natural territories);

2) is approved by procedure for maintaining the register of the residents of the Arctic zone, the scope of information containing in the specified register and also procedure for provision of such data;

3) approves form of the certificate certifying registration as resident of the Arctic zone;

4) approves approximate form of the agreement on implementation of investing activities;

5) exercises control of activities of managing company;

6) provides the parcels of land which are in federal property, free from the third party rights and the real estate objects located in the Arctic zone, and also located on them which are in federal property and free from the third party rights for the purpose of realization by residents of the Arctic zone of investment projects;

7) the 15th signs the agreement, stipulated in Article this Federal Law, on transfer of powers to managing company on provision of the parcels of land which are in federal property, free from the third party rights and real estate objects located in the Arctic zone, and also located on them which are in federal property and free from the third party rights;

8) determines form and procedure for issue of the certificate on accomplishment by the resident of the Arctic zone of terms of agreement of implementation of investing activities;

9) establishes forms of the requests specified in parts 1 and 24 of article 9 of this Federal Law;

10) establishes requirements to the business plan specified regarding the 2nd article 9 of this Federal Law;

11) is approved by giving format electronically of the documents specified regarding the 2nd article 9 of this Federal Law;

12) approves technique of determination of values of maximum permissible variations from the parameters of implementation of the investment project provided by the agreement on implementation of investing activities;

13) ceased to be valid according to the Federal Law of the Russian Federation of 22.07.2024 No. 197-FZ

14) will be organized by provision to residents of the Arctic zone of the services necessary for implementation of activities in the territory of the Arctic zone (including legal services, services in conducting financial accounting, services in customs clearance);

15) performs other powers provided by this Federal Law.

Article 6. Managing company

1. Managing company:

1) is performed by order taking for the conclusion of agreements on implementation of investing activities;

2) signs agreements on implementation of investing activities;

3) is conducted by the register of residents of the Arctic zone;

4) exercises control over the implementation by residents of the Arctic zone of agreements on implementation of investing activities;

5) grants the written certificate on accomplishment by the resident of the Arctic zone of terms of agreement on implementation of investing activities;

6) performs other functions provided by this Federal Law.

2. The functions of managing company provided by part of 1 this Article, performed by it in the territory of the subject of the Russian Federation or on part of the territory of the subject of the Russian Federation relating to the overland territories of the Arctic zone can be transferred based on the agreement signed between authorized federal body and the relevant supreme executive body of the government of the subject of the Russian Federation, to economic society in which at least fifty one percent of shares (shares) belongs to the specified subject of the Russian Federation or non-profit organization which single founder is this subject of the Russian Federation.

Article 7. Public council of the Arctic zone

1. For the purpose of accounting of requirements and interests of the citizens of the Russian Federation living in the Arctic zone, protection of the rights and freedoms of citizens of the Russian Federation and the rights of public associations, non-profit organizations when implementing state policy and normative legal regulation in the sphere of development of the Arctic zone the public council of the Arctic zone is created.

2. Public council of the Arctic zone:

1) is performed by monitoring of processes of interaction between the residents of the Arctic zone and indigenous ethnic groups of the Russian Federation living in the Arctic zone;

2) takes part in development of actions for environmental protection in the Arctic zone;

3) prepares offers for authorized federal body, managing company concerning increase in efficiency of their activities for management of the Arctic zone.

3. Representatives of the all-Russian and regional associations (associations), and also the non-profit organizations performing the activities in the Arctic zone are part of public council of the Arctic zone.

4. The structure of public council of the Arctic zone affirms authorized federal body.

5. The public council of the Arctic zone acts on the basis of the provision establishing procedure for convocation, rotation of structure and holding meetings of public council of the Arctic zone, procedure for adoption of decisions by it and procedure for forming of working groups under the given public advice approved by authorized federal body.

Chapter 3. Legal status of residents of the Arctic zone
