In pursuance of article 2 of the Law of the Republic of Belarus of December 16, 2019 "About change of the Law of the Republic of Belarus "About legal status of foreign citizens and stateless persons in the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES: No. 267-Z

1. Approve Regulations on the List of persons whose entry into the Republic of Belarus is prohibited or undesirable it (is applied).

2. To Committee for State Security, the Ministry of Internal Affairs, the State boundary committee, the Ministry of Foreign Affairs till July 1, 2020 to bring the regulatory legal acts into accord with this resolution, and also to take other measures for its realization.

3. This resolution becomes effective since July 1, 2020, except for Item 2, of this resolution which is becoming effective from acceptance date.

Regulations on the List of persons whose entry into the Republic of Belarus is prohibited or undesirable

Chapter 1. General provisions

1. This Provision establishes procedure for inclusion of foreign citizens and stateless persons (further - foreigners) in the List of persons whose entry into the Republic of Belarus is prohibited or undesirable (further - the List), and exceptions of foreigners of the List, and also procedure for its maintaining.

2. In this Provision the following main terms and their determinations are applied:

The list - databank about foreigners whose entry into the Republic of Belarus is prohibited or undesirable, representing the information and technical system including set the represented Committee for State Security, the Ministry of Internal Affairs, the State boundary committee, the Ministry of Foreign Affairs of information about foreigners which entry into the Republic of Belarus is prohibited or undesirable (further if other is not determined, - the information about foreigners);

maintaining the List - action for representation, accumulating, storage, updating, recovery, transfer, destruction, provision and protection of information about foreigners;

entry in the List - the information about foreigners containing in databank;

protection of the information about foreigners containing in the List - actions for prevention of any unauthorized intervention in process of maintaining the List, including attempts of illegal access to information about foreigners, their blockings, copying, distribution and (or) provision, modification, destruction, and also other wrongful acts concerning the information about foreigners;

entrance closing - complex of the organizational, technical, legal and other measures directed to non-admission of entry into the Republic of Belarus of foreigners, the right to whose entrance is limited on the bases provided by the Law of the Republic of Belarus of January 4, 2010 No. 105-Z "About legal status of foreign citizens and stateless persons in the Republic of Belarus" (further - the Law), and inclusion of such foreigners in the List;

the initiator of closing of entrance - state body which according to this Provision makes the decision on deportation, dispatch, transfer to foreign state according to the international treaty on readmission, denial of entry to the Republic of Belarus and (or) draws up the conclusion on closing (opening) to foreigners of entry into the Republic of Belarus for inclusion them in the List;

the decision - the document on deportation, dispatch, transfer to foreign state which is legally processed according to requirements of the legislation according to the international treaty on readmission, denial of entry to the Republic of Belarus, cancellation of such decisions, permission of entrance and stay in the Republic of Belarus for the term of no more than one month, permission of single entrance and (or) stay in the Republic of Belarus, reducing term of prohibition of entry into the Republic of Belarus;

permission to single entrance and (or) stay in the Republic of Belarus - the decision of the official of body of the border service, customs authority, law-enforcement body on permission to the foreigner included in the List on the basis provided in paragraph six of part one of article 30 of the Law, single entrance and (or) stay in the Republic of Belarus on condition of provision of the documents confirming execution by it of the resolution on imposing of administrative punishment in the form of penalty or obtaining from the foreigner of the obligation about execution of the relevant resolution in the shortest possible time with delivery to it the written notice of need of execution of the resolution on imposing of administrative punishment in the form of penalty during stay in the territory of the Republic of Belarus;

the entry visa and stay in the Republic of Belarus - the decision of the body which made the decision on denial of entry to the Republic of Belarus or on inclusion of the foreigner in the List on permission to the foreigner of entrance and stay in the Republic of Belarus for the term of no more than one month;

entrance opening - complex of the organizational, technical, legal and other measures directed to the foreigner's exception of the List according to the procedure and on the bases established by this Provision;

entrance prohibition term - period of time during which entry into the Republic of Belarus is forbidden the foreigner;

transliteration - exact transfer of signs of one writing signs of other writing in case of which each sign (the sequence of signs) of one system of the letter is transferred by the same sign (the sequence of signs) of other system of the letter.

3. The list is created for the purpose of ensuring accounting of information about foreigners on whom relevant decisions, for the organization of information exchange of state bodies for non-admission of entry of such foreigners into the Republic of Belarus are made.

4. Information on the foreigners included in the List is provided:

to state bodies and other organizations of foreign states, and also the international organizations and interstate educations - according to international treaties of the Republic of Belarus;

to the foreigners included in the List, to their representatives - it is non-paid on their requests, including by means of the global computer Internet on the official site of the Ministry of Internal Affairs, about the actual circumstances and the bases, terms of prohibition of their entry into the Republic of Belarus, except for the foreigners included in the List based on paragraphs of the tenth and eleventh of part one, the paragraph of the fifth of part two of article 30 of the Law.
